B.A.T.F. Approves Drive-Through Gun Sales

Had I not checked this out myself, I would have thought this to be an April Fools joke. The Bureau of Alcohol, Tobacco and Firearms has authorized all FFL licensees to sell firearms through drive-up windows of their stores.

Or in outdoor kiosks.

Or in parking lots.

Life is good!

The ATF’s April 10 letter to FFL licensees issued the new guidlines  in response to the coronavirus disease (WU HAN  virus 武漢病毒).

“In light of the March 13, 2020, declaration of a national emergency concerning the outbreak of the novel coronavirus disease (COVID-19), and the Department of  Homeland Security’s subsequent classification of firearms businesses as essential, the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) has received questions from industry members  regarding the legality of firearm sales and deliveries exterior to the brick-and-mortar structure at which the firearms business is licensed. Specifically, Federal Firearms Licensees (FFLs) have requested guidance regarding whether they may verify customer identity and permit the completion of paperwork, including for purposes of the National Instant Criminal Background  Check System; accept payment; and deliver firearms or ammunition to customers (collectively, “the requested activities”) in the following settings:

(1) a drive-up or walk-up window or doorway on the FFL’s property;

(2) a temporary table or booth located in a parking lot on the FFL’s property; and

(3) a nearby space that is not located on the FFL’s property.As is further detailed below, pursuant to the Gun Control Act (GCA) and its ATF Federal Firearms Licensees. ”

“The Bureau of Alcohol Tobacco Firearms and Explosives, in new guidance to federally licensed firearm retailers, said Friday that dealers can provide drive-up or walk-up service to reduce health risks posed by the coronavirus.

The guidance was issued, the ATF said, in response industry questions about how business transactions could be restricted following the declaration of a national health emergency.

The move was made at the request of the National Shooting Sports Foundation in an effort to expedite background checks and make the firearms sales process as safe for both gun retailers and customers as possible given COVID-19 武漢病毒  social distancing guidelines.”

Gun-controlled California: Suspects linked to Orinda Halloween gang-related shooting were prohibited possessors

Dones and Johnson: Not worried about the safety of CA citizens/AP photos

Last Halloween a shooting took place at an Airbnb rental in Orinda, CA. Five people were shot and killed. The party had been advertised on social media. Many of the guests in attendance were rival gang members.

Just earlier in October Governor Newsom signed 15 MORE gun control laws “aimed at strengthening gun control and the gun violence restraining order program.”

According to Gov. Newsom, “California is once again leading the nation in passing meaningful gun safety reforms.”

ABC 10 reported at the time that former Congresswoman Gabrielle Giffords, co-founder of Giffords: Courage to Fight Gun Violence said, “The legislative package Governor Newsom signed today will help make California safer for all who call it home.”

Guess two felons in possession of handguns missed the memo about keeping California safer.

SF Gate reports that two suspects associated with the Orinda shooting – Domico Dones and Frederick Johnson – were arrested and charged with felon in possession of a handgun with a laser scope and ammunition (Dones) and similar charges for Johnson (who also faced an additional charge of child endangerment).

Agents with the federal Bureau of Alcohol, Tobacco, Firearms and Explosives linked a gun used in the shooting in Orinda to other shootings in the Bay Area. More from the SF Gate report:

“It wasn’t clear whether Dones and Johnson were at the unsanctioned Oct. 31 party at an Airbnb rental house in Orinda. Authorities said they couldn’t discuss how their arrests relate to the shooting investigation because it remains active.

Dones and Johnson were not among five people who were arrested last week in connection with the shooting. Four of them were then released after Contra Costa county prosecutors said they didn’t have enough evidence to file charges.

The East Bay Times reports the fifth suspect remain held on an unrelated probation violation.

The ATF is offering a $20,000 reward for information leading to arrests or convictions in the case.

Rival gang members and people armed with guns were among the more than 100 people who were at the party that was promoted on social media as an “Airbnb mansion party,” authorities said. Investigators said they believe an altercation that started in the kitchen led to gunfire and that there were multiple shooters.”

Creepy Joe: Sell back your assault weapons or register them with the government

Joe’s got a plan to end America’s gun violence. Funny how he and Obama couldn’t end gun violence while they were in office for eight years.

“It’s within our grasp to end our gun violence epidemic and respect the Second Amendment, which is limited. As president, Biden will pursue constitutional, common-sense gun safety policies. Biden will:

Get weapons of war off our streets. The bans on assault weapons and high-capacity magazines that Biden, along with Senator Feinstein, secured in 1994 reduced the lethality of mass shootings. But, in order to secure the passage of the bans, they had to agree to a 10-year sunset provision and when the time came, the Bush Administration failed to extend them. As president, Biden will:

Ban the manufacture and sale of assault weapons and high-capacity magazines. Federal law prevents hunters from hunting migratory game birds with more than three shells in their shotgun. That means our federal law does more to protect ducks than children. It’s wrong. Joe Biden will enact legislation to once again ban assault weapons. This time, the bans will be designed based on lessons learned from the 1994 bans. For example, the ban on assault weapons will be designed to prevent manufacturers from circumventing the law by making minor changes that don’t limit the weapon’s lethality. While working to pass this legislation, Biden will also use his executive authority to ban the importation of assault weapons.

Regulate possession of existing assault weapons under the National Firearms Act. Currently, the National Firearms Act requires individuals possessing machine-guns, silencers, and short-barreled rifles to undergo a background check and register those weapons with the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF). Due to these requirements, such weapons are rarely used in crimes. As president, Biden will pursue legislation to regulate possession of existing assault weapons under the National Firearms Act.

Buy back the assault weapons and high-capacity magazines already in our communities. Biden will also institute a program to buy back weapons of war currently on our streets. This will give individuals who now possess assault weapons or high-capacity magazines two options: sell the weapons to the government, or register them under the National Firearms Act.

Reduce stockpiling of weapons. In order to reduce the stockpiling of firearms, Biden supports legislation restricting the number of firearms an individual may purchase per month to one.”

Pancho Beto wants mandatory buyback of “assault weapons” and gun registry

Fortunately, this guy has no chance whatsoever of becoming president.

Pancho Beto announced via Twitter on Friday his plan to end gun violence which includes the following:

“Beto will work with Congress to create a nationwide gun licensing system that will ensure individuals seeking a gun undergo an assessment by law enforcement and a background check. Individuals must be 21 years old to receive a license, will be required to complete a certified gun safety training, and will need to renew their licenses every five years.

Individuals will also be required to register their guns through a registry and all new handguns will be microstamped. In recognition of the country’s long hunting tradition, those under 21 with hunting licenses will be able to lawfully possess firearms for hunting. States will have the flexibility to administer their own licensing systems, allowing them to set higher standards. Where a state does not have a system in place, the federal government will administer the system.

Weapons of war belong on the battlefield, not in our communities or on our streets. Beto is calling for a mandatory buyback program for assault weapons and a voluntary buyback program for handguns. To create a funding stream for buybacks, Beto will increase the excise tax on gun manufacturers and fines imposed on gun traffickers, and will enable ATF to purchase any banned assault weapons presented to the agency. Individuals who fail to participate in the mandatory buyback of assault weapons will be fined.

Fauxcahontas proposes more taxes on guns and ammo

Because raising taxes always solves big problems…

From Yahoo: Sen. Elizabeth Warren (D-Mass.) wants to sharply increase taxes on guns and ammunition as part of a comprehensive new plan to reduce gun deaths in the United States by 80%.

Warren, who is set to appear along with most of the other 20-plus Democratic presidential candidates at a gun control forum in Des Moines, Iowa, on Saturday, is also proposing universal background checks (like they already don’t exist?), federal gun licensing, a one-week waiting period on all gun purchases to limit impulsive violence, a ban on assault weapons and a newly empowered Bureau of Alcohol, Tobacco, Firearms and Explosives, among a host of other suggestions.

“Faced with a complex and entrenched public health crisis, made worse by the ongoing inability of a corrupt government (isn’t she part of that corruption?) to do anything about it, it’s easy to despair,” Warren wrote in a Medium post. “But we are not incapable of solving big problems. We’ve done it before.” (How’d that work out with Obamacare?)

Warren is unveiling her plan a week after deadly massacres in El Paso, Texas, and Dayton, Ohio, the latest in a years-long run of mass shootings that have transformed the politics of gun control, making it a key issue for Democratic primary voters and a key issue for the party in many general elections.

Warren chose the 80% mark for gun violence death reductions in order to echo the 80% reduction in driving deaths since 1965, when Congress decided the number of people dying in automobile accidents was unacceptable.

>“We’ll start by implementing solutions that we believe will work,” she wrote. “We’ll continue by constantly revisiting and updating those solutions based on new public health research. And we’ll make structural changes to end the ability of corrupt extremists to block our government from defending the lives of our people.”

Warren is not the first candidate to release a plan to combat gun violence, and much of the field ― including former Vice President Joe Biden and Sen. Bernie Sanders (I-Vt.) ― supports universal background checks and bans on high-capacity ammunition magazines. Sen. Cory Booker (D-N.J.) similarly pushed for federal gun licenses, and Sen. Kamala Harris (D-Calif.) has promised to use a wide array of executive actions to stem gun violence even if Congress doesn’t act.

Two things set Warren’s plan apart: the taxes and her emphasis on eliminating the influence of the National Rifle Association.

For a century, the federal government has imposed an excise tax on manufacturers and importers of guns and ammunition. Handguns are taxed at 10%, while all other guns and ammunition are taxed at 11%. Warren would raise the tax on guns to 30% and the tax on ammunition to 50%.

Warren’s plan to combat the influential but weakened NRA, which has essentially united the Republican Party against gun control and stonewalled Democratic movement on the issue for decades, includes a promise to appoint an attorney general who will investigate the NRA’s use of “loopholes … to divert member dues into lavish payments for its board members and senior leadership.”

Her plan also emphasizes the need for structural reforms, including ending the 60-vote requirement to end a filibuster in the Senate, in order to pass comprehensive gun violence legislation.

“Enough is enough,” Warren writes. “Lasting gun reform requires the elimination of the filibuster.”

Kamala Harris vows to take executive action on gun control if elected

Fortunately this womyn has a slim chance of taking the lead of the demorat presidential candidates.

From NY Post: Sen. Kamala Harris pledged Sunday that she will pursue executive action on gun control measures if Congress fails to act in the first 100 days of her presidential administration.

“I’m proposing, one, that if by my 100th day in office when elected president of the United States, if the United States Congress fails to put a bill on my desk … then I’m prepared to take executive action because that’s what’s needed: action,” Harris, a California Democrat and 2020 hopeful, said in an interview with CNN’s Jake Tapper.

Harris had first articulated the plan at a CNN town hall in late April, but bought it up again Sunday on the heels of yet another school shooting, in which 18-year-old Kendrick Castillo was killed after rushing the gunman to save his classmates.

“We are not waiting on tragedies and we are not waiting on good ideas,” Harris said, pointing to the “heroism of a child who we now mourn his loss, his parents’ only child.”

When asked how she liked Sen. Cory Booker’s (D-N.J.) proposal for a federal gun registry she answered, “I like the idea. But, Jake, I’m going to tell you, on the issue of the need for gun safety laws, we’re not at any loss for good ideas. People have been having good ideas for decades on this issue.”

Booker is also vying for the White House.

Harris said that the country was waiting for Congress to act. If she was forced to take executive action, Harris said she would require those who sell more than five guns a year to do background checks. She would also have the Bureau of Alcohol, Tobacco, Firearms and Explosives take away licenses from gun dealers that don’t follow the law.

Harris also expressed support for government intervention in dealing with Facebook. Co-founder Chris Hughes said Thursday that the social network should be broken up.

Asked by Tapper if she agreed with Hughes, Harris answered, “yes, I think we have to seriously take a look at that, yes.”

“I mean, when you look at the issue, they’re essentially a utility. Like, there are very few people that can actually get by and be involved in their communities or society or in whatever their profession without somehow, somewhere using Facebook,” Harris said. “It’s very difficult for people to be engaged in any level of commerce without – so, we have to recognize it for what it is. It is essentially a utility that has gone unregulated. And as far as I’m concerned, that’s got to stop.”

Over the course of the interview, Harris also tried to clean up comments she made to Tapper in January when she said she wanted to do away with private health insurance. Harris explained that while she supported Medicare-for-all “it doesn’t get rid of all insurance.” “It was in the context of saying, let’s get rid of all the bureaucracy. Let’s get rid of all the waste,” she said of her previous remark.

Harris said the Medicare-for-all bill she supports “doesn’t get rid of supplemental insurance.”

The legislation also entitles all residents of the United States to health care services.

Tapper asked if this meant Harris supported giving health care to illegal immigrants. “Let me just be very clear about this. I’m opposed to any policy that would deny in our country any human being from access to public safety, public education or public health, period,” Harris answered.

DOJ rule will reclassify bump stocks as machine guns in de facto ban

Are they also going to ban belt loops?

From US News: The Justice Department on Tuesday issued its final rule to ban bump stocks, making them illegal to own or sell.

The reform, the first major gun-control action in recent years and the first of the Trump administration, comes after several recent mass shootings – including one in Las Vegas at a country music festival carried out by a shooter using bump stocks.

A senior Justice Department official said that anyone who currently has bump stocks, a firearm accessory that allows guns to fire as quickly as automatic machine guns, has 90 days to turn them into the Bureau of Alcohol, Tobacco, Firearms and Explosives or destroy them, The Wall Street Journal reported. According to the official, tens of thousands of bump stocks are in America, but it is difficult to know an exact number.

According to the Journal, acting Attorney General Matthew Whitaker signed and submitted a regulation banning the devices on Tuesday, and it is expected to be published this week.

The ATF in 2010 has approved the accessory, saying it was not like machine guns, which are banned under federal law. However, following a spate of deadly shootings, an increase in gun-control activism and calls for stricter gun laws, President Donald Trump called on the Justice Department to prohibit their use.

Justice Department officials on Tuesday reclassified bump stocks as illegal machine guns, because they “convert an otherwise semiautomatic firearm into a machine gun” by allowing “the trigger to reset and continue firing without additional physical manipulation of the trigger by the shooter,” the Journal reported.

Hundreds of guns found en route to Chicago after being stolen from UPS facility in Tennessee

Apparently not all of Chiraq’s illegal guns come from Indiana.

From MyFoxChicago: Most of the roughly 400 guns that were stolen from a United Parcel Service facility in Tennessee have been recovered in the Chicago area, federal authorities said Tuesday.

Authorities seized about 365 Ruger .22-caliber and .380-caliber firearms after police officers responded to a call about suspicious activity in the southern Chicago suburb of Midlothian on Sunday afternoon – about 12 hours after the guns were taken from a UPS facility in Memphis, a Bureau of Alcohol, Tobacco, Firearms and Explosives agent said in court documents.

ATF had said the guns being shipped from a Ruger factory in North Carolina were taken by two men in a U-Haul truck. ATF spokesman Michael Knight said the truck was recovered along with the guns.

Court documents said officers found the truck at a store parking lot in Midlothian and questioned 24-year-old Roland Jackson of Chicago and 18-year-old Taveyan Turnbo before they both ran away.

Turnbo was arrested hours later and faces federal charges of possessing stolen firearms. He was scheduled for an initial court appearance Tuesday afternoon in Chicago. Court documents said he denied taking part in the theft at the UPS facility.

Jackson faces federal charges of being a convicted felon illegally possessing firearms. The ATF said he remained at large Tuesday.

The estimate of 400 stolen firearms makes it one of the largest single gun thefts the ATF has investigated, Knight said.

Turnbo told investigators he and Jackson had sold at least three of the guns for a total of $400, according to court documents.

UPS said it is cooperating with law enforcement.

ATF had asked the public to send social media posts, photos or any other information related to the theft. A $5,000 reward was offered for information leading to an arrest and conviction in the case.

How is this possible? Despite strict gun control laws, NJ arts festival shooting leaves 22 injured

On June 13, New Jersey Governor Phil Murphy (D) signed six bills aimed at eliminating gun violence infringing upon our Second Amendment rights. Those bills included: expand gun background checks, tighten the handgun carrying permit process, reduce the legal capacity of ammunition magazines and establish a so-called “red flag” law.
Even before these bills, New Jersey had some of the most restrictive gun control laws in the nation.
A shooting occurred over the weekend that injured over 20 people. Guess the governor needs to sign off on MORE gun control laws…
From Fox News: Nearly two dozen people were injured after gunfire broke out early Sunday during a fight at an all-night art event in New Jersey’s capital city, leaving one suspect dead which authorities said appeared to be caused by “neighborhood beef.”
(The dead suspect had just been released from prison.)
Mercer County Prosecutor Angelo Onofri said at a news conference that a total of 22 people were injured in the shooting, 17 of whom were treated for gunshot wounds at nearby hospitals. A second suspect is in custody.
“It’s a massive crime scene,” Onofri said.
Two suspects opened fire shortly before 2:45 a.m. at the 24-hour Art All Night show in the Roebling Market section of the city, according to Onofri, who told The Associated Press a “neighborhood beef” was behind the shooting.
The event began Saturday afternoon and was scheduled to continue until Sunday afternoon and typically draws thousands of people. The festival showcases local art, music and food.
“This is truly a tragedy for Trenton,” Trenton Mayor Eric Jackson said. Four people are listed as in critical condition, including a 13-year-old boy who is in “extremely critical condition,” according to Onofri.
Police have identified at least two suspects in the shooting. One, a 33-year-old man, was pronounced dead while the other was taken into police custody. Onofri said authorities “believe” the suspect who died was shot and killed by police. Trenton police at the scene told NJ.com that officers engaged with at least one gunman.
Authorities are now combing through the warehouse where the shooting took place as part of the investigation. Onofri said that “multiple weapons” were recovered at the scene. The Bureau of Alcohol, Tobacco, Firearms and Explosives said on Twitter the agency is “actively assisting” Trenton and New Jersey State Police with the shooting.
Onofri said that authorities are also investigating an attempted carjacking that took place in the area after the shooting. Three people were in a vehicle when a man came up and pointed a gun at them, the prosecutor said. Their vehicle sustained “some damage” during the confrontation, he added, without releasing further details.
A witness told The Trentonian he witnessed a fight break out before gunshots rang out, with several punches being thrown. “I saw two punches and then heard several gunshots,” Franco Roberts said.
Roberts told the newspaper he thought something bad was going to happen because there were “more people outside than in the warehouse” standing around.  “Everybody ran toward the door,” he said. “And the people fighting and shooting got mixed with the crowd that was running and they went out the door shooting.”
Angelo Nicolo told WPVI that he and his brother were at the event when they heard loud popping sounds, and that people started running down the street. “And all of a sudden, my brother goes to me, ‘You hear that gunfire?’ I go, ‘It sounds like fireworks.’ He said, ‘No, that’s gunfire.’ Next thing you know, we turn around and everybody’s running down the street. All hell broke loose,” Nicolo said.
The Trenton resident said he saw one person with a gunshot wound to the leg. “I saw two police officers escort a guy that got shot in the leg; they bandaged him up and whisked him away before the ambulance came here,” he told WPVI. “It was pretty gnarly.”
The event was billed as a showcase for more than 1,500 pieces of art. Authorities said that about 1,000 people were in the area when the shooting started and people stampeded.
“Devastated by last night’s shooting at Art All Night Trenton,” New Jersey Gov. Phil Murphy said on Twitter. “We must eradicate the scourge of gun violence from our communities.”
