Lawsuit: San Francisco DA carried firearm on commercial flights, fired whistleblowers

This is so typical of the political elite: Do As I Say, Not As I Do.

George Gascon is the demorat district attorney for San Francisco. He was appointed by fellow gun grabber Gavin Newsom in January 2011 to succeed gun-grabber Kamala Harris and was elected DA of San Francisco in November 2011.

He is also a rabid gun grabber.

In 2013, Gascon wrote a piece for Politico entitled, “Time to ban large gun clips.”

An excerpt from his piece proves he has mastered the fear-mongering, gun-grabber terminology: “These “assault magazines” are devices that hold more than 10 bullets. They were designed and manufactured for military use to allow soldiers to kill the maximum number of enemy combatants without reloading.”

He supports San Francisco’s latest stab at the Second Amendment which includes banning the possession of firearms at gatherings like parades or protests, even when they are relatively small.

Now SF Gate reports that the Gascon flew commercial while carrying a firearm and fired whistleblowers who reported his unlawful actions to TSA. From their report:

A former senior investigator says he was fired for blowing the whistle on his boss, San Francisco District Attorney George Gascón, who he alleged carried a gun while flying — in violation of federal law.

Gascón reacted with a “pattern of retaliation and harassment” that culminated in the termination of senior investigator Henry G. McKenzie on Oct. 30, 2017, according to the suit filed in U.S. District Court in San Francisco.

In the Nov. 24 filing, McKenzie says that Gascón — who is also the city’s former police chief — took a gun on board commercial flights repeatedly after becoming D.A. in January 2012.

According to the suit, members of the San Francisco District Attorney’s Office Investigators Association, which included McKenzie, discussed the “need to blow the whistle” on Gascón’s potential criminal violations in early 2017.

Sometime that spring, an investigator in the district attorney’s office contacted the Transportation Security Administration to report Gascón’s alleged unlawful travel with a firearm.

“The issue is flying armed while not being a peace officer, and flying armed when there was no need to” for law enforcement purposes, McKenzie’s attorney, Fulvio Cajina, told us.

Under federal law, peace officers who are armed while traveling are required to state that they are doing so for good reason — a reason related to their work — under penalty of perjury. The investigators believed that, as district attorney, Gascón was no longer an active peace officer and had no need to travel with a gun.

In the months after the TSA was notified, five of the Investigators Association’s seven-member governing body were either terminated or reprimanded. In all, according to the suit, “nearly half of the district attorney’s investigative department — or about 14 staff members — “were either terminated or forced to resign under intense pressure within a five-month span,” the suit said.

At a Sept. 5, 2017, training day at the Lake Merced shooting range, Gascón allegedly told the entire investigations staff that “there was a ‘cancer’ growing in the Bureau of Investigations and he was going to cut it out,” according to the suit.

In what was described as a rant, Gascón told the group that if anyone was going to talk to The Chronicle’s Matier & Ross, “they better make sure they had their facts straight” and that he would “be around a lot longer than anyone else” at the bureau.

The next day, on Sept. 6, 2017, McKenzie says he was placed on administrative leave and that an internal affairs investigation was pending.

McKenzie alleges he was removed from his job because he “was either a whistle-blower or had aided a whistle-blower.”

He was fired the next month, and in late February, McKenzie’s termination was upheld by the D.A.’s office after an administrative review. McKenzie has since found a new job.

In the meantime, according to the lawsuit, “federal authorities have launched a criminal investigation into defendant Gascón.”

TSA spokeswoman Lorie Dankers declined comment, saying the agency “cannot provide any additional detail beyond what is in publicly available documents.”

Kate Brown, the most transparent governor of Oregon?

Gov. Kate Brown: Can she #betransparent?

Kate Brown, the first openly bi-sexual demorat governor of Oregon, is up for re-election this November. She claims she “has already done more to improve transparency in state government than any other governor in Oregon’s history.”

Let’s take a look at her record, shall we?

According to a report from Forbes earlier this year, their audit of Gov. Brown revealed nearly 4,000 redacted items from her official state calendar. The governor redacted calendar entries on nine out of every ten days since taking office. In addition to these transparency issues, we found potential violations of Oregon state law regarding Brown’s credit card spending.

“The governor is flouting Oregon open records laws and blurring the line between the taxpayer-funded agency resources and her campaign activities. Furthermore, Brown used public funds for private purposes – during her time as secretary of state and as governor.

Now we’ve discovered systemic redactions from Brown’s calendar. Through Brown’s first 1,156 days as governor (February 2015 through April 2018), 994 days on her official calendar included redacted information. There are up to 14 line-item redactions per day.

Oregon State Law (ORS 192.355 Section 2a) allows redactions for information of a “personal nature” (i.e. doctor’s appointments). But in Brown’s calendar, there were nearly 4,000 items redacted, including names of people Brown met with, travel locations, campaign events, and even entire calendar days.

Brown’s calendar was packed with 500 events tagged as “campaign,” with further details redacted. When we asked the governor for comment, spokesperson Chris Pair cited a circuit court case – not a completely settled law – arguing the public has no right to know.”

Guess what else Gov. Brown has done to improve transparency in state government? According to Oregon Live, she and the state agencies she oversees have kept proposed bills confidential while legislative lawyers draft legislation.

This is significant because how the state plans to pay for her policies in 2019, if re-elected, is not being made available to the voting citizens of her state before the November election. Fortunately, a judge in Marion County ordered that she release approximately 250 draft proposed bills by Friday.

“Sarah Weston, a lawyer for the Oregon Department of Administrative Services, said the state plans to ask the Oregon Court of Appeals to halt the records release and reverse the Marion County court’s decision.

“The request forms are fundamentally a communication between the client and the client’s lawyer,” Weston said. She cited a statute that says legislative lawyers may draft bills requested by agencies, if the governor signs off on them.

In previous years, Portland business attorney Greg Chaimov – himself a former legislative lawyer – had asked for the agencies’ bill request forms and obtained them relatively quickly, according to his lawyer John DiLorenzo. The firm where Chaimov and DiLorenzo work, Davis Wright Tremaine, shares the information with its clients and friends free of charge, DiLorenzo said. Those entities often want to see what state officials are proposing so they can lobby against bills they dislike. In response to a reporter’s question, DiLorenzo confirmed that one of Chaimov’s clients is the business-allied political nonprofit Priority Oregon, which has been running attacks ads against Brown.  

This year, the governor’s office told Chaimov he would have to deal with the Department of Administrative Services, and that agency said it would not release the records because they were protected by attorney-client privilege.

The administrative department had also informed other state agencies in May that legislative concepts would “be temporally exempt from disclosure [under the Public Records Law] until Legislative Counsel has submitted bill drafts to the Governor’s Office for final approval (this should be done by November 30, 2018),” DiLorenzo wrote in a court filing. He noted that would be well after the election.

“Although it is expected that agencies will have discussed legislative concept ideas with stakeholders, agencies are directed to treat this document as confidential and privileged and, accordingly, not to share the text of this form outside of state government before legislation is drafted and finalized,” the department wrote, according to a court record.”

From Fox News: New York Mets star pitcher Noah Syndergaard tossed a curveball to Twitter fans late Monday, suggesting the number of deadly hurricanes that have ravaged the United States in recent weeks is “karma” for the Trump administration’s decision to withdraw from the Paris Climate Accord.
Syndergaard, 25, a starting pitcher for the Mets who has been on the disabled list since May, linked the spate of recent hurricanes – Harvey, Irma, Jose and Maria – to President Trump’s June pullout from the Paris deal. On Saturday, a European Union official said the U.S. may be open to reviewing the terms of the accord, but National Security Adviser H.R. McMaster quickly shot down the “false report.”
“U.S. pulls out of Paris Climate Accord. Then hit by 4 hurricanes in 6 weeks. Global Warming Karma?” Syndergaard wrote, adding the hashtags: “I’m a Texan Republican” and “wake up.”
Syndergaard, nicknamed ‘Thor’ for his likeness to the fictional character due to flowing, blonde locks and a chiseled frame, tweeted later: “…..and I know Karma.”
To that post, he added the hashtag “take the MRI.” That tweet was an apparent dig at himself for refusing an MRI before he was scheduled to pitch on May 1. Syndergaard ended up injuring himself during the game, after which he was placed on the disabled list. He has yet to pitch in another major league game this season.
Social media users quickly responded to the pitcher’s climate change claim.
“Stick to baseball because weather obviously isn’t your strong point,” Rdsknsfan3 wrote.
“You just lost a lifetime Mets fan. Stick to pitching, if you can stay healthy for even one freaking season. Stupidity Karma?” MaximilianoNJ wrote.
Added LHVPundit: “Stick to what you know (baseball) and leave the science to scientists. Mets fans don’t care about where you stand on political issues.

From Fox News:  Chelsea Handler is facing heat for an essay she penned this week calling for women to come together and support each other.
However, in the same essay published by Thrive Global, Handler singles out white female voters who supported Donald Trump — a move that many are calling hypocritical.
Handler said there is a problem with “women supporting women” in the United States. “One of the saddest things about November 8,” she added, “were the women of America who somehow managed to vote for Donald Trump, specifically the 53 percent of all white female voters who chose Mr. Trump.”
Handler noted that America “is a free country, and we are free to differ on public policy” but “what kind of a woman votes for a white, entitled rich guy who has spent his entire life working the system for excess personal profit while insatiably groping strange women for personal pleasure.

The (Catholic) Woman Newt Committed Adultery With

In the mid-1990s, while he was Speaker of the House and married to wife no. 2, Marianne Ginther, Newt Gingrich had an affair with a 23-years-younger House of Representatives staffer named Callista Bisek. In 2000, Newt married Callista shortly after divorcing Marianne.

But don’t be too sorry for Marianne. She herself was the other woman involved in an adulterous affair with the Newt when he was still married to wife no. 1, Jackie Battley! It was Battley who claimed that she was in her hospital bed recovering from surgery when Newt said he wanted a divorce. [Source: wiki]

Callista is also a reason for Newt’s senior staff quitting en masse yesterday. They told the UK’s Daily Mail that they quit because:

  • Newt did not take his presidential campaign seriously;
  • He was lazy and refused to do the hard work of grassroot campaigning, preferring instead to rely on social media; and
  • After his disastrous sniping at fellow Republican Paul Ryan’s budget plan, instead of working to put out the flames he himself had started, Newt and wife Callista took a two-week vacation, in defiance of his staff.

Hey, “lifelong Catholic” Callista and “newly converted to Catholicism” Newt: Ever heard of the 7th Commandment?

The image was released by the National Oceanic And Atmospheric Association (NOAA) on the day half of North America is in the grip of a severe winter storm. The map was created using multiple satellites from government agencies and the US Air Force.
The shroud of white stretches down from Alaska and sweeps through the Midwest and along to the Eastern seaboard. The bitter cold has reached as far as Texas and northern Mexico where in Ciudad Juarez temperatures today were expected to dip to minus 15C. Tens of millions of people chose to stay at home rather than venture out. In Chicago, 20in of snow fell leading to authorities closing schools for the first time in 12 years. But never fear, boys and girls. Al Gore is here!
He insists on his blog that “increased heavy snowfalls are completely consistent with what they have been predicting as a consequence of manbearpig man-made global warming.”
This is the same Gore who once proclaimed in a CNN “Late Edition” interview with Wolf Blitzer that “During my service in the United States Congress, I took the initiative in creating the Internet.” The same Gore whose new energy-wasting mansion (his 4th) in Montecito, Calif., has 6,500 square feet of living space and a swimming pool and fountains. His energy-wasting Nashville home is 10,000 square feet. The same Gore who had a net worth of a mere $1-2 million in 2000, but quickly fattened to an estimated $120 million by 2008 from his many global warming scams, such as an Academy Award and a Nobel Peace Prize no less.
Hmm, let me see if I got it right:

  • If there’s increased heavy snowfalls, it’s man-made manbearpig global warming!
  • If it’s an unexpectedly warm and dry winter, it’s man-made manbearpig global warming!
  • If summer is beastly hot, it’s man-made manbearpig global warming!
  • If summer is unseasonably cool, it’s man-made manbearpig global warming!

In other words, the same cause can lead to entirely opposite results! Which means the “science” of man-made manbearpig global warming can and will never be proven wrong. Pure genius.

Frankly Sir, You Are an Embarrassment

Al Gore — He did it again.
Recently, Nobel Peace Prize winner Al Gore toured again. Or maybe he does that all the time. This time, he turned up in Gothenburg (Sweden) for the usual alarmist talk. In advance, all distinguished guests were politely advised to – if possible – use any form of public transportation to go to the event, in order to minimize CO2 emissions.
Intriguingly, the Master of World Climate himself arrived in a rental car (with or without driver is unclear), from the airport, and subsequently left the engine running for the entire lecture. That is to say, about one hour. Incidentally, local legislation prohibits – for very good environmental reasons, i. e. pollution – any car engine running on empty for more than 60 seconds. Fines are severe. As far as I know, he was not fined.
It starts to form a pattern.
After the ceremony in the Norwegian capital Oslo, it is customary that the laureate is invited to the Swedish capital Stockholm, for a cordial visit. The train ride, supposedly the environmental choice according to Mr. Gore, is approximately four hours. However, he opted for the cosier ride with one of the Swedish government aircrafts. As these can, according to the rules, only be used when a cabinet member is on board – and as the Swedish government after a short ceremonial visit – offered to fly him to Frankfurt (Germany) for his flight to the US, you can calculate both the manpower and the fuel used for this grand tour against man’s destruction of the planet.
Stupidity and hypocricy – as well as vanity – are, like it or not common human traits. I admit to some of them occasionally, but I don’t demand taxpayers to finance my stupid talks at dinner (yes, I love doing that). Here’s the deal Mr Gore: get out of my way, and I will keep out of yours.

Shut Up, Jimmy Carter

This essay by Joe Queenan on Jimmy Carter’s literary diarrhea is so on-target and plain hilarious.
Jimmy Carter tries hard to paint himself as some virtuous dude, but the reality is that he is hypocritical and cruel. When he was President, Carter treated with contempt the Secret Service agents who would take a bullet for him. He told them not to look at him or speak to him even to say hello when he went to the Oval Office.
Carter once tried to kill a small stray dog with a bow saw because the terrier ate some food his wife had put out for their cat in their home in Plains, GA. The dog managed to dodge Carter’s attack, but Carter then insisted that Secret Service agents take the dog away. The agents instead gave the orphan dog to the press corps. This is what a bow saw looks like:

Jimmy Carter is also America’s worst president, although I do believe that Barack Caliph Obama will soon take over that title.

In November 1980, the American people made a disastrous decision whose reverberations are still being felt today. Rather than biting the bullet and re-electing the glum, uncharismatic, hopeless Jimmy Carter to the White House—thereby ensuring that he would return to Plains, Ga., at the conclusion of his second term and keep his blabberpuss shut—they turfed him out into the street.
That made him mad. Really mad. By giving one of America’s dopiest presidents the bum’s rush, the American people ensured that Mr. Carter would spend the rest of his life trying to even the score, trying to persuade them that they had made a huge mistake when they cast their lot with Ronald Reagan, trying to convince them that they were a bunch of jerks.
The particular form of retribution Carter chose was as sinister and cruel as any known to man. He took his pen in hand and began to write books. Long books. Boring books. Dour books. Yes, long, boring, dour, numerous books. Books with sanctimonious names like “Keeping Faith” and “Living Faith” and “Leading a Worthy Life.” Books with pompous names like “Turning Point,” “Our Endangered Values” and “Always a Reckoning.” Books with hokey names like “Christmas in Plains” and “Everything to Gain: Making the Most of the Rest of Your Life.” And yes, even books with names like “The Little Baby Snoogle-Fleejer” that defy classification.
He has not set his pen down since.
With the recent release of the exquisitely pointless “White House Diary,” his 25th entry in the literary sweepstakes, Mr. Carter has now written more books than James Joyce, Jane Austen, Gustave Flaubert, George Eliot, Virgil, Homer and Jonathan Franzen. He has also written more books than Franklin Delano Roosevelt, Lyndon Baines Johnson, Dwight Eisenhower, Woodrow Wilson, Abraham Lincoln, Thomas Jefferson, George Washington and a whole lot of other presidents who got more points on the scoreboard than he ever did. Most ex-presidents have the good grace to stop at a single publication after they leave office, though more than a few have obligingly opted for the public’s favorite number in this lethal genre: zero.
Not Jimmy.
The Oval Office equivalent of the Edsel, Mr. Carter has spent three decades in the wilderness retrofitting his image as the best, the brightest, and the noblest ex-president of them all. This is like trying to get credit for touchdowns 30 years after the clock has run out, with the score reading Eureka College 50, Navy 0.
Being history’s most admired ex-president is like being the most beloved former skipper of a torpedoed aircraft carrier. If the ship sank while you were at the helm, it doesn’t really matter what a great job you did manning the inflatable lifeboat afterward. Mr. Carter inhabits some weird parallel universe with people like George Foreman, who were despised when they were at their peak and then manufactured a touchy-feely post-career aura that made some people forget how much they disliked them when they were famous. But George Foreman, unlike Jimmy Carter, is funny. And George Foreman could throw a punch.
Carter’s extraneous exhumation of the musty old diary he kept during his four long, horrid years in office suggests that he is scraping the bottom of the barrel for material. Publishing a diary describing the four years in office that were so awful they got you booted out into the street is like George Pickett publishing “Gettysburg Diary” or Mike Brown publishing “Quiet Days in Katrina: A FEMA Diary.” And if Carter’s gone back to the dismal years 1977-80 to exhume diary material, what comes next? “Tuesdays with Bert Lance”?
This is a classic case of being careful what you wish for. The American people wanted Jimmy Carter out of office in the worst way, and to this day they are paying the price. If we had to do it all over again, I think a lot of people would vote to amend the Constitution and allow presidents to run for five, six—as many terms as they wanted. That wouldn’t leave them much spare time to write books.
