Judge blocks California's high-capacity magazine ban

From ABC News: A federal judge on Thursday blocked a California law set to take effect Saturday that would have barred gun owners from possessing high-capacity ammunition magazines.
The judge ruled that the ban approved by the Legislature and voters last year takes away gun owners’ Second Amendment rights and amounts to the government taking people’s private property without compensation.
California law has prohibited buying or selling the magazines since 2000, but until now allowed those who had them to keep them.
“Hundreds of thousands, if not millions, of otherwise law-abiding citizens will have an untenable choice: become an outlaw or dispossess one’s self of lawfully acquired property,” San Diego-based U.S. District Judge Roger Benitez wrote. (Judge Benitez was appointed by George W. Bush.)
He issued a preliminary injunction blocking the law from taking effect while he considers the underlying lawsuit filed by the National Rifle Association-affiliated California Rifle & Pistol Association.
Meanwhile, a Sacramento-based judge on Thursday rejected a similar challenge by several other gun owners’ rights organizations, creating what Ari Freilich, staff attorney at the Law Center to Prevent Gun Violence, called “dueling opinions” that may be sorted out on appeal. “Unfortunately this law will be delayed but we are confident it will go into effect, and soon,” he said.
He called the San Diego lawsuit and ruling part of an effort by the NRA “to delay and dismantle California’s law brick by brick.”
Had the ban taken effect, owners would have been required to get rid of their magazines by sending them out of state, altering them to hold no more than 10 bullets, destroying them or turning them into law enforcement agencies. Possession could have been punished by $100 fines or up to a year in jail.
Owners can now keep the magazines until a final ruling by Benitez or if an appeals court overturns his injunction, said Chuck Michel, attorney for the NRA and the California Rifle & Pistol Association.
“This court recognized that the Second Amendment is not a second-class right and that law-abiding gun owners have the right to own these magazines to defend themselves and their families,” Michel said.
State lawmakers approved the ban last year as part of a package of bills adding to what already were some of the nation’s strictest gun laws. Voters agreed in November when they approved Proposition 63, a measure that toughened the penalties by allowing violators to be fined or jailed.
Benitez said he was mindful of voters’ approval and government’s legitimate interest in protecting the public but added that the “Constitution is a shield from the tyranny of the majority.”
Gun owner’s constitutional rights “are not eliminated simply because they possess ‘unpopular’ magazines holding more than 10 rounds,” he wrote in a 66-page decision.
California Attorney General Xavier Becerra criticized the decision but did not say what he will do next. “Proposition 63 was overwhelmingly approved by voters to increase public safety and enhance security in a sensible and constitutional way,” Becerra said in a statement. “I will defend the will of California voters because we cannot continue to lose innocent lives due to gun violence.”
Supporters say that magazines often holding 30 or 100 bullets are typically used in mass shootings and aren’t needed by hunters or civilian owners. “Clearly it escalates the lethality in any mass shooting when high-capacity magazines are involved,” said Amanda Wilcox, a spokeswoman for the California chapters of the Brady Campaign to Prevent Gun Violence whose daughter was fatally shot.
Forcing assailants to change magazines more frequently gives victims time to flee or subdue the shooter, Becerra argued in court filings.
He listed as examples the shooting in Orlando, Florida, that killed 49 people and injured 53; the terrorist assault that killed 14 and injured 22 in San Bernardino; the massacre of children and teachers at Sandy Hook Elementary School in Newtown, Connecticut; and the Arizona attack that killed six and wounded 13 including former U.S. Rep. Gabrielle Giffords.
Moreover, the government wouldn’t own the magazines in the way it would property seized for a new highway or public building, he argued, since the magazines would be destroyed by law enforcement agencies.
Becerra said opponents’ Second Amendment challenge has repeatedly been rejected by other courts, allowing at least seven other states and 11 local governments to already restrict the possession or sale of large-capacity ammunition magazines.

Mark Kelly’s campaign against “assault weapons” such as the AR-15 rifle has sparked a local backlash. On March 13, a Tucson, Arizona radio host published a photograph of former Congresswoman Gabby Giffords holding an AR-15 rifle at a gun range.
Giffords has since confirmed that the photograph is authentic.
James T. Harris, blogging at the website of “101.4 FM The Truth,” wrote:
What is wrong with this picture? Absolutely nothing, and prior to the aggressive progressive opportunistic fear mongering in the wake of Sandy Hook, this picture would have raised no eyebrows and garnered little public attention.
However, in response to the exploitative political scheming of Mark Kelly, persons connected to Congresswoman Giffords released this photo in response to what they perceived to be her husband’s hypocrisy.
Subsequently, Breitbart News confirmed the authenticity of the image through law enforcement sources in Arizona, and obtained a copy of the photograph from a source who requested anonymity.
The latter source was present when the photograph was taken, and said that Giffords had requested it for campaign purposes during October 2010.
According to the source, the image sent to Breitbart News was cropped to protect the identity of the person on the right-hand side of the original photograph (to Giffords’s left).
The source, who is a member of the law enforcement community, told Breitbart News:
“We were told she wanted to toughen her image. She asked to come out and she wanted to shoot a rifle. She had one of our guys out there to show her how to shoot an AR-15.”
In January 2011, Giffords suffered near-fatal wounds in a mass shooting while meeting with constituents in Tucson. The perpetrator used a 9mm Glock 19 semi-automatic pistol.
Giffords and husband Mark Kelly have since formed an organization, Americans for Responsible Solutions, to press for policy changes such as limiting the sale of “assault weapons, ” including the AR-15.
Breitbart News reported last week that Kelly attempted to purchase an AR-15 from a gun store in Tucson earlier this month.
Likewise, the AR-15 that Giffords is shown holding in the image is a standard, semi-automatic civilian weapon, according to the source who saw it being taken.
The source saw a campaign official take the photograph, which was later provided to law enforcement personnel as a courtesy, according to the source.
The source says the existence of the photograph has been known in the local law enforcement community for a while: “I’m not the only one who knows about this photo.”
Multiple law enforcement sources in Arizona told Breitbart News that Mark Kelly’s campaign against “assault weapons” has generated resentment within the law enforcement community–and a desire that the photograph be made public.  The source who witnessed the photograph put it this way:  “Giffords and Kelly came across with a different demeanor in 2010. To me, it seems like they’ve done a complete 180 because of what happened. And with the latest controversy–with Mark Kelly doing what he did with the AR-15 stunt–this photo needs to be put out.”
While Kelly declined to comment, Americans for Responsible Solutions spokesperson Jen Bluestein told Breitbart News: “Looks like the photo is cropped.”  Bluestein noted that there are “many images of Gabrielle Giffords with guns,” though she said she had not seen the image of the AR-15 before.
At 1:14 p.m. PDT, Giffords posted two images on her Facebook page with the following statement:
“Here are two photos of me that a conservative blog has dug up. I remember both of these days fondly. The first is at the Tucson Police Department firing range. They invited me to test rifles and tasers that they bought with federal funds, which I helped secure. The second was in Afghanistan while I was visiting with our troops serving abroad. My work as Southern Arizona’s Congresswoman frequently put me in close contact with some of the world’s most powerful and deadly weapons – supporting police departments, advocating for the Border Patrol, standing up for our troops in Iraq and Afghanistan, and supporting my constituents’ and my own Second Amendment rights.
I grew up with guns, and I like owning them. So does my husband Mark. It’s an interest we’ve shared ever since we met. It’s part of my heritage as an Arizonan and it’s my right as an American. Being able to shoot a gun is something I haven’t been able to do since I was shot – because my right arm is paralyzed, and I’m less mobile than I was.
“As I member of the House Armed Services Committee, I proudly spent a lot of time with our military, border patrol and state and local law enforcement. I guess the intention of those who have publicized these photos is to somehow call into question my belief that military style assault weapons should be more strongly regulated with background checks and other safeguards. I have never wavered in my support for those who serve our country. I fought to make sure they have the weapons and safety gear needed to carry out their mission, and proper health and mental care when their service ends.”
I don’t have to choose between owning, using, and enjoying guns, on one hand, and preventing gun violence, on the other. Both sides need to come together to support commonsense solutions to gun violence, like keeping guns out of the hands of dangerous people like the young man who shot me. That’s why I’m fighting this fight. That’s why I’m working to bring people together to support gun rights and reduce gun violence. I hope you join me.

Itching For a Class War in America

When news came last January 8 of a shooter in Tucson, Arizona, killing six people and wounding Democratic Congresswoman Gabrielle Giffords, the media and the Left were quick to demonize conservatives and Republicans before we even knew anything about the killer. They quickly blamed “right wing hate rhetoric” for 22-year-old Jared Loughner’s killings, although it turns out that Loughner is a psycho whose motives for the massacre, while unclear, were not political.
A week later, before an audience of 14,000 at a memorial honoring the victims, Obama called for more civil political discourse in America:

“at a time when our discourse has become so sharply polarized…it’s important for us to pause for a moment and make sure that we’re talking with each other in a way that heals, not a way that wounds…. And I believe that for all our imperfections, we are full of decency and goodness, and that the forces that divide us are not as strong as those that unite us.”

Obama’s words evaporated like dewdrops in the morning sun, instantly forgotten by the Left, if they even had paid attention in the first place. Self-satisfied narcissists that they are, they think his words applied only to those dastardly Tea Party conservatives.
And so, not only are the Left not talking to us “in a way that heals, not a way that wounds,” they’re ratcheting up the hate rhetoric to heights never seen before. The Left deliberately are provoking a race and class war in America.

Exhibit No. 1

On his show “Real Time” on April 9, 2011, self-styled “comedian” Bill Maher — he of the permanent self-satisfied smirk — called for a class war in America. This is what he said:

“As long as we have three wars going, America needs to add one more: a class war.”


Exhibit No. 2

On August 21, 2011, Democratic Congresswoman and former House Speaker Nancy Pelosi foments class warfare by claiming that “the rich” won’t pay taxes because “they want to be immortal,” and that the GOP “hates kids” and deliberately keeps wages low to force people to pay bank fees.

What the former House Speaker did not tell her audience is that she is one of the richest women in America. In 2007, Nancy Pelosi was the sixth wealthiest member of the U.S. House of Representatives, with an estimated average net worth of $62.5 million.

Exhibit No. 3

On August 26, 2011, as described by Buck Sexton of The Blaze, at a protest sing-along against Wisconsin Governor Scott Walker at the state capitol, a member of the Red & Anarchist Action Network (RAAN) held up a huge banner saying “Class War” and made this threat: “All you f**king Tea Party Baggers, It’s coming, get ready.”

RAAN is a group with “a history of street protests and union pickets which turn violent.” The anarchist group even boasts on its website of having undertaken a number of confrontations with authorities and violence against political parties and banks. See the list here.

U.S. Rep. Gabrielle Giffords was discharged from a hospital in Houston Wednesday, about five months since she was shot in the head at a constituent meeting in Tuscon, Ariz. She will begin her next step of recovery as an outpatient.

Top 10 Examples Of Liberal Hate

Even before details were clear about the Arizona shooting, Left-wingers tried to assess blame for the tragedy to Sarah Palin, the Tea Party, Rush Limbaugh, Glenn Beck and the Second Amendment. When it became clear that the gunman was a deranged lunatic whose political philosophy was more in tune with the loony Left than the Tea Party, liberals continued to cry out against a so-called climate of hate perpetuated by Right-wingers. Perhaps those making that charge have forgotten the hatefulness and violent words coming from their own. Here are the Top 10 Examples of Liberal Hate.
(1) Palin Derangement Syndrome: The Left’s obsessive hatred of Sarah Palin is well-chronicled and is often accompanied by violent rhetoric. Let these three examples suffice: (1) Keith Halloran, a New Hampshire Democratic candidate, said on a Facebook thread that he wished Palin had been aboard the Alaska plane that crashed, killing five including Sen. Ted Stevens; (2) Another New Hampshire Democrat, Timothy Horrigan resigned from the state   legislature after writing this gem on Facebook: “Well a dead Palin wd be even more dangerous than a live one . . .  she is all about her myth & if she was dead she cldn’t commit any more gaffes”; and (3) foul-mouthed comedian Sandra Bernhard warned Palin she would be “gang-raped by my big black brothers” if she tried coming to New York.
(2) Obama packing heat: Barack Obama has repeatedly sprinkled his political campaigning with words more appropriate to a street thug than the President of the United States. During his 2008 campaign he said in June, “If they bring a knife to the fight, we bring a gun,” and in September, “I want you to go out and talk to your neighbors. . . . I want you to argue with them, get in their faces.” He kept it up during the recent midterm election with this comment: “If Latinos sit out the election instead of saying, ‘We’re gonna punish our enemies and we’re gonna reward our friends . . . .”
(3) Courtland Milloy’s spit wish: Washington Post columnist Courtland Milloy said that after the health care vote he wanted to spit on and assault Tea Party members: “I know how the ‘tea party’ people feel, the anger, venom and bile that many of them showed during the recent House vote on health care reform. I know because I want to spit on them, take one of their ‘Obama Plan White Slavery’ signs and knock every racist and homophobic tooth out of their Cro-Magnon heads.”
(4) Krugman’s flip flop: New York Times columnist Paul Krugman was first out of the box connecting the Arizona shooting to Right-wing speech that created a climate of hate, intoning, “the purveyors of hate have been treated with respect, even deference, by the GOP establishment.” He must have for gotten his own words in December 2009 during the health care debate when he wrote, “A message to progressives: By all means, hang Senator Joe Lieberman in effigy.”
(5) Bush Derangement Syndrome: Before it fades into history, the liberal hatred of President Bush should be recalled. Codepink, Michael Moore, rap stars and Hollywood comedians hurled vitriol against the President. A movie was made about his assassination. But as an example of violent rhetoric, special attention should be given to remarks made by New York State Comptroller Alan Hevesi, who later apologized for describing fellow Democrat Sen. Charles Schumer as “the man who, how do I phrase this diplomatically, who will put a bullet between the President’s eyes if he could get away with it.”
(6) Daily Kos’ hypocrisy: Markos Moulitsas, of the liberal Daily Kos, was also quick to indict the Right for the Arizona tragedy, tweeting that Sarah Palin had “accomplished her mission,” a reference to her midterm elections bulls-eye target of politicians that included Rep. Gabrielle Giffords. However, his Daily Kos website blog also included Gifford’s district on a list of congressional districts “bulls-eyed” for primary challenges. And just last week, the website included a post declaring that Giffords was “dead to him” after she voted against Nancy Pelosi as speaker of the House.
(7) Exterminate Republicans: This is what passes for a theater review in the Village Voice: Michale Feingold, while reviewing the play “King Cowboy Rufus Rules the Universe,” wrote: “Republicans don’t believe in the imagination, partly because so few of them have one, but mostly because it gets in the way of their chosen work, which is to destroy the human race and the planet. Human beings, who have imaginations, can see a recipe for disaster in the making; Republicans, whose goal in life is to profit from disaster and who don’t give a hoot about human beings, either can’t or won’t. Which is why I personally think they should be exterminated before they cause any more harm.”
(8) Hang Drudge: Liberal talk radio host Mike Malloy suggested stringing up Internet king Matt Drudge, saying, “Drudge? Aw, Drudge, somebody ought to wrap a strong Republican entrail around his neck and hoist him up about 6 feet in the air and watch him bounce.”
(9) Outright assaults: Sometimes the hatred on the Left exceeds talk and escalates to violent assaults. Cases in point: In August 2009, members of the Service Employees International Union beat up Kenneth Gladney for distributing “Don’t Tread On Me” flags at a Missouri town hall meeting. In June 2010, Nathan Tabor was punched in the face by a Democrat during a Tea Party protest in North Carolina. Last October, Human Events reporter Emily Miller was physically assaulted while interviewing Rep. Charlie Rangel during the “One Nation Working Together” rally at the National Mall in Washington.
(10) Greenpeace “knows where you live”: Greenpeace advocated mass civil disobedience last April with this blog item on its website: “The proper channels have failed. It’s time for mass civil disobedience to cut off the financial oxygen from denial and skepticism. . . . If you’re one of those who have spent their lives undermining progressive climate legislation, bankrolling junk science, fueling spurious debates around false solutions, and cattle-prodding democratically elected governments into submission, then hear this: We know who you are. We know where you live. We know where you work.”

Dem Congresswoman Shot by Gunman

On the web, the rumor mill has the killer Jared Lee Loughner variously as an anarchist, a communist, a registered Tea Party member, a registered Democrat, an Obama supporter…. But 22-year-olds are too young to have developed a coherent political belief system. I don’t believe him to be an ideologue. Nor are the shootings ideologically-politically motivated, no matter the rationalizations we may hear from him in the days to come.
Loughner is a Columbine-type psychopath, and what he perpetrated today are acts of malice — pure evil. Of course, the media and the Left will do their utmost to portray him as a “right wing gun-nut” and make this tragedy a cause for gun control.

NY Post says Giffords “might have been shot at point blank range, some reports indicated. There are conflicting reports as to whether she survived.” Her father Spencer Giffords, when asked if his 40-year-old daughter had any enemies, said ‘Yeah. Congresswoman, 6 Others, Killed By Gunman

Rep. Gabrielle Giffords (D-AZ) and six others died after a gunman opened fire at a public event on Saturday, the Pima County, Ariz., sheriff’s office confirms.
The 40-year-old Democrat, who was re-elected to her third term in November, was hosting a “Congress on Your Corner” event at a Safeway in northwest Tucson when a gunman ran up and started shooting, according to Peter Michaels, news director of Arizona Public Media.
At least three other people, including members of her staff, were injured. Giffords was transported to University Medical Center in Tucson. Her condition was not immediately known.
Giffords was talking to a couple when the suspect ran up and fired indiscriminately from about four feet away, Michaels said.

The suspect ran off and was tackled by a bystander. He was taken into custody. Witnesses described him as in his late teens or early 20s.
Giffords was first elected to represent Arizona’s 8th District in 2006. The “Congress on Your Corner” events allow constituents to present their concerns directly to her.
