Mass. judge OKs taxpayer-funded sex change for murderer

MyFoxBoston:  A federal judge on Tuesday ordered state prison officials to provide a taxpayer-funded sex-reassignment surgery to a transgender inmate serving life in prison for murder.

U.S. District Judge Mark Wolf ruled in the case of Michelle Kosilek, who was born as a man but has received hormone treatments and lives as a woman in an all-male prison. Robert Kosilek was convicted of murder in the killing of his wife in 1990.

Wolf is believed to be the first federal judge to order prison officials to provide the surgery for a transgender inmate.

Kosilek first sued the Massachusetts Department of Correction (DOC) 12 years ago. Two years later, Wolf ruled that Kosilek was entitled to treatment for gender-identity disorder, but stopped short of ordering surgery. Kosilek sued again in 2005, arguing that the surgery is a medical necessity.

“Everybody has the right to have their health care needs met, whether they are in prison or out on the streets,” Kosilek said. “People in the prisons who have bad hearts, hips or knees have surgery to repair those things. My medical needs are no less important or more important than the person in the cell next to me.

In his ruling Tuesday, Wolf found that surgery is the “only adequate treatment” for Kosilek’s serious medical need. The court finds that there is no less intrusive means to correct the prolonged violation of Kosilek’s Eighth Amendment right to adequate medical care,” Wolf wrote in his 126-page ruling.

Prison officials have repeatedly cited security risks in the case, saying that allowing her him to have the surgery would make her him a target for sexual assaults by other inmates.

But Wolf found that the DOC’s security concerns are “either pretextual or can be dealt with by the DOC.” He said it is up to prison officials to decide how and where to house Kosilek after the surgery.

I couldn’t find much on the murder victim, Cheryl Kosilek.  On Bonnie’s Blog of Crime, it states, “All I could find was that they had a fight and he strangled her, put her body in her car and left her car in the parking lot of Emerald Square Mall.

The judge’s ruling states, in part, “…that Kosilek is at high risk of serious harm if he does not receive sex reassignment surgery“.  She he is at high risk of suicide because of her his medical  condition.

Too bad no one could have warned Cheryl that she was in high risk of serious harm death by the hands of her husband.

It should be enough to keep this murderer alive and living tax-free for the rest of his life in tax-payer provided facilities.  That’s more of a life than his dead wife Cheryl will ever have.

  1. I’ll be glad to do it for free, and I have all the materials on hand:

    A pair of rusty pruning shears.
    A mallet (anesthesia).
    A wooden spoon to bite down on(if the mallet doesn’t work).
    A 1/2 drill and a 3/4 drill bit (to accomodate his fellow inmates).
    A soldering gun to cauterize bleeders.
    A box of shop towels.
    Baby aspirin for pain.

    I think I have covered with no cost to the taxpayer

     
  2. A little more on the crime he committed: he strangled his wife with wire, almost decapitating her. After disposing of her body, he treated himself to a steak dinner. If you’re interested, there is a petition to stop this lunacy at atlasshrugs.com.

  5. A more in-depth article on the sordid affair. The price of the surgery listed here is much lower than what Dr. Drew stated last night as being between $50,000 and $100,000. Also interesting to note that bigmouth Sandra Fluke has added free sex-change surgery to her talking points.

    Taxpayers have already paid for hormone treatments, laser hair removal, psychotherapy, and antidepressants for this slug. What if he changes his mind again after the surgery? How many times are we on the hook for this nutball?

     
  6. This is why this is becoming a huge waste of Taxpayers time and money. Not only is he going to be a danger towards women at women’s prison, he’s going to be a security nightmare for prison officials. It’s why I think the state should have put him on death row or Super max with no contact with anyone outside of prison.

     
  7. First, the judge: You’re telling me it took 126 pages to say “Give the perv the surgery”?? What kind of judge sticks the people with the tab for that, then says ‘security concerns can be dealt with by the DOC’?? He’s leaving them holding the bag, so if something happens to him/her, it will be DOC’s fault, not his. That’s just downright irresponsible. By the way, the judge looks like a perv too…what’s he do under…never mind. Also notice, the judge didn’t order the surgery, so there’s another issue that someone will have to deal with. On the other hand, by not ordering the surgery, that could leave the whole issue in limbo indefinitely, or until the other prisoners take care of things in the way that prisoners do.

    Next, the prisoner and/or his lawyer: We’re doing this to prevent this prisoner from committing suicide???? That gives it medical credence?? I’d say let’s take our chances, and if he does….well, then, gee, that’s too bad, one less prisoner to pay for.

    Last, our prison system is way too soft. Being in prison, especially for murder, means you’re being punished; it’s not just an orange jump suit and a change of address.

     
    • Not to mention, they’re attributing the suicide attempts to his ‘inner conflict’, when he was on antidepressants during at least one attempt…antidepressants have been known to CAUSE suicide attempts, especially the one he was on.

       
  8. I agree…I should have gotten a clue when they stopped calling them prisons and started calling them “correctional centers”. The first sign something was going haywire.

     
  9. you should see how quick the LGBT community is quick to celebrate that one of their own is getting SRS on taxpayers dime. They even tried to squash opposition and labeled anyone who was against it a bigot and transphobic. It’s liberalism to the extreme in the LGBT camp
