A great American and hero in the Arkansas State Legislature, Rep. Andy Mayberry, of Hensley, introduced into the Arkansas State Legislature, “The Pain-Capable Unborn Child Protection Act,” HB 1037, which became law in Arkansas on February 28, 2013.

This new law in part would ban abortions at 20 weeks, the point at which the bill claims a fetus is capable of feeling pain.  Nevertheless, this bill did not become law without opposition from Arkansas’ Democratic Governor Mike Beebe, who vetoed this bill on Tuesday, February 26th, claiming that this bill was contrary to the 1973 U.S. Supreme Court decision of Roe v. Wade, and further justifying his decision because he didn’t want the state of Arkansas to pay the cost of defending this measure.

The bill had been passed by the Republican legislature garnering the support of many Democrats.  However, yesterday, February 27th, the House voted 53-28 to reaffirm the bill, and today, February 28th, the Senate voted 19-14 to reaffirm the bill, and combined, these overrode Beebe’s veto, making the bill, law, thus satisfying the simple majority vote requirement in both chambers.

Unfortunately, this law provides exceptions in cases of rape, incest and pregnancies that endanger the mother’s life or could cause irreversible physical impairments; but, it does not provide for any exemption for fetal disorders or abnormalities.  I believe that babies are babies no matter what the situation of their conception and that how that pregnancy came about still does not affect the fact that the baby is a child, a live infant person, who is guaranteed life, liberty and the pursuit of happiness under the United States Constitution.

However, it is still a great victory for Life against the abortion industry/mill.  Rep. Mayberry told the Associated Press that this law was patterned after the law in the State of Nebraska which has not been challenged as yet, further citing justification as a result of the advancements in pre-natal science which provide new evidence and definitions of “viability”.

The States of Nebraska, Kansas, Idaho, Oklahoma, Louisiana, Georgia and Alabama have also enacted the Pain-Capable Unborn Child Protection Act and/or similar legislation protecting the unborn.  Rep. Mayberry speaking on the House Floor Wednesday, called HB1037 “a bill that saves babies’ lives.  These are babies who are capable of feeling pain.  The methods used to abort those pregnancies are excruciatingly painful.”

Additionally, another bill is still pending entitled, “The Arkansas Human Heartbeat Protection Act,” SB 134, introduced by another great American hero, Arkansas Republican Senator Jason Rapert, from Conway, which has also garnered support in the Republican-majority legislature which most probably will be presented to the Governor in the very near future.  If this bill becomes law, it would ban abortions once a heartbeat was detected, requiring a woman seeking an abortion at 12 weeks of gestation or later to undergo an abdominal ultrasound to check for a fetal heartbeat, and it would prohibit an abortion if a heartbeat is detected, but adds an exception in the case of a fetal anomaly that would not allow the child to live after birth.  More information will be provided on this bill and our prayers are warranted for its passage as well.

Finally, Governor Beebe did sign into law last Tuesday, February 26th, the “Pregnant Woman’s Protection Act” which insures that a pregnant woman and her unborn child are protected from unlawful criminal violence and that a woman’s decision to carry her child to term be respected.  According to Charmaine Yoest, Ph.D. and President & CEO of Americans United for Life, “A pregnant woman is more likely to be a victim of homicide than to die of any other cause,” and that “criminal investigations across the nation demonstrate that husbands or boyfriends are oftentimes perpetrators of pregnancy-associated violence and that this violence is often intended to end or jeopardize the pregnancy.”  Dr. Yoest further provides that “Studies have shown that violence and abuse are often higher during pregnancy than during any period in a woman’s lifetime.”

Accordingly, we should appreciate these victories!  I am praying that the Arkansas Human Heartbeat Protection Act becomes law as well!

Abortion clinics closing across America

The pro-life campaign is changing hearts and minds.

The evidence:

More and more abortion clinics are closing down across America. So much so that the leftwing Huffington Post bemoans the “dramatic toll” that recent pro-life laws have taken on abortion clinics, with Arizona leading the way.

Tom Strode reports for the Baptist Press (via Christianity Today) that the reasons for closure vary, but the overall trend is clear:Abortion centers are shutting down at an unprecedented rate. The total so far this year is 44,  according to the pro-life Operation Rescue, which monitors closings and health and safety violations by clinics nationwide. That number far surpasses the 25 surgical clinics shutdown last year and the 30 in 2011.

Among the 44 that closed this year are 42 clinics that provided surgical abortions, and two that offered chemical abortions by drugs. Some of the shutdowns have been of major clinics, including Virginia’s No. 1 abortion provider: NOVA Women’s Healthcare in Fairfax, Va., which shut down after state and local governments enacted regulations the abortion provider appeared unable to meet. The clinic had performed 3,066 abortions in 2012 and 3,567 in 2011.

The reasons given for the upswing in closings include:

One of the clinics that closed this year was the Planned Parenthood center in Bryan, Texas. The closing came less than four years after Abby Johnson, responding to the call of her conscience, walked out of that clinic as its director and into the offices of the Coalition for Life.

Since her dramatic reversal, Johnson has become a leading pro-life advocate and has started a ministry to help workers leave the abortion industry. In a written statement after the announcement of the closing of the Bryan Planned Parenthood abortion center, Johnson pledges to “fight until every abortion clinic in this country has shut down” — “Knowing that the former abortion clinic I once ran is now closing is the biggest personal victory of my life. From running that facility, to then advocating for its closure, and now celebrating that dream … it shows that my life has indeed come full circle.”

State legislatures enacted 69 pro-life laws this year, according to a report released Thursday (Sept. 5) by Americans United for Life. In all, 48 states considered about 360 such proposals in 2013, AUL reported.

The legislative action this year continued a recent trend in states: 70 “life-affirming measures” became law in 2011 and 38 in 2012, according to AUL.

Some measures have targeted making the procedure and clinics safer for women, and have helped escalate the number of clinic shutdowns. This year, states such as Alabama, North Carolina and Texas passed varied laws either requiring abortion clinics to meet the same health and safety standards as outpatient surgical centers, or authorizing the state to enforce such requirements. Also, in 2013, North Dakota and Wisconsin joined Alabama and Texas in mandating abortion doctors have admitting privileges at local hospitals.

Meanwhile, the abortion battle has gone digital as more states ban abortions by telemedicine.

Taxpayers Fund 1/3 of Planned Parenthood's Budget


To the 53% of Americans who still pay federal income tax:
Do you know that your tax dollars fund as much as one-third of the budget of the abortion mill with the Orwellian name of “Planned Parenthood”? (What sort of “parent” kills her/his own child?)
The Catholic News Agency reports on July 17, 2011, that a new in-depth report on Planned Parenthood (PP) by the pro-life group, Americans United for Life, finds that $363 million – one-third of PP’s annual budget  – comes from the American taxpayer.
Americans United for Life’s report, “The Case for Investigating Planned Parenthood,” is the result of their legal team researching more than 20 years of PP records, law enforcement reports, and other materials. The $363 million figure is by Planned Parenthood’s own accounting.
At a July 14 press conference in Washington, D.C., hosted by Rep. Renee Ellmers (R-NC) and Rep. Randy Hultgren (R-Ill.), President of Americans United for Life Dr. Charmaine Yoest said, “While Congress is discussing going deeper in debt and raising the debt ceiling … our government is quietly subsidizing the world’s largest abortion provider with $1 million a day.
Here are some of the study’s findings:

  • Government taxpayers’ funding of Planned Parenthood has doubled since 1998 – as well as the number of abortions performed.
  • PP has committed numerous financial malpractices and human rights abuses over the last two decades, including failure to report criminal child sexual abuse, failure to comply with parental involvement laws, and willingness to refer to substandard clinics.
  • Planned Parenthood has been documented as assisting people engaged in prostitution and/or sex trafficking, and has “dangerously” misused the abortion drug RU-486.
  • PP has provided inaccurate and misleading information to women regarding fetal development, abortion’s health risks, and to patients on emergency contraception, including the pill “ella”.
  • PP committed Medicaid fraud — in California, New York, New Jersey and Washington state – where PP affiliates have been exposed for fraudulent overbilling practices.

Yoest calls for an investigation and Congressional hearings into Planned Parenthood and its systematic abuse of federal funding: “American taxpayers are being forced to directly support this abortion-saturated organization which is fraught with fraud and misuse of government monies.”
