Private property rights battle: Court rules Missouri couple must plant grass, even though wife is allergic

From Kansas City.com: A Missouri couple decided to turn their entire yard into a flower garden.  It turns out, that was against a city ordinance, which says half of residents’ yards must be grass turf.
But the wife is allergic to grass. Now a federal judge has ruled: tough.
So Janice and Carl Duffner are vowing to fight on.
Their city of St. Peters, near St. Louis, put the Duffners on notice that they must comply with the law. The Duffners said at the time they filed their civil rights action in late 2016 they were subject to penalties of $180,000 and 20 years in jail for non-compliance.
“If the city is permitted to impose draconian fines and imprisonment simply because a citizen chooses to cultivate on their own private property lawful, harmless plants of their own choosing instead of a potentially harmful plant of the government’s choosing, there is no longer any principled limit to the government’s control over either the property or the owners,” the Duffners’ complaint stated.
The Duffners bought their home in 2002 and began landscaping that included planting beds, two small ponds, pathways and seating areas. The St. Peters Board of Aldermen adopted the turf ordinance in 2008. At some point, an unidentified person complained to the city that the Duffners had no grass.
The Duffners asked for an exemption but were denied. Instead, the Board of Adjustment in 2014 told them to plant at least 5 percent of their property with grass. They refused.
In its response to the federal complaint, the city noted that the Duffners had first gone to circuit court in St. Charles County and had lost there because they had failed to exhaust their administrative remedies. After a mixed ruling from the Missouri Court of Appeals, the Duffners turned to federal court.
U.S. District Judge John A. Ross (appointed by Obama) last week ruled for the city, saying the Duffners “have failed to identify a fundamental right that is restricted by the Turf Grass Ordinance.” The judge said the Supreme Court has held that “aesthetic considerations constitute a legitimate government purpose.”
Ross also said the Duffners failed to demonstrate that the penalties for violating the turf ordinance are excessive and contrary to the Eighth Amendment.
The Duffners’ attorney, David Roland of the Freedom Center of Missouri, told the Riverfront Times that the couple will appeal.
“My estimation is that this is one of the most important property rights cases in the country right now,” he said. “We’re going to go all hands on deck.”

Proof that USA is less free under Obama

When Barack Hussein Obama was elected president in 2008, he vowed that he would “fundamentally transform” America.
Most people either didn’t believe him or simply didn’t bother to think about what “fundamental transformation” means.
Since the United States was founded on the principles of limited government, individual freedom, and free-market capitalism, Obama’s “fundamental transformation” must mean a drastic (“fundamental”) change (“transformation”) from:

  1. Limited to unlimited government, the most unlimited being a totalitarian state, wherein the all-seeing state reaches into every niche and cranny of our lives. (See the NSA’s tracking and recording of our every phone call, email, and financial transaction.)
  2. Individual freedom to political tyranny, whether government or the cultural tyranny of “political correctness.”
  3. Free-market capitalism to big-corporate socialism (fascism) or communism.

Put simply, the third transformation is the diminution or loss of economic freedom.
What is “economic freedom”? From the Fraser Institute, a Canadian libertarian think-tank:

Economic freedom has been shown in numerous peer-reviewed studies to promote prosperity and other positive outcomes. It is a necessary condition for democratic development. It liberates people from dependence on government in a planned economy, and allows them to make their own economic and political choices.
The classic definition of economic freedom is:

Individuals have economic freedom when property they acquire without the use of force, fraud, or theft is protected from physical invasions by others and they are free to use, exchange, or give their property as long as their actions do not violate the identical rights of others. An index of economic freedom should measure the extent to which rightly acquired property is protected and individuals are engaged in voluntary transactions. (James Gwartney and Robert Lawson et al., Economic Freedom of the World: 1996 Annual Report)

Interestingly, nations that are economically free out-perform non-free nations in every indicator of well-being — those of average per capita GDP, average income of the poorest 10% of the population, life expectancy, and political and civil liberties.
Every year, the Fraser Institute undertakes a measurement — an index — of the degree to which the policies and institutions of countries are supportive of economic freedom. The results are published in an annual report, Economic Freedom of the World.
The index of each country is derived from 42 data points that are used to measure the degree of economic freedom in 5 broad areas:

  1. Size of government: expenditures, taxes, and enterprises
  2. Legal structure and security of property rights
  3. Access to sound money
  4. Freedom to trade internationally
  5. Regulation of credit, labor, and business

According to the Fraser Institute’s Economic Freedom of the World 2014 Annual Report, President Ebola can claim great success in “fundamentally transforming” by greatly reducing the economic freedom of Americans.
Here’s a screenshot I took of page 172 of the 2014 Report, on the economic freedom of the United States from 1980 to 2012:

As you can see, in 4 of the 5 areas of economic freedom, the U.S. has declined drastically in 2012, as compared to 1980 or even to 2005 (under George W. Bush):

  1. Size of government: The U.S. ranked 49th in the world in 1980, and 46th in 2012.
  2. Legal system and property rights: The U.S. ranked 1st in the world in 1980, but 36th in 2012.
  3. Access to sound money: The U.S. ranked 5th in the world in 1980, 1st in 2005, but plummeted to 38th in 2012.
  4. Freedom to trade internationally: The U.S. ranked 7th in the world in 1980, but fell to 29th in 2012.
  5. Regulation: The U.S. ranked 4th in the world in 1980, 6th in 2005, but 10th in 2012.

Overall, when all 5 areas are summarized, in 1980 the U.S. ranked 3rd in the world in economic freedom, falling to 9th in 2005, then worsened further to 14th in 2012.
The top 10 countries in economic freedom are:

  1. Hong Kong
  2. Singapore
  3. New Zealand
  4. Switzerland
  5. Mauritius
  6. United Arab Emirates
  7. Canada
  8. Australia
  9. Jordan
  10. Chile/Finland (a tie)

The 10 least economically free countries are:

10. Myanmar (formerly Burma)

9. Democratic Republic of Congo

8. Burundi

7. Chad

6. Iran

5. Algeria

4. Argentina

3. Zimbabwe

2. Republic of Congo

And the least economically free country in the world is actor Sean Penn’s favorite country:

1. The late Hugo Chavez’s Venezuela

Agenda 21-Huffpo Hack's Bias Exposed by Rosa Koire

We owe a debt of gratitude to Rosa Koire for getting out a heads-up on this.  She was approached by Huffpo “journalist”, Andrew Reinbach, who wanted an interview for a story he was doing about U.N. Agenda 21.  The main thrust of the interview was his determination to blame the “vast rightwing conspiracy” aka John Birch Society for making an issue of the harmless little non-binding Agenda 21. 
Rosa laid it on the line…. BIG TIME!   She blogged about it on her website and posted the  interview on Youtube!

When you read his article, it’s as if the 44 minute interview with Rosa never happened.  It didn’t fit the narrative of tin foil hat JBS paranoia he had in mind .

How the Tea Party Is Upending Urban Planning

…Across the country, Tea Party activists have been storming planning meetings of all kinds, opposing various plans by local and regional government having anything to do with density, smart growth, sustainability or urbanism. In California, Tea Party activists gained enough signatures for a ballot measure repealing the state’s baseline environmental regulations, while also targeting the Senate Bill 375, the 2008 law that seeks to combat climate change by promoting density and regional planning.
…We’ve spent a lot of time and effort on fostering civic engagement, through a program for mediating land use disputes, or helping community residents visualize future scenarios. Since Jacobs, giving people a voice has been paramount in planning. Local Tea Party leaders attack those kinds of efforts as a ruse – that planners have draped the public process with the trappings of citizen input, while in fact all the decisions to promote smart growth have already been made. Some might wonder whether there’s some truth to that.
Yet, as in national politics, the Tea Party view doesn’t leave room for compromise. Even the most open-minded and free-speech supporting planner can’t operate when the framework for the dialogue itself has been invalidated. Where does one go from there? The skirmishes at town halls around the country over the past year or so means that planners will have to try even harder to make their case. But in the mean time, the chairman of that sleepy planning board hearing might be eying the exits, looking for a black helicopter, to make a run for it.       Full Article

Agenda 21- California Court Blew Up the Gravy Train

If the city keeps its staff and finishes its projects, the price tag would be more than $109 million.
City Administrative Officer Miguel Santana is instructed to begin the process of laying off 192 redevelopment employees….
….. Santana said redevelopment agency staffers make an average of $109,000 annually, considerably more than the $72,000 average of other city employees. They also would bring higher city pension costs because they do not contribute toward their retirement benefits.

L.A. lawmakers vote to discard redevelopment agency

The Los Angeles City Council voted Wednesday to relinquish control of its redevelopment agency, leaving the task of shutting down hundreds of millions of dollars in activities to some other branch of government.
On a 9-3 vote, the council decided to in effect walk away from the agency and 192 employees.
The vote came one day after the city’s financial analysts warned that the budget, which is already in dire shape, could face more than $109 million in costs if it took responsibility for redevelopment, which is being eliminated statewide.The reality of the situation is the CRA [Community Redevelopment Agency] as we know it is dead,” said Council President Herb Wesson. “And I think it’s time for us to take it off of the machine.
The vote took place despite opposition from union officials, affordable housing advocates and lobbyists for real estate interests. Councilman Richard Alarcon voted against the move, saying the council should use “every minute” of the next two days reviewing the legal issues.
“We should fight for these employees. We should fight for these projects. We should fight in court if necessary,” he said.
Under the state law that killed redevelopment, each local government must decide whether to become a so-called “successor” to its redevelopment agency. With L.A. no longer in play, the County Board of Supervisors could decide to do so.   Full Story

This video was recorded at Rosa Koire’s conference on Agenda 21, “Behind the Green Mask”, August 6, 2011 in Santa Rosa, California.
Agenda 21 is the Master Plan put forth by the United Nations in 1992 and adopted by President Bill Clinton.
