From Fox News: Eleven MS-13 gang members – all of whom are illegal immigrants aliens except one – are facing life in prison after being charged in the kidnappings and deaths of two teens whose bodies were dug up in a Virginia park last year.
The ages of the male gang members charged Friday ranged from 20 to 27. All of them are from El Salvador and only one – who is believed to have fled the country – is not in police custody, according to NBC Washington.
Police uncovered the bodies of 17-year-old Edvin Escobar Mendez and 14-year-old Sergio Arita Triminio at Holmes Run Park in March 2017 after receiving a tip. The two teens disappeared just weeks apart the prior year.
After Mendez vanished and was reported missing by his family, his brother tracked down Triminio – one of his friends – who revealed to him that Mendez was “abducted or killed” because the MS-13 members thought he was allied with a rival gang.
Two days after that reported conversation, Triminio, who lived near Holmes Run Park, disappeared while taking out the trash. “He never came back,” his mother said.
Investigators believe Triminio was killed because the MS-13 members thought he was working as a police informant, a federal indictment said. A court-ordered electronic monitoring device that Triminio was wearing, per his probation orders, stopped working the day he vanished, the documents added.
All but one of the men facing the conspiracy to kidnap charges are reported to be illegal immigrants aliens, and one suspect is facing a conspiracy to commit murder in aid of racketeering charge.
The names of those charged are Elmer Zelaya Martinez, 27, Erick Palacios Ruiz, 20, Ronald Herrera Contreras, 20, Josue Vigil Mejia, 21, Henry Zelaya Martinez, 24, Oscar Contreras Aguilar, 20, Yonathan Melgar Martinez, 21, Pablo Miguel Barrera Velasco, 20, Anderson Villatoro, 21, Francisco Avila Avalos, 20 and Fredys Baires Abarca, 20. Their gang member aliases included nicknames such as “Killer”, “Horror” and “Lil Clandestino”.
All of them are charged with conspiracy to kidnap, while Aguilar is also charged with conspiracy to commit murder in aid ofracketeering.
MS-13 was started by Central American immigrants, mainly from El Salvador, in Los Angeles in the 1980s and has expanded to include Hondurans, Guatamalans, Mexicans and other Central and South Americans.
President Trump’s Justice and Homeland Security Departments have made targeting the gang a top priority. The president himself has used the word “animals” to describe the gang.

From Houston Chronicle: Lawyers for Houston-area serial killer Danny Bible filed a civil rights suit Friday alleging the aging death row inmate is in such poor health that any attempts to execute him will end in a gruesome, botched procedure.
The so-called “ice pick killer” has Parkinson’s, bad veins and a slew of other medical conditions that raise the possibility of a prolonged and painful lethal injection process his lawyers argue could violate the 8th Amendment’s ban on cruel and unusual punishment.
The 66-year-old is scheduled to die on June 27.
“Texas will almost certainly join Alabama and Ohio and add itself to the unconscionable list of botched executions in America,” his attorney Jeremy Schepers told the Chronicle.
“Mr. Bible is an elderly, frail man who has been confined to a wheelchair for the last 15 years and his health is rapidly deteriorating,” he continued. “Recent medical evaluations confirm that his veins are inaccessible and unsuitable for placing an IV. Any attempts to carry out the execution will amount to torture, cause excruciating pain, and violate his constitutional rights.”
Bible’s bid for reprieve comes months after a high-profile botch that forced officials in Alabama to call off the execution of Doyle Hamm, a 61-year-old death row prisoner with lymphoma. In February, a lethal injection team there spent hours poking the condemned killer’s arms, legs and groin to find a usable vein before ultimately giving up as the midnight deadline approached.
Previously, Ohio saw similarly botched procedures in the attempted execution of Romell Broom in 2009 and Alva Campbell in 2017. Schepers writes that Bible is in worse health than Hamm, Campbell or Broom.
The Texas lethal injection preparation – a part of the process media and witnesses are not permitted to observe – involves inserting two IV lines, while the prisoner is strapped to a gurney.
But lying down causes Bible shortness of breath, and his lawyers argue that he would “likely be choking and gasping for air” during attempts to hook up IVs that may be “futile” anyway.
Bible’s legal claim, which lays out a “galaxy of medical issues” in detail over the course of 90 pages, names Texas Department of Criminal Justice officials and “anonymous execution team members” among its numerous defendants.
This isn’t the first time a Texas death row prisoner has fought his sentence by questioning the lethal injection process. Thomas “Bart” Whitaker – a Fort Bend man eventually spared by Gov. Greg Abbott – was one of three inmates behind a years-long suit alleging the drugs Texas uses could cause undue suffering.
And earlier this year, hours before his February execution, John Battaglia unsuccessfully tried winning a stay by raising concerns about two allegedly botched executions his lawyers said were caused by too-old drugs.
Both of those cases focused on the possibility that the drugs themselves would cause suffering, a claim that could more generally apply to any death row prisoner. Bible’s argument focuses more narrowly on the possibility that he, specifically, is unfit to execute.
“To my knowledge this is the first suit of its kind in Texas,” said lethal injection expert and death penalty lawyer Maurie Levin, who worked on the Whitaker and Battaglia cases.
In Bible’s case, his lawyers suggest that an alternative method – firing squad or nitrogen gas – would decrease the risk of suffering.
Bible was initially sent to death row in 2003, more than two decades after the crime that landed him there.
A former drifter, Bible’s lengthy string of violence dates back to at least 1979. That May, a passerby found the bloodied, half-naked body of Inez Deaton along the slope of a Houston bayou. She’d been stabbed 11 times with an ice pick before her killer posed her corpse by the water.
For nearly two decades, Deaton’s slaying went unsolved – but Bible’s violent streak continued.
In the years that followed, Bible terrorized women in the Midwest, once setting his girlfriend’s car on fire because he didn’t like her haircut. After he returned to Texas and settled west of Fort Worth, he murdered his sister-in-law Tracy Powers and her infant son Justin. Then, he killed Powers’ roommate, Pam Hudgins, and left her body hanging from a roadside fence.
Following those killings, he fled to Montana, where he kidnapped a woman and raped an 11-year-old girl, according to court records.
Eventually, he was caught and in 1984 he pleaded guilty to Hudgins’ murder. He was sentenced to 25 years for the killing and 20 years for a Harris County robbery. He was released on parole eight years later, under a since-repealed mandatory supervision law.
While still on parole, he raped and molested multiple young relatives, including a 5-year-old. Then in 1998, he raped Tera Robinson in a Louisiana motel room before stuffing her into a duffel bag when he became enraged that he couldn’t maintain an erection. The woman broke free and called for help.
Bible was eventually caught in Florida, and freely admitted to his crimes under questioning.
Weeks after he was sentenced, Bible narrowly escaped death during a head-on-collision on the way to death row. The officer behind the wheel of the prison transport vehicle, 40-year-old John Bennett, died in the wreck, while Bible ended up in a wheelchair.
In past appeals, Bible’s attorneys have used his deteriorating medical condition to argue against his execution, saying he can’t be a danger in his current state.
Texas has already executed six men this year, including another Houston serial killer, Anthony Shore. Aside from Bible’s, there are seven other death dates on the calendar in Texas.

Gov. Jerry Brown pardons five "nonviolent" illegal aliens facing deportation

According to Brown’s office: Kidnapping, robbery, using a firearm, inflicting corporal injury, intent to terrorize and obstructing a police officer are now classified as “nonviolent crimes.”

From Sacramento Bee: Amid a brewing legal battle with the Trump administration over California’s liberal immigration policies, Gov. Jerry Brown on Friday granted pre-Easter pardons to five immigrants illegal aliens facing possible deportation.
They were among 56 pardons and 14 commutations that the Democratic governor handed down ahead of the Sunday holiday. The majority were convicted of drug-related or other nonviolent crimes, according to Brown’s office.
Executive clemency is particularly significant for immigrants, since they can be deported for old convictions, even if they have legal resident status. By forgiving their criminal records, Brown eliminates the grounds on which they could be targeted for removal from the country.
“These are individuals who have turned their lives around and deserve a second chance,” said UCLA School of Law Professor Ingrid Eagly, who represents two of the immigrants pardoned Friday. She added that the stakes are higher since the election of President Donald Trump, who has emphasized stricter immigration enforcement.
“Under the current administration, there’s much more of a focus on deportation. More individuals are being picked up and placed into deportation proceedings,” Early said. “There’s also less discretion being exercised by immigration agents on the ground and by immigration prosecutors.”
The pardoned immigrants are:

  • Sokha Chhan, who is in the custody of Immigration and Customs Enforcement pending deportation to Cambodia. He came to the United States at the age of 13 to escape the Khmer Rouge regime and has lived here for 35 years. Chhan was sentenced in 2002 for inflicting corporal injury on a spouse or cohabitant and threatening a crime with the intent to terrorize, both misdemeanors; he served three years probation and 364 days in jail. In his clemency application, one his five children, whom Chhan raised as a single father, wrote that he had shown her “what it meant to be a loving and independent individual.”
  • Daniel Maher, who has publicly advocated for immigrants with a criminal record to have an opportunity for redemption. Maher moved to California from Macau legally when he was 3 years old, according to KQED, but he never applied for citizenship and he lost his green card when he was sentenced in 1995 for kidnapping, robbery and using a firearm (as a prohibited possessor). He served five years in prison, before being released early for good behavior, and three years on parole. Maher now oversees the curbside recycling program in Berkeley and has been recognized by the city for training at-risk youth for green jobs. He was detained, but not deported, by ICE in 2015.
  • Phann Pheach, who was born in a refugee camp in Thailand and came to the United States at the age of 1, according to a GoFundMe account set up by his wife. Pheach was convicted in 2005 for possession of a controlled substance for sale and obstructing a police officer; he served six months in prison and 13 months on parole. Pheach has been detained by ICE and is facing deportation proceedings to Cambodia, “a place he never once knew,” his wife wrote on the fundraising page for his legal defense. “He is the glue that holds his family together,” she added. “I am crumbling apart without my husband, who I have been with for over 10 years.”
  • Francisco Acevedo Alaniz, who was convicted for vehicle theft in 1997 and served five months in prison and 13 months probation. In his clemency application, he reported being active in his church and volunteering with a youth sports program.
  • Sergio Mena, who was sentenced in 2003 for possession of a controlled substance for sale and served three years probation.

Immigration has been at the center of a political showdown between California and the Trump administration. Earlier this month, U.S. Attorney General Jeff Sessions filed suit against California for three new laws passed last year to protect immigrants living in California illegally.
Brown slammed Sessions for “initiating a reign of terror” against immigrants illegal aliens in California and accused the federal government of “basically going to war” against the state. Days later, Trump visited California for the first time as president and dismissed the state as “totally out of control.”
During the past year, as federal immigration authorities have escalated their enforcement efforts, Brown has regularly included immigrants in his annual Easter and Christmas acts of clemency.

From Fox News: An undocumented immigrant illegal alien, with a history of arrests and deportations, was sentenced to 35 years in prison Friday after his sexual assault conviction earlier this year.
KATU News reported that Mexican national Sergio Jose Martinez, 31, attacked two women in Portland, Ore., on the same day. The first was a 65-year-old whose car he stole, and a younger woman. He was arrested July 24, the report said.
Prior to the attacks, Martinez had been deported 20 times, had a series of probation violations for illegal crossings into the United States and had a felony burglary conviction, KGW.com reported, citing court documents filed in March.
Martinez faced charges of kidnapping, assault, robbery and sodomy, KATU News reported. He was released from Multnomah County Jail last December despite the objection of U.S. Immigration and Customs Enforcement (ICE) officials.
ICE had asked local authorities to alert the federal agency prior to Martinez’s release, the paper reported. However, the agency told KATU News in July that “local authorities released Mr. Martinez back into the community the following day without providing any notification to ICE.”
Multnomah County (Ore.) Sheriff Mike Reese and county officials penned a letter addressing the issue, saying “the Sheriff’s Office does not hold people in county jails on ICE detainers or conduct any immigration enforcement actions,” KGW.com reported.
Martinez’s sentencing came a day after the acquittal of San Francisco murder defendant Jose Inez Garcia Zarate, an undocumented immigrant, in the death of Kate Steinle.

An Ohio prosecutor said he may seek the death penalty against Ariel Castro, the Cleveland man charged today with the kidnap and rape of three women he allegedly brutalized for a decade while allegedly inducing abortions in at least one of the captives.

“Capital punishment must be reserved for those crimes that are truly the worst examples of human conduct,” Cuyahoga County Prosecutor Timothy McGinty said today, indicating that Castro will likely face additional charges of aggravated murder related to the pregnancies.

The death penalty is applicable under Ohio law for the “most depraved criminals who commit aggravated murder during the course of a kidnapping,” McGinty said.

Castro allegedly induced abortions in one of his victims, Michele Knight, 32, on at least five separate occasions by punching her in the stomach.

But another alleged captive, Amanda Berry, carried a child to term, delivering the now 6-year-old girl in a plastic kiddie pool, police said.

Castro today was charged with four charges of kidnap, one for each woman and the 6-year-old child whom Berry delivered while in captivity. He was charged with three counts of rape.

Bail was set at $2 million per case, for a total of $8 million.      Hmmmmmmm

Not happy about it , but I guess the dirtbag is entitled to bail. Right?

Nakoula Basseley Nakoula deserves a place in American history. He is the first person in this country jailed for violating Islamic anti-blasphemy laws.
You won’t find that anywhere in the charges against him, of course. As a practical matter, though, everyone knows that Nakoula wouldn’t be in jail if he hadn’t produced a video crudely lampooning the prophet Muhammad.
After the attack on US facilities in Benghazi that killed Ambassador Chris Stevens and three others, the Obama administration claimed the terrorist assault had been the outgrowth of a demonstration against the video. In a speech at the United Nations, the president declared — no doubt with Nakoula in mind — “The future must not belong to those who slander the prophet of Islam.”
After Benghazi, the administration was evidently filled with a fierce resolve — to bring Nakoula to justice.
Charles Woods, the father of a Navy SEAL killed in Benghazi, said Secretary of State Hillary Clinton told him when his son’s body returned to Andrews Air Force Base: “We will make sure that the person who made that film is arrested and prosecuted.”
Lo and behold, Nakoula was brought in for questioning by five Los Angeles County sheriff’s deputies at midnight,

eventually arrested and held without bond, and finally thrown into jail for a year.

Did I read That right? No Bail? But…But…But…
He sits in La Tuna Federal Correctional Institution in Texas, even as the deceptive spin that blamed his video for the Benghazi attack looks more egregious by the day.
