Senator Tillis of NC introduces the Justice for Victims of Sanctuary Cities Act

WASHINGTON, D.C. – Today, Senator Thom Tillis (R-NC) introduced the Justice for Victims of Sanctuary Cities Act, legislation that holds sanctuary jurisdictions accountable for failing to comply with lawful detainer and release notification requests made by federal authorities and jeopardizing public safety. Joining Tillis as original co-sponsors are Senators Lindsey Graham (R-SC), Chuck Grassley (R-IA), Joni Ernst (R-IA), Marsha Blackburn (R-TN), and Ted Cruz (R-TX).

The legislation creates a private right of civil action for the victims of sanctuary jurisdictions, allowing them to bring an action for compensatory damages against the sanctuary jurisdiction as a result of a violent crime committed by an illegal immigrant. Any sanctuary city or jurisdiction that refuses to waive its immunity as it relates to sanctuary-related civil action would be subject to the withholding of certain Community Development Block Grant (CDBG) funding.

The Justice for Victims of Sanctuary Cities Act is a direct response to a growing number of sanctuary jurisdictions across the nation (including North Carolina’s Buncombe, Cumberland, Durham, Forsyth, Guilford, Mecklenburg, and Wake Counties) that either have official sanctuary policies or are refusing to comply with detainer requests and release notifications from the Department of Homeland Security.

Earlier this month, the Mecklenburg County (NC) Sheriff’s Office refused to notify ICE and comply with a lawful detainer request when it released a dangerous illegal immigrant from county jail who was charged with multiple domestic violence charges for strangling a woman and threatening to kill her. This was only one of more than 20 troubling instances this year of the Mecklenburg County Sheriff’s Office releasing potentially dangerous individuals after refusing to comply with detainer requests. The reckless sanctuary policy prompted criticism from the U.S. Attorney for the Western District of North Carolina.

“It’s disturbing to see sheriffs across North Carolina establish sanctuary jurisdictions, releasing dangerous individuals back into communities while refusing to notify federal immigration officials,” said Senator Thom Tillis. “If politicians want to prioritize reckless sanctuary policies over public safety, they should also be willing to provide just compensation for the victims. The Justice for Victims of Sanctuary Cities Act is commonsense legislation that will enhance public safety and hold sanctuary jurisdictions accountable for their refusal to cooperate with federal law enforcement.”

“A good piece of legislation that is long overdue,” said Senator Lindsey Graham. “There must be consequences for governments and entities that gamble with public safety, refuse to work with federal officials, and refuse to deal with felons here illegally. This legislation empowers individuals who are the victims of these entities and governments’ poor decisions.”

“If state and local public officials jeopardize the safety and security of the American people by refusing to comply with federal immigration law, they should be held to account by our citizens when such reckless endangerment leads to more violent crime,” said Senator Chuck Grassley. “We are a nation of laws. Whether you are a citizen, immigrant or even a local government, disregarding those laws should carry consequences.”

“Sanctuary jurisdictions are failing to cooperate with law enforcement authorities, jeopardizing the safety of our communities,” said Senator Joni Ernst. “This is a serious problem that needs to be addressed. Our commonsense bill will put a check on these sanctuary jurisdictions, provide a pathway for victims of crimes committed by illegal immigrants to seek justice, and enhance and promote public safety.”

Our nation’s laws exist for a reason. When a sanctuary city or state recklessly decides to harbor illegal immigrants who may commit crimes against innocent Americans, the families of those victims deserve the right to seek compensation from those jurisdictions,” said Senator Marsha Blackburn. “It’s time we put the public safety of our citizens above the sanctuary of an immigrant who has come to our country illegally.”

“The American people, and Texas communities in particular, are tired of seeing our federal immigration laws flouted and criminal illegal immigrants enabled to commit future crimes and escape prosecution,” said Senator Ted Cruz. “Sanctuary cities and their policies are a dangerous affront to the rule of law, and only exasperate the crisis at our border. I am proud to join my colleagues in holding these jurisdictions accountable, and will continue working to enforce our federal immigration laws and ensure the safety and security of the American people.”

Unhinged Left: Man arrested for death threats against GOP senators who supported Justice Kavanaugh

From NY Post: A Long Island man was busted for making death threats against GOP U.S. Senators Chuck Grassley and Susan Collins for their support of then-Supreme Court nominee Brett Kavanaugh, The Post has learned.

Ronald DeRisi, 74, was taken into custody early Friday, and is expected to be arraigned later in the day in Central Islip federal court before Magistrate judge Gary R. Brown.

The Smithtown man is accused of leaving disturbing voicemails on the senators’ office phones following their public support of Kavanaugh’s nomination and confirmation, in an attempt to discourage the pols from voting in the jurist’s favor, a source familiar with the case revealed.

In one message left on September 27, DeRisi allegedly said that he had a “present” for Iowa’s Grassley, growling, “It’s a 9 millimeter. Side of your f—ing skull you scumbag motherf—–r.”

The message concluded: “Yeah, Kavanaugh – I don’t think so.”

In another rant aimed at the 85-year-old senator, DeRisi was recorded saying “We’re tired of this guy sucking taxpayers’ money! Getting a free f—ing ride! How many more years you gonna do it? None! He’s a dead man! 9 millimeter, side of the f—-ing head! If f—ing Kavanaugh gets in, he’s dead f—ing meat! Actually even if Kavanaugh doesn’t get in he’s dead f—ing meat. 9 millimeter, side of the head, you f—ing old bastard.”

Most of the calls were placed from a pre-paid cell phone, according to court docs.

DeRisi took a different tone with Collins, of Maine, calling her a “twit” on the day of the vote.

“I’m gonna get you,” he’s accused of saying. “You better pray this guy don’t get in.”

He left another message two minutes later, saying: “tick-tock, tick-tock, tick-tock.”

Less than an hour later, Collins received another message from DeRisi.

“Listen, you dumb son of a bitch, don’t you know that guy’s a sex offender? How could you not know that…you f–king twit.”

DeRisi pleaded guilty in Nassau County in 2015 to one count of aggravated harassment, for repeatedly calling his target’s office more than 15 times, and leaving threatening voicemails. It’s not clear if that victim was also a public figure. A message to DeRisi’s residence was not immediately returned.

Reps for Collins did not return requests for comment, while Grassley’s office referred the Post to the Public Information Office of the United States Capitol Police, who also declined to comment.

“Representative democracy cannot work if elected officials are threatened with death for simply doing their job,” United States Attorney Richard Donoghue said in a statement. “The First Amendment – the pinnacle of American achievement – protects debate, disagreement and dissent, not death threats. We and all those dedicated to the rule of law will not tolerate the use violence and threats of violence in attempts to prevail in political disputes.”

Ageist: Rosie O’Donnell calls for senior GOP politicians to retire

From Fox News: Rosie O’Donnell took to Twitter to mock the age of prominent Republicans, calling on Senate Judiciary Committee Chairman Chuck Grassley and Sen. Orrin Hatch, R-Utah, to retire – despite lefty leaders being the same age.

“Grassley and hatch – too old – they should be done – come on – at thanksgiving we don’t let the 85 year olds carve the turkey #retire,” O’Donnell tweeted.

Hatch, the Senate president pro tempore and third in the presidential line of succession behind Vice President Mike Pence and House Speaker Paul Ryan, and Grassley are two of the GOP’s most prominent members. Many Hollywood liberals, including O’Donnell, are currently upset that many Republicans continue to support Supreme Court nominee Brett Kavanaugh amid sexual harassment allegations.

Grassley is 85, while Hatch is 84 years old. But several prominent Democrats are in the same age range. Liberal icons Justice Ruth Bader Ginsburg and Dianne Feinstein are both 85, Maxine Waters is 80, Nancy Pelosi is 78 and Bernie Sanders is a spry 77 years old.

A 2014 Gallup poll showed the average retirement age is 62.

O’Donnell, 56, has a decades-old feud with President Trump and she has been an outspoken critic of his administration. Some of her followers were offended by her call for the older Republicans to retire.

I hate to bring this up but discriminating against someone because of their age is just as wrong as any other form of discrimination. Their behavior was the same decades ago. Approaching 70 myself, I’ll match wits with you any time you’d like,” one user wrote.

“Not cool,” another follower added. “Plenty of 85 year old people are as sharp as ever.”

Just last year, CNN published a story headlined, “The Democratic Party has an age problem,” that noted the ongoing problem with the advanced age of some liberal leaders.

“Democratic leaders across both the legislative and executive branches are generally older than leadership on the other side of the aisle,” CNN’s Ryan Struyk wrote before noting the average age of Democrats on Capitol Hill was 61, while the average Republican was 57.2 years old.

The top man in the Bureau of Alcohol, Tobacco and Firearms (ATF) has turned sensationally against his Department of Justice bosses saying they were trying to stymie an investigation into the Operation Fast and Furious scandal.

Kenneth Melson, acting director of the ATF, gave a secret deposition to Congress on July 4, it was revealed today. He took his own lawyer instead of relying on one from the ATF.

The stunning move will increase pressure on Attorney General Eric Holder to resign over the operation that saw some 2,000 guns sold to straw buyers who then sold them to Mexican drug cartel leaders.

But Fast and Furious and its sister plan, Project Gunrunner, went disastrously wrong, and 80 percent of the weapons went missing. Two were found at the Arizona site where Border Agent Brian Terry was killed in December.

Republicans leading the investigation in both the House and Senate wrote a stinging letter to Holder yesterday informing him of Melson’s move, calling it “extremely helpful to our investigation.”

Rep. Darrell Issa and Sen. Charles Grassley wrote, “He was candid in admitting mistakes that his agency made and described various ways he says that he tried to remedy the problems.”

Issa and Grassley said Melson claimed that ATF’s senior leadership would have preferred to be more cooperative with the congressional probe.

“However, he said that Justice Department officials directed them not to respond and took full control of replying to briefing and document requests from Congress. The result is that Congress only got the parts of the story that the Department wanted us to hear,” they wrote.

“If his account is accurate, then ATF leadership appears to have been effectively muzzled while the DoJ sent over false denials and buried its head in the sand.”

The Dirty 19: Senators Who Voted to Censor Internet


Want to know who are the enemies of liberty in Congress? Here’s a list of 19 Senators who just voted to censor the Internet.
On November 18, 2010, the lame duck Senate Judiciary Committee unanimously voted to move forward with censoring the Internet via the COICA bill, S. 3804, although the bill is a clear violation of the First Amendment.
Here’s what the Electronic Frontier Foundation, an international non-profit digital rights advocacy and legal organization based in the United States, says about S. 3804:

The “Combating Online Infringements and Counterfeits Act” (COICA) is an Internet censorship bill which is rapidly making its way through the Senate. Although it is ostensibly focused on copyright infringement, an enormous amount of noninfringing content, including political and other speech, could disappear off the Web if it passes.
The main mechanism of the bill is to interfere with the Internet’s domain name system (DNS), which translates names like “www.eff.org” or “www.nytimes.com” into the IP addresses that computers use to communicate. The bill creates a blacklist of censored domains; the Attorney General can ask a court to place any website on the blacklist if infringement is “central” to the purpose of the site.
If this bill passes, the list of targets could conceivably include hosting websites such as Dropbox, MediaFire and Rapidshare; MP3 blogs and mashup/remix music sites like SoundCloud, MashupTown and Hype Machine ; and sites that discuss and make the controversial political and intellectual case for piracy, like pirate-party.us, p2pnet, InfoAnarchy, Slyck and ZeroPaid . Indeed, had this bill been passed five or ten years ago, YouTube might not exist today. In other words, the collateral damage from this legislation would be enormous. (Why would all these sites be targets?)
There are already laws and procedures in place for taking down sites that violate the law. This act would allow the Attorney General to censor sites even when no court has found they have infringed copyright or any other law.

Although countless experts have said S. 3814 would be ineffective, unconstitutional, bad for innovation and the tech economy, the Senate Judiciary Committee approved of the bill anyway. Hypocrites that they are, many of the same senators who voted in favor of net censorship have been speaking out against internet censorship in other countries.
