Woman sues college instructor for requiring masturbation to pass his course

A creepy college instructor in Nevada required his students to masturbate and reveal their sex fantasies in order to get a pass in his course.
Nick Divito reports for Courthouse News Service, June 28, 2012, that a Western Nevada College student claims in court that her human sexuality instructor, Tom Kubistant, required students to masturbate to pass his class, made them keep sex journals for class discussion, was obsessed with women’s orgasms and told the class “that he will increase their sexual urges to such a height that they won’t be able to think about anything other than sex.”
Western Nevada College (WNC) in Carson City, Nevada’s state capital, is one of four community colleges that are part of the Nevada System of Higher Education.
In her federal complaint filed in U.S. District Court on June 25, 2012, 60-year-0ld Karen Royce sued Western Nevada College, her instructor Tom Kubistant, Kubistant’s department chairman Robert Morin, and college president Carol Lucey, in Federal Court.
Royce says she enrolled in Kubistant’s Human Sexuality class in the fall of 2011, figuring it would help her in her profession as a social worker. The class was part of the Psychology Department at the college’s Carson City campus.
On the first day of class, Royce says, she was shocked when “Kubistant informed the class that he will increase their sexual urges to such a height that they won’t be able to think about anything other than sex.”  He then had students compile lists, which he read, of “all the different kinds of sex, i.e. oral sex, vaginal sex, anal sex,” the complaint states. He told students to compile a list of different sexual positions. Then Kubistant discussed penis myths, told a sex joke and doled out homework: three journal entries of 250 words each, disclosing their personal sexual thoughts, according to the complaint.
Royce says Kubistant told the students that their final exam would be an assignment titled, “A Sexual Case Study … You!” which had to address such topics as early sexual exploration, sexual abuse, loss of virginity, homosexual experiences, promiscuity, cheating, arousal, climaxes, masturbation, sexually transmitted diseases and fetishes.
Plaintiff Royce states: “Upon reaching Kubistant’s requirement that virginity and sexual abuse be disclosed and thoroughly discussed, plaintiff felt pure terror. As a sexual abuse survivor, plaintiff was horrified at the thought of reliving the sexual abuse endured as a child. The memories brought up simply by Kubistant’s requirement forced plaintiff to her bed crying for the entire evening.”
On the second day of class, Kubistant spent the entire 3-hour period discussing female orgasms and female ejaculation, and played a 90-minute movie of women having orgasmic sex, the complaint states. “At the conclusion of the movie, Kubistant asked female students to openly discuss their own orgasms with the class, and then revealed, through reading the students’ journals, ‘We have virgins in the room!'”
Kubistant offered students extra credit if they bought a stun gun for protection and visited sex stores. In the fourth week, Kubistant spent the 3-hour class discussing masturbation and sex toys, according to the complaint.
“During the class, the journal entry of a student sitting next to plaintiff was discussed in detail with it expanding into a discussion about anal sex; the journal entry disclosed an obsession with licking her boyfriend’s ass,” the complaint states.
Kubistant then doled out a homework assignment: Students were to masturbate twice as much as they would normally do, and then disclose specifics in their journals, the complaint states. “Kubistant informed the class that if they were masturbating 14 times a week they must masturbate 28 times a week.”
Royce claims she informed Kubistant that she did not masturbate, causing Kubistant to order her to masturbate at least three times. “Kubistant then angrily announced to the entire class they must masturbate if they intended to pass the class,” according to the complaint.
“Plaintiff contacted several doctors inquiring as to the appropriateness of Kubistant’s behavior,” the lawsuit states. “The doctors indicated they were suspicious as to Kubistant’s intentions and indicated asking for personal, private, sexual disclosures inappropriate and outside the bounds of ethical standards.”
Royce claims Kubistant also required female students to write a journal about their vaginas, to draw a picture of their own vagina and orgasm, and to indicate where they enjoyed being stimulated. “Again, this was to turn in for Kubistant’s purview.” She says the women in the class were required to describe their personal experiences with oral sex, masturbation, standard sex, to identify if they possessed a G-spot and disclose whether they faked orgasms.
“Motivated by her pure and continued terror about memorializing her sexual abuse on paper, plaintiff approached Kubistant requesting modification of the sexual case study assignment,” the complaint states. “Kubistant responded angrily, informing plaintiff she had to detail her own sexual history. Kubistant flippantly dismissed plaintiff’s request stating that her unease in the assignment, i.e. providing Kubistant with a detailed sexual account of her own life, meant she had ‘sexual issues’ and that the project would be cathartic.”
In the fifth week of class, Kubistant broke the class into groups to do 10-minute presentations on different topics: “One group was responsible for bringing in sex toys; another group was responsible for describing (again) the female orgasm; another group was assigned the topic of nudity. Plaintiff’s group was told to demonstrate KY Jelly products and novelty condoms.”
Royce says she asked to do a presentation instead on the health dangers of Vaseline lubricants to women, but “Kubistant flippantly informed plaintiff there was no time for such presentation and that she needed to stick to the topic of novelty condoms.”
After 5 weeks of classes, Kubistant had not followed the syllabus, and did not teach the history of sex, cultural influences on sex or prominent sexual studies, according to the lawsuit. “Instead, the consistent topic Kubistant discussed was the female orgasm. It was a theme and discussed during every class; mentioned during every lecture,” the complaint states.
In October, Kubistant told her that the class was not for her. She says she complained to the college’s administration, “providing an overview of the facts enumerated above,” without result. The complaint states:
“Plaintiff complained about the discrimination, harassment and hostile environment created and perpetuated by Kubistant to Morin, College Department Chairperson. Plaintiff asked Morin if Kubistant’s class had ever been observed in the last seven (7) years; Morin refused to answer informing Plaintiff to contact legal counsel. Plaintiff asked Morin about the faculty handbook policy stating, ‘faculty asking any students about personal sex is sex harassment;’ again, Morin refused to answer, referring plaintiff to WNC legal counsel.”
Royce says she did so, and the college’s attorney informed her that “a claim of sexual harassment could not be made since plaintiff, by signing the Acknowledgement, ‘welcomed’ whatever discrimination and/or harassment Kubistant was committing.”
So Royce withdrew from the class.
She is seeking damages for a hostile and offensive work environment, conspiracy, Title IX violations and violation of equal protection. She is represented by Kenneth J. McKenna.

Jason Howerton reports for The Blaze, July 13, 2012, that Western Nevada College (WNC) is defending Kubistant after an investigator reviewed the course syllabus and interviewed students and found “no evidence” of sexual harassment. WNC spokeswoman Anne Hansen said in a statement:
“The investigator found no evidence to support the student’s complaint of sexual harassment. In fact, the investigator found that the instructor was considered to be an excellent and caring professor, who, with the exception of that one student, appeared to be universally admired by other students who had taken the course.”
I searched for “Tom Kubistant” on WNC’s faculty and staff directory, but came up with no results. That’s likely because Kubistant is a part-time instructor and not one of the college’s permanent faculty. WNC’s course catalog lists only one “human sexuality” course: PSY 130 Human Sexuality. There is no mention of the name(s) of the instructor for the course, nor does the course description make mention of masturbation or revealing one’s sexual fantasies as being part of the course requirements.
This is the page on Tom Kubistant on the Rate My Professors website. Surprisingly (or maybe not surprisingly), he received a 4.8 rating on “Overall Quality” (a 5.0 rating is a perfect score), and comments of “a brilliant man,” “best” or “one of the best professors I have ever had.”

  3. Just how in the HELL does ANYONE “welcome” sexual harassment and/or discrimination”??? It’s legally impossible! That’s the de facto premise for EVERY sexual harassment case from here to Pluto and back again. At first, all I could picture was Harry Reid’s face on the instructor and OMG they found someone even UGLIER!! LOL
    I would have pulled out after the first day, gotten my full money back and told them all to f-off! But then, I was in a (NOT SEXUAL) similar situation and I tried to hang in there in a class, but man, once they said “detail sexual abuse” and I was a past victim??? NO WAY! I be outta here!

Even the good guards oftentimes have something else to do when he’s in danger of “dropping the soap”. Y’all know L was a guard. We had a granddaughter damaged like that – only 5 no less! – her perp was in prison in our state. He couldn’t come up to the prisons around here – they knew a family member was there – but the inmates thought enough about L that postcards and letters went out IMMEDIATELY! The guards didn’t waste any time “gossiping” either. *wicked glee* He lived either 7 years of hell, or in P/C. Karma rocks. As for the inmates, sure didn’t hurt that our little beauty was the same color they were!! Uh huh, looked like their little sisters, such might even drive a gang-banger to cry!   15. I am absolutely stunned! He indeed looks very creepy, very evil looking and he really makes me physically ill. I hope she wins! I wish she would have recorded in class what he had said.

    • You know the class I mentioned up above, that I tried to stick out? Well, I wasn’t going to post a bunch of verbiage, but in MD, one sided taping – illegal, so I asked permission before every class, in front of everyone, cuz he was impossible to follow his lectures. So I had this “meeting” (mental/emotional abuse session) @ his request, on “tape” when I complained to dean. (They wouldn’t listen, but they knew I had proof.) Another dean came to class to lecture, saw some really creepy abusive silent behavior towards me from prof, Based on both, I found out later he was “invited to find employment elsewhere”. YAY FOR ME!! I had a very abusive 2nd ex, took the abuse, never fought back. Fought back this time – AND WON! Man that felt good. Finished the course just fine! 😀

        Show me any other “Human Sexuality” course in any U.S. college or university which requires students to masturbate and write about their most intimate private sexual fantasies and activities — including traumatic abuse experiences — and I’ll refrain from calling YOU a moron. You see, unlike you, I actually have plenty of experience and knowledge about U.S. colleges & universities. Not only was I a college student for many years — through undergrad and graduate schools, graduating with a B.A., M.A., and Ph.D. — I taught in universities, beginning as a part-time Lecturer, then tenure-track Assistant Professor, finally promoted to the top rank of Full Professor. Not only that, but my husband also is a professor, and for longer years than I. And though we are now both Professor Emeriti, we still keep track of what’s going on in academe. And we can tell you this:
        What that creep of an Instructor at Western Nevada Community College required in his Human Sexuality course is entirely improper, inappropriate, and has nothing to do with academic learning.
        For you to defend him and call the plaintiff “a closed-minded moron” tells me you are either a pervert or an ignoramous or just abysmally stupid. I challenge you to find even one similar “Human Sexuality” course curriculum in the colleges and universities in and around Redmond, Washington, where you live. Until you can come up with evidence, shut your big mouth, moron.

    we’re talking boundaries, and personal privacy here, and that teacher crossed the line. it’s possible to discuss “human sexuality” in a classroom setting without turning it into a public “show and tell” session. we all have our private fantasies, but the place to discuss them is in private, with a consenting partner, not in a public classroom.

  19. What he did is equivalent to psychological rape. I’ve taken this course, although at a higher level and at a different University. We were encouraged to share our personal experiences, as it would benefit the entire class, but we were also told doing so, or not doing so, would not have any effect on our grades. What would have caused a student problems was if he or she divulged any personal experiences told by someone in the class. Grades were strictly from the tests/exams/quizzes/papers we were to write and nothing else.
