Private property rights battle: Court rules Missouri couple must plant grass, even though wife is allergic

From Kansas City.com: A Missouri couple decided to turn their entire yard into a flower garden.  It turns out, that was against a city ordinance, which says half of residents’ yards must be grass turf.
But the wife is allergic to grass. Now a federal judge has ruled: tough.
So Janice and Carl Duffner are vowing to fight on.
Their city of St. Peters, near St. Louis, put the Duffners on notice that they must comply with the law. The Duffners said at the time they filed their civil rights action in late 2016 they were subject to penalties of $180,000 and 20 years in jail for non-compliance.
“If the city is permitted to impose draconian fines and imprisonment simply because a citizen chooses to cultivate on their own private property lawful, harmless plants of their own choosing instead of a potentially harmful plant of the government’s choosing, there is no longer any principled limit to the government’s control over either the property or the owners,” the Duffners’ complaint stated.
The Duffners bought their home in 2002 and began landscaping that included planting beds, two small ponds, pathways and seating areas. The St. Peters Board of Aldermen adopted the turf ordinance in 2008. At some point, an unidentified person complained to the city that the Duffners had no grass.
The Duffners asked for an exemption but were denied. Instead, the Board of Adjustment in 2014 told them to plant at least 5 percent of their property with grass. They refused.
In its response to the federal complaint, the city noted that the Duffners had first gone to circuit court in St. Charles County and had lost there because they had failed to exhaust their administrative remedies. After a mixed ruling from the Missouri Court of Appeals, the Duffners turned to federal court.
U.S. District Judge John A. Ross (appointed by Obama) last week ruled for the city, saying the Duffners “have failed to identify a fundamental right that is restricted by the Turf Grass Ordinance.” The judge said the Supreme Court has held that “aesthetic considerations constitute a legitimate government purpose.”
Ross also said the Duffners failed to demonstrate that the penalties for violating the turf ordinance are excessive and contrary to the Eighth Amendment.
The Duffners’ attorney, David Roland of the Freedom Center of Missouri, told the Riverfront Times that the couple will appeal.
“My estimation is that this is one of the most important property rights cases in the country right now,” he said. “We’re going to go all hands on deck.”

Missouri bar using "Lynch" and "Kaepernick" jerseys as doormats

From KOMU: A Lake of the Ozarks bar owner was taking heat Tuesday for what at least one passer-by saw as a racist doormat out front.
“It’s not a race thing,” said Jason Burle, who owns the S.N.A.F.U Bar near the Bagnell Dam. “A lot of people want to twist it around to be a race thing.”
Burle said he ordered two NFL jerseys to be used as doormats outside his bar after NFL players started kneeling during the national anthem at football games.
“We pulled them out of the box, taped them down. There was no ill-intent,” Burle said.
Burle used the jerseys of NFL players Marshawn Lynch and Colin Kaepernick. When placed side-by-side, the jerseys read “Lynch” “Kaepernick.”
“If someone thinks that I mean personal harm to someone, they don’t know me,” Burle said.
But that’s what crossed Taylor Sloan’s mind when he saw the jerseys outside Burle’s bar over the weekend.
“That’s not the Missouri I know,” Sloan said. “It just kind of upset me really bad. Put a bad taste in my mouth.”
Sloan posted on the bar’s Facebook page. He and Burle had a heated exchange online.
Sloan wrote on the page, “You are also expressing hate, violence and continuing American racism under the faux guise of patriotism.”
Burle responded, “It’s funny to me that someone would look that far deeply into it just to find a racist link.”
Burle told KOMU the doormat is about standing up for himself and his family, many of whom served in the military. Burle spent six years in the Air Force. Seeing NFL players kneel during the national anthem didn’t sit well with him.
“A lot of us military folks take that personal to heart,” Burle said.

Aetna ditching 70% of its ObamaCare business

Via NY Post: Insurance giant Aetna won’t be offering coverage under ObamaCare next year in 11 of the 15 states it now serves — an announcement that instantly became an issue in the presidential race.
Aetna’s decision led Donald Trump to charge that President Obama’s health care reform was “imploding.” “Aetna’s decision to leave the Affordable Care Act’s public marketplaces is the latest blow to this broken law that is slowly imploding under its regulatory red tape,” said Trump campaign deputy national policy director Dan Kowalski.
Millions of Americans have lost their health coverage under this disastrous policy, eliminating their ability to choose their doctors. Thousands of businesses have been forced to cut employment or shutter their doors in response to Obama’s signature achievement,” he added.
The company had previously warned that it expected to lose more than $300 million this year on the 900,000 patients it covers under the Affordable Care Act. Aetna said it is pulling out of ObamaCare markets in Arizona, Florida, Georgia, Illinois, Kentucky, Missouri, North Carolina, Ohio, Pennsylvania, South Carolina and Texas.
Aetna does not currently offer the policies in New York. It does offer other medical insurance to individuals and small businesses as well as large employers in the state, officials said. It will continue to offer policies in Delaware, Iowa, Nebraska and Virginia.
ObamaCare is credited with expanding coverage to millions of previously uninsured or under-insured people.

But insurers have complained they have lost money on the policies. United Health Group and Humana are other insurers exiting ObamaCare plans.
Aetna CEO Mark Bertolini, in a statement, said there were not enough younger, healthier customers signing up to make ObamaCare policies sustainable. “The vast majority of payers have experienced continued financial stress within their individual public exchange business. Providing affordable, high-quality health care options to consumers is not possible without a balanced risk pool,” Bertolini said.
More than a dozen nonprofit insurance co-ops have shut down in the past couple years. The pullouts could spell trouble because competition is supposed to help control price increases.
Some states like Alaska and Oklahoma will be left with only one insurer selling ObamaCare plans to individuals in 2017. More densely populated states like New York say their ObamaCare markets remain strong.
But rates for customers are skyrocketing to maintain stability.

Citing increased medical costs, New York recently authorized insurers offering individual ObamaCare plans to increase premiums by an average 16.6 percent — the highest rate hike in the program’s four-year existence. New York’s small businesses will get hit with an average 8.3 percent rate hike.

Pinned inside her mangled Mercedes, seriously injured and fading fast, Katie Lentz turned to her rescuers on the lonely open stretch of Missouri highway and asked them to pray.
Struck head-on by a drunk driver on Sunday morning, emergency workers had been battling for an hour and a half to free Lentz, but to no avail.
But as they joined hands a Catholic priest appeared, even though there were no bystanders and the road was blocked, who offered a prayer and an instruction to the rescuers that they would now be able to free her.
Suddenly, heavy equipment needed to cut through the metal arrived from a nearby town and Lentz was pulled from the wreck in time to be saved – but when they turned to thank the priest, he was gone.
‘He came up and approached the patient, and offered a prayer,’ Chief Raymond Reed told KHQA-TV.
‘It was a Catholic priest who had anointing oil with him. A sense of calmness came over her, and it did us as well.
‘I can’t be for certain how it was said, but myself and another firefighter, we very plainly heard that we should remain calm, that our tools would now work and that we would get her out of that vehicle.’

State nullification laws threaten feds with felonies on gun controls

The Save America Foundation has collected data for the following report:
Texas, Florida, South Carolina, Missouri, Indiana, Tennesee, Oklahoma, North Dakota, New Mexico, Arizona, Alaska and Wyoming have proposed legislation to either jail federal officials who violate the second amendment or to nullify federal laws to control guns within state borders.
Notably, the bills for Missouri and Florida threaten public officials, including federal agents, with felonies and jail time if they attempt to enforce certain federal gun control measures. The Missouri bill reads in part,
“Any official, agent, or employee of the federal government who enforces or attempts to enforce any act, order, law, statute, rule, or regulation of the federal government upon a personal firearm, a firearm accessory, or ammunition that is owned or manufactured commercially or privately in the state of Missouri and that remains exclusively within the borders of the state of Missouri shall be guilty of a class D felony.”
Florida’s likewise:
Any official, agent, or employee of the government of the United States, or employee of a corporation providing services to the government of the United States who enforces or attempts to enforce any act, order, law, statute, rule or regulation of the United States government upon a civilian-owned firearm, a firearm accessory, or  ammunition that is owned, sold, transferred, or manufactured commercially or privately in Florida shall be guilty of a felony and, upon conviction, shall be subject to imprisonment for not less than one   (1) year and one (1) day or more than five (5) years, a fine of not more than five thousand dollars ($5,000.00), or both.

Dangerous heat and humidity continue

  • The life-threatening combination of very hot temperatures and extreme humidity levels continues across the Plains, Mississippi Valley and Midwest.
  • High temperatures should reach the 90s to near 105 degrees this afternoon with the hottest readings in southwest Kansas.
  • Heat indices (combining the air temperature with the relative humidity) should be in a 100 to 125 degree range.

In Missouri, the oppressive heat is already being blamed for 9 suspected heat-related deaths in the Kansas City area, and has sicken more than 130 in St. Louis this weekend alone. Mayor Francis Slay walked door-to-door in the 4400 block of 39th Street on the South side Sunday telling residents to protect themselves and their neighbors. “This is an excellent time to be a good neighbor. Make sure everyone, especially children, seniors, and pets are keeping cool. If you know of individual who has an air conditioner but you cannot hear it running, please encourage them to turn it on.”

In Texas, wildlife are abandoning their young because of the extreme heat and prolonged drought.

Pregnant does are having problems carrying fawns to term, and most of them born prematurely aren’t surviving. Other does are abandoning their newborns because drought-induced malnutrition has robbed them of their ability to produce milk.

Song birds and birds of prey also are suffering in the drought. They are abandoning the nest and abandoning the young because they are unable to feed themselves to fly and get food to feed the young.

USDA Fines Family $4 Million For Selling Bunny Rabbits

The federal government, in the person of the Dept of Agriculture, slapped a fine of $4 MILLION on a family in Nixa, Christian County, Missouri for selling bunny rabbits.
UPDATE: The Dollarhite family is standing firm and refusing to pay the fine. According to this site, a protest was organized for yesterday in front of the Springfield, Missouri USDA office. The protest was organized by the president of the Branson Farmer’s Market organization and members of We Are Change Branson and the Branson Tea Party.

USDA fines family four million dollars for selling bunny rabbits

When the Dollarhite family of Nixa, Mo., first started raising and selling bunnies as part of a lesson to teach their teenage son about responsibility and hard work, they had no idea they would eventually meet the heavy hand of the US Department of Agriculture (USDA). According to a recent article covered in Breitbart’s Big Government, the USDA recently ordered the Dollarhite family to pay more than $90,000 in fines because they sold more than $500 worth of rabbits in a year — and if they fail to pay the fine by Monday, May 23, the fine will multiply to nearly $4 million.It all started back in 2006 when John Dollarhite and his wife Judy rescued two rabbits that ended up breeding. The family cared for and raised the new rabbits, and eventually began to sell them to neighbors, friends, and others for $10 or $15 each. Having started by first selling the animals for meat, and later for show, the Dollarhites carefully and humanely raised the small creatures on their three-acre homestead, all while teaching their son honest values in a business environment similar to running a small lemonade stand.
Eventually, the Dollarhites developed such a highly-respected reputation across Missouri that the popular Branson, Mo., theme park Silver Dollar City, and even a local pet store, Petland, began purchasing bunnies from the family in 2009. And according to John, individuals from both Silver Dollar City and Petland, as well as a rabbit competition judge, told him that the family’s bunnies were among the best they had ever seen — healthy, beautiful, and very well-cared for.
All seemed well until a USDA inspector showed up at the family’s home in the fall of 2009, and asked to do a “spot inspection” of the rabbitry. The inspector made no indication that anything was amiss, but only that she wished to see the facility. After meandering the premises, the inspector claimed that a few very insignificant aspects of the raising facility were in violation of USDA standards, even though the Dollarhites were not USDA certified, nor were they required to be. She then asked if the Dollarhites wished to be part of the voluntary USDA certification system, upon which they told her they would look into it.
After the inspector left, the Dollarhites heard nothing more from the USDA until January 2010 when a Kansas City-based USDA inspector called the family and said he needed to have a meeting with them because they sold more than $500 worth of rabbits in a single year. When the Dollarhites asked why this was a problem and what law this violated, the man refused to offer an explanation over the phone.
Upon meeting in person, the inspector said he was only there to investigate the rabbitry and take notes for a report, upon which he instructed the family to contact another USDA office if they failed to hear anything further from the USDA after six weeks. As the eighth week arrived without any communication, John called the office and was redirected to the Washington, DC, office where a lady shockingly and bluntly explained to him that she had his report, and that the USDA planned to prosecute him and his family “to the maximum that we can” in order to “make an example” out of him.
Shortly thereafter, the Dollarhites received a letter from the USDA Animal and Plant Health Inspection Service (APHIS) ordering them to pay a fine of $90,643 for supposedly violating a mystery law that prohibits the selling of more then $500 in rabbits within a year, even though the Dollarhites were in full accordance with Missouri state law, did not sell their rabbits across state lines, and raised their rabbits humanely and in excess of minimum requirements. The letter outlined that the Dollarhites had until May 23 to pay the exorbitant fine, or else face additional fines totaling nearly $4 million — all for selling about $4,600 worth of rabbits that netted the family a mere $200 in profits.
The whole scenario proves, once again, that the USDA is nothing more than a tag-team terrorist duo with the US Food and Drug Administration (FDA). Both agencies’ insatiable lust for power and control over private affairs is never satisfied, as they continue to prowl around like bloodthirsty predators seeking whoever and whatever they can devour. When will Americans finally stand up to their tyranny and say enough is enough?

Largest Earthquake Drill in Central U.S. History

What does our government know that it’s not telling us?
The last few days have seen swarms or clusters of earthquakes in Arkansas, ranging from 2.0 to 3.3 in magnitude. Arkansas is one of 8 states that make up the New Madrid Seismic Zone or Fault Line. The other 7 states are Missouri, Illinois, Indiana, Kentucky, Tennessee, Alabama, and Mississippi.

The 150-mile…long fault system, which extends into five states, stretches southward from Cairo, Illinois; through Hayti, Caruthersville and New Madrid in Missouri; through Blytheville into Marked Tree in Arkansas. It also covers a part of West Tennessee, near Reelfoot Lake, extending southeast into Dyersburg. Most of the seismicity is located between 3 and 15 miles…beneath the Earth’s surface.
The zone had four of the largest North American earthquakes in recorded history, with moment magnitudes estimated to be as large as 8.0, all occurring within a three-month period between December 1811 and February 1812…. Based on artifacts found buried by sand blow deposits and from carbon-14 studies, previous large earthquakes like those of 1811-1812 appear to have happened around AD 1450 and around AD 900, as well as approximately AD 300. Evidence has been found for an apparent series of large earthquakes around 2350 BC.
[The earthquakes on February 7, 1812, had magnitudes of 7.4 to 8.6 with their] epicenter near New Madrid, Missouri. New Madrid was destroyed. At St. Louis, Missouri, many houses were severely damaged, and their chimneys were toppled. This shock was definitively attributed to the Reelfoot Fault by Johnston and Schweig. It was uplift along this reverse fault segment, in this event, that created waterfalls on the Mississippi River, disrupted the Mississippi River at Kentucky Bend, created a wave that propagated upstream and caused the formation of Reelfoot Lake. The earthquakes were felt as far away as New York City and Boston, Massachusetts, where ground motion caused church bells to ring….
In a report filed in November 2008, The U.S. Federal Emergency Management Agency warned that a serious earthquake in the New Madrid Seismic Zone could result in “the highest economic losses due to a natural disaster in the United States,” further predicting “widespread and catastrophic” damage across Alabama, Arkansas, Illinois, Indiana, Kentucky, Mississippi, Missouri and particularly Tennessee…. The earthquake is expected to also result in many thousands of fatalities, with more than 4,000 of the fatalities expected in Memphis alone…. The USGS [U.S. Geological Society] recently issued a fact sheet reiterating the estimate of a 10% chance of a New Madrid earthquake of magnitude comparable to those of 1811-1812 within the next 50 years, and a greater chance of a magnitude 6.0 earthquake in the same time frame.

BREAKING: Rep. Emanuel Cleaver Earmarks $48 BILLION to Pal Who Runs Child Day Care Center From Home With His Wife

Earlier today it was reported that far left Representative Emanuel Cleaver (D-MO) proposed a $48 billion earmark to redistribute taxpayer money to the inner city.
It was the Mother of All Earmarks…
Liberal Rep. Emanuel Cleaver proposed a whopping $48 BILLION EARMARK that would redistribute wealth to the inner cities and gift money to the poor and thereby produce a much larger consumer class to buy the goods and services produced in this country.

The $48 billion would go to Cleaver’s friend, a gentleman named Lamar Mickens, president of the not-for-profit Quality Day Campus who runs the organization out of his Kansas City home.

Currently Mickens operates this massive proposal out of his home but with Cleaver’s help, this earmark could put him on the road to success. 

Cleaver provides a link to a Mickens “manifesto” where a lengthy agenda is outlined — but again with no specifics other than the rich should provide money to the poor so that the poor will have more money to spend.

Lamar Mickens is the President and the Treasurer of Quality Day Campus, Inc. His wife Cynthia is the Vice President of Quality Day Campus, Inc.
It says so on their handwritten Annual Report!

And get this… It’s classified as a child day care center that he runs out of his home!
This is UNBELIEVABLE!
Rep. Cleaver is asking for $48 billion to donate to his friend’s shady day care center that is run out of a Kansas City home?
Rep. Cleaver has some explaining to do.
