Mukilteo shooting victim’s brother sues killer, store where gun was purchased

From KIRO: A lawsuit has been filed against a Washington state man convicted of killing three people at a house party and against the store where he bought the gun used in the killings.

The Daily Herald reports David Bui filed the suit earlier this month against 22-year-old Allen Ivanov, his parents and the Cabela’s outfitter store in Marysville, claiming the store and his parents should have known how Ivanov was planning to use the AR-15-style rifle.

(Note: Ivanov legally purchased his firearm. He warned friends that he was going to commit a mass shooting and those who actually knew how he was planning to use the AR-15 said absolutely NOTHING. From Wikipedia: Ivanov sent text messages to his friends alluding to his plans to commit a mass shooting a couple of days beforehand, calling himself a “future shooter”. Police say he was motivated by the recent breakup between him and one of the victims, and his anger that his ex-girlfriend seemed to be moving along in her life.)

Bui is the brother of Anna Bui, who was killed in July 2016 at a house in Mukilteo along with Jacob Long and Jordan Ebner. Ivanov was sentenced last year to life in prison without parole.

Representatives for Bass Pro Shops, Cabela’s parent company, did not return the newspaper’s calls or an email seeking comment.

More gun control: California senate votes to raise long gun purchases to age 21

From Fox News: The California legislature on Wednesday voted to raise the age for buying long guns throughout the state from 18 to 21.

Senate Bill 1100, introduced by Sen. Anthony Portantino, was approved with a 26-12 vote and sent to Democratic Gov. Jerry Brown for a signature, The Sacramento Bee reported.

The bill would limit those who can purchase rifles to age 21 and above. State law already limits the sale of handguns to people 21 or older.

Portantino cited the February massacre at Marjory Stoneman Douglas high school in Parkland, Florida — in which a 19-year-old used an AR-15-style gun to kill 17 people — as inspiration for the bill.

“The two most deadly recent school tragedies have been perpetrated by people under 21 with long guns,” Portantino said Wednesday. “We should be sending our children off to school knowing they are going to be safe, healthy and get a good education.”

Opponents of the legislation argued that people can obtain long guns through illegal channels and that state legislators should focus on making sure criminals and those with mental health issues cannot get guns themselves.

Republican Sen. Jim Nielsen said he thinks “bills like this miss the target,” according to the Los Angeles Times.

“What is magic about 21?” Nielsen asked. “All of a sudden you are not a danger anymore?

The bill includes exemptions for anyone under 21 who serve as police officers, in the military or have valid state hunting licenses.

What do you know: Dick’s Sporting Goods misses 2nd quarter sales expectations

Shocker, not. Pandering to the social justice warriors doesn’t guarantee they’ll boost your profits.

From CNBC: Shares of Dick’s Sporting Goods plunged by more than 9 percent Wednesday morning after the retailer said it sold less merchandise during the second quarter than analysts were expecting.

Sales at Dick’s Sporting Goods stores open for at least 12 months also tumbled by a bigger-than-expected 4 percent during the quarter. It was partly blamed on athleisure brand Under Armour, which has been moving into more low-price retailers like Kohl’s, frustrating companies like Dick’s that try to sell inventory at higher price points.

Under Armour shares were also falling Wednesday morning.

“As expected, sales were impacted by the strategic decisions we made regarding the slow growth, low margin hunt and electronics businesses, which accounted for nearly half of our comp decline,” CEO Ed Stack said in a statement. “In addition, we experienced continued significant declines in Under Armour sales as a result of their decision to expand distribution.”

Dick’s was also one of the first businesses in the U.S. to stop selling assault rifles and high-capacity magazines, and barred the sale of guns to customers under age 21 following the February massacre at a high school in Parkland, Florida. The company had predicted this move could hurt sales but also would draw more shoppers to its stores.

Stack said Wednesday he was confident sales would turn around as those challenges lessen.

Dick’s raised its profit outlook for the full year and now expects to earn $3.02 to $3.20 per share in 2018, up from a prior range of $2.92 to $3.12.

Chicago suburb bans assault weapons and large-capacity magazines

Via Yahoo (Reuters) – A Chicago suburb has banned the possession, sale and manufacture of assault weapons and large-capacity magazines in response to the massacre at a Florida high school and other recent mass shootings in the United States.
Residents of Democratic-leaning Deerfield, Illinois have until June 13 to remove any firearms and magazines that fall outside the new restrictions or face a fine of between $250 and $1,000 per day, according to an ordinance passed by the town board on Monday night.
The ban was a direct response to the Feb. 14 killing of 17 people at Marjory Stoneman Douglas High School in Parkland, Florida and the student-led campaign for tighter restrictions on guns inspired by the mass shooting, the ordinance said.
The Deerfield decision is likely to face legal challenges from gun rights groups that see it as a violation of their constitutional rights. A similar ban in Highland Park, Illinois was challenged all the way to the U.S. Supreme Court and upheld.
The National Rifle Association and the Illinois State Rifle Association did not immediately respond to requests for comment.
“We hope that our local decision helps spur state and national leaders to take steps to make our communities safer,” Deerfield Mayor Harriet Rosenthal said in a statement.
Opponents of the ban fear the town will now try to outlaw other firearms, further violating their right under the Second Amendment of the U.S. Constitution to own guns.
“First it’s going to be assault rifles. There will be new bans in the future. It’s just a matter of time,” Deerfield resident Larry Nordal told the Chicago Tribune. Nordal did not immediately respond to a request for further comment.
The ban defines assault weapons as a range of firearms such as semiautomatic rifles like the AR-15, a gun similar to the one used in the Florida massacre. High-capacity magazines are defined as those holding more than 10 rounds.
Deerfield High School senior Ariella Kharasch, who supported the legislation, wants more action on the local and national levels. “This is our generation’s fight. We’re going to keep fighting and this is part of it. Change happens gradually step by step,” Kharasch told the Chicago Tribune.
Some excerpts from the ordinance (which lists specific firearms):
“…may increase the public’s sense of safety by effecting a cultural change which communicates the normative value that assault weapons should have no role or purpose in civil society…”
“…the possession, manufacture and sale of assault weapons in the Village of Deerfield is not reasonably necessary to protect an individual’s right of self-defense…”

Bump stock ban makes it way through Washington state senate

Following in the foot steps of New Jersey, this “feel-good” bill will do nothing, absolutely NOTHING, to prevent people from bump firing.
From Hanna Scott at MyNorthwest.com: It was a big win for Washington Democrats and gun control advocates Thursday night as the state Senate approved a bump stock ban.
The bump stock ban is among a slew of gun control legislation making its way through the state Legislature this session (See here for the other anti-gun bills, including large capacity magazine ban and license/registration of “assault weapons”). But it’s one that many have had their eye on. The so-called bump stocks are a trigger modification that allows a semi-automatic rifle to fire more rapidly — similar to a fully automatic. It was used by the Las Vegas gunman who killed 58 people and injured hundreds.
This bill went through a Senate committee earlier this month where survivors of the Vegas shooting told lawmakers how dangerous the devices can be. A local mother who’s daughter was killed in the shooting begged lawmakers to ban bump stocks.
“The bump stock modification on the AR-15 that murdered Carrie increased the gun’s rate of fire to nine rounds per second,” she said. “Think of that — a 30-round magazine could be emptied in just over three seconds. Nobody stood a chance.”
Bump stock ban
Critics complained the bill was too broad because it included all types of trigger modifications, some of which can just be used to improve sighting and accuracy. But it made its way out of committee. It was debated late Thursday night on the Senate floor where Republican Senator Mike Padden fought for an amendment that would not ban the bump stocks at all. He proposed other measures.
“Rather than ban them, it takes a different approach and allows for the same requirements and procedures for purchasing and owning a pistol or handgun for the purchase and possession of a bump fire stock, including requiring a state and federal check at the time of acquisition,” Padden proposed.
But Democratic senators like Jaime Pedersen weren’t feeling it.
“This amendment essentially legalizes bump stocks with a background check and I think that’s the wrong direction to go in,” Pedersen argued. “The state has a very long history of not allowing machines guns or fully automatic rifles. And that is the reasoning behind why I brought this bill forward in the first place.”
Padden’s amendment failed, but another amendment by Republican Senator Hans Zieger did pass. Zeigler’s amendment tightens up the bill as far as the definition of trigger modifications, so the ban doesn’t effect trigger mods that help with things like accuracy. The final bill only bans modifications that are specifically designed to accelerate the rate of fire.
Lingering concerns
But before final passage there were still plenty of concerns from some Republicans, including Senator Mark Schoelser who argued it was slippery slope for gun rights in Washington state.
“Clearly, this is the first gun seizure in the State of Washington,” Schloesler said. “Because if you are found in possession, you are a felon. Turn it in, have it seized, be a felon. It is gun seizure for the first time.”
The ban cleared the Senate on a 29-20 vote with four Republicans joining the Democratic majority. If it clears the House and Governor Jay Inslee signs it as is, the ban would go into effect in July. After that, it would become illegal to manufacture or sell a bump stock in Washington. A year later it would become illegal to own or posses a bump stock. Anyone who owns them will have to turn them in. They’d also be declared contraband that can be seized by police, which had some Republicans concerned cops would go into homes to seize the weapons.

Liberal logic: Despite all the gun control laws in California, the illegalities of gun acquisition and questionable mental wellness of this shooter, it’s still the NRA’s fault.
From NY Post: The deranged Northern California gunman built two of the four weapons he used in his bloody rampage himself, authorities said.
Kevin Janson Neal — who killed five people Tuesday before being gunned down by police — fashioned a pair of AR-15 semi-automatic rifles from parts he purchased, the Record Searchlight reported.
These firearms were manufactured illegally, we believe, by him at his home,” Tehama County Assistant Sheriff Phil Johnston said Wednesday. “So they [the guns] were obtained in an illegal manner, not through a legal process. They are not registered.”
Cops said the crazed gunman had also used two handguns that were registered to someone else.
A restraining order issued in February prohibited him for owning guns.
The order was put in place after he was charged with assaulting two women in January, the outlet reported. He was out on $160,000 bail when he carried out the shooting.
Investigators believe Neal, 43, started his rampage by killing his wife Monday, then donned a ballistic vest the following morning, grabbed his weapons and set off on a 45-minute killing spree.
He killed two neighbors, stole their truck and drove around, randomly picking off targets.
He also tried to get into the Rancho Tehama Elementary School but was unable to after a quick-thinking staff member ordered a lockdown.
Neal appeared to have wanted to exact revenge on his neighbors after a long-running dispute, authorities said.

Mark Kelly’s campaign against “assault weapons” such as the AR-15 rifle has sparked a local backlash. On March 13, a Tucson, Arizona radio host published a photograph of former Congresswoman Gabby Giffords holding an AR-15 rifle at a gun range.
Giffords has since confirmed that the photograph is authentic.
James T. Harris, blogging at the website of “101.4 FM The Truth,” wrote:
What is wrong with this picture? Absolutely nothing, and prior to the aggressive progressive opportunistic fear mongering in the wake of Sandy Hook, this picture would have raised no eyebrows and garnered little public attention.
However, in response to the exploitative political scheming of Mark Kelly, persons connected to Congresswoman Giffords released this photo in response to what they perceived to be her husband’s hypocrisy.
Subsequently, Breitbart News confirmed the authenticity of the image through law enforcement sources in Arizona, and obtained a copy of the photograph from a source who requested anonymity.
The latter source was present when the photograph was taken, and said that Giffords had requested it for campaign purposes during October 2010.
According to the source, the image sent to Breitbart News was cropped to protect the identity of the person on the right-hand side of the original photograph (to Giffords’s left).
The source, who is a member of the law enforcement community, told Breitbart News:
“We were told she wanted to toughen her image. She asked to come out and she wanted to shoot a rifle. She had one of our guys out there to show her how to shoot an AR-15.”
In January 2011, Giffords suffered near-fatal wounds in a mass shooting while meeting with constituents in Tucson. The perpetrator used a 9mm Glock 19 semi-automatic pistol.
Giffords and husband Mark Kelly have since formed an organization, Americans for Responsible Solutions, to press for policy changes such as limiting the sale of “assault weapons, ” including the AR-15.
Breitbart News reported last week that Kelly attempted to purchase an AR-15 from a gun store in Tucson earlier this month.
Likewise, the AR-15 that Giffords is shown holding in the image is a standard, semi-automatic civilian weapon, according to the source who saw it being taken.
The source saw a campaign official take the photograph, which was later provided to law enforcement personnel as a courtesy, according to the source.
The source says the existence of the photograph has been known in the local law enforcement community for a while: “I’m not the only one who knows about this photo.”
Multiple law enforcement sources in Arizona told Breitbart News that Mark Kelly’s campaign against “assault weapons” has generated resentment within the law enforcement community–and a desire that the photograph be made public.  The source who witnessed the photograph put it this way:  “Giffords and Kelly came across with a different demeanor in 2010. To me, it seems like they’ve done a complete 180 because of what happened. And with the latest controversy–with Mark Kelly doing what he did with the AR-15 stunt–this photo needs to be put out.”
While Kelly declined to comment, Americans for Responsible Solutions spokesperson Jen Bluestein told Breitbart News: “Looks like the photo is cropped.”  Bluestein noted that there are “many images of Gabrielle Giffords with guns,” though she said she had not seen the image of the AR-15 before.
At 1:14 p.m. PDT, Giffords posted two images on her Facebook page with the following statement:
“Here are two photos of me that a conservative blog has dug up. I remember both of these days fondly. The first is at the Tucson Police Department firing range. They invited me to test rifles and tasers that they bought with federal funds, which I helped secure. The second was in Afghanistan while I was visiting with our troops serving abroad. My work as Southern Arizona’s Congresswoman frequently put me in close contact with some of the world’s most powerful and deadly weapons – supporting police departments, advocating for the Border Patrol, standing up for our troops in Iraq and Afghanistan, and supporting my constituents’ and my own Second Amendment rights.
I grew up with guns, and I like owning them. So does my husband Mark. It’s an interest we’ve shared ever since we met. It’s part of my heritage as an Arizonan and it’s my right as an American. Being able to shoot a gun is something I haven’t been able to do since I was shot – because my right arm is paralyzed, and I’m less mobile than I was.
“As I member of the House Armed Services Committee, I proudly spent a lot of time with our military, border patrol and state and local law enforcement. I guess the intention of those who have publicized these photos is to somehow call into question my belief that military style assault weapons should be more strongly regulated with background checks and other safeguards. I have never wavered in my support for those who serve our country. I fought to make sure they have the weapons and safety gear needed to carry out their mission, and proper health and mental care when their service ends.”
I don’t have to choose between owning, using, and enjoying guns, on one hand, and preventing gun violence, on the other. Both sides need to come together to support commonsense solutions to gun violence, like keeping guns out of the hands of dangerous people like the young man who shot me. That’s why I’m fighting this fight. That’s why I’m working to bring people together to support gun rights and reduce gun violence. I hope you join me.

Gun Manufacturers Refuse To Sell To Government Agencies.

For months, we’ve been showing the hypocrisy of the left when it comes to guns. They don’t want guns for citizens to protect themselves, but they want guns for police, government officials and bodyguards. And no one can justify having an AR-15. Even though it is only a semi-automatic weapon like most handguns, they look scary, and therefore should not be accessible to citizens. Police and military, sure, but not ordinary people.

Well, it looks like those restrictions are backfiring. Six firearms manufacturers are fed up with these gun control laws around the country, and they’ve made announcements stating that they will no longer be selling their products to any government agency within a jurisdiction that restricts firearms from citizens.

Olympic Arms had this to say:

 “Due the passing of this legislation, Olympic Arms would like to announce that the State of New York, any Law Enforcement Departments, Law Enforcement Officers, First Responders within the State of New York, or any New York State government entity or employee of such an entity – will no longer be served as customers. In short, Olympic Arms will no longer be doing business with the State of New York or any governmental entity or employee of such governmental entity within the State of New York – henceforth and until such legislation is repealed, and an apology made to the good people of the State of New York and the American people.”

Here’s another statement from York Arms:

Based on the recent legislation in New York, we are prohibited from selling rifles and receivers to residents of New York. We have chosen to extend that prohibition to all governmental agencies associated with or located within New York. As a result we have halted sales of rifles, short-barreled rifles, short barreled shotguns, machine guns, and silencers to New York governmental agencies.”

 Other manufacturers include LaRue Tactical, Extreme Firepower, Templar Custom and Cheaper than Dirt.

They’re only being consistent and fair. And liberals are all about making sure we all have “equal rights.” So, if these manufacturers are not allowed to sell a particular gun or clip to a regular, law-abiding citizen, then forget it, they’re not going to sell it to a police officer or the mayor’s security detail either.

Now, if we could just get Glock, Sig Sauer and Smith and Wesson on board, then that could do some real damage. If they do join the boycott, watch for the government mandate requiring that they continue manufacturing for the government.
