Straw purchaser who bought gun used by Omaha cop killer gets probation

Courts are soft on criminals yet politicians are making it tougher for law-abiding citizens. And Officer Orozco and her family paid the ultimate price for this injustice. The woman who illegally purchased a gun for her boyfriend, who in turn used the gun to fatally shoot Omaha police officer Kerrie Orozco earlier this year has been sentenced to one year of probation, a federal judge ruled Monday.
Jalita Johnson, 26, bought the Glock semi-automatic handgun, along with a 50-round drum magazine and ammunition from a Jonesboro, Georgia, pawnshop in April. Johnson lied on the corresponding paperwork at the time of the purchase, answering “yes” when asked if she was the actual buyer of the gun and not purchasing the gun for another individual. Prosecutors, however, ascertain that Johnson’s boyfriend, Marcus Wheeler – a 26-year-old convicted felon and known gang member prohibited from making the purchase himself – gave her the money for the gun and told her exactly what to buy.
The following month, on May 20, Omaha officers were in pursuit of Wheeler, who was wanted in connection with another shooting, when an exchange of gunfire erupted. Wheeler fired a total of nine rounds, one of which struck Orozco right above her bullet-proof vest. Wheeler was subsequently shot and killed by Sgt. Jeff Kopietz during the continued pursuit. Orozco, who at the time was working her last shift before taking a deferred maternity leave days after her premature baby was released from medical care, was rushed to the hospital, but efforts to save her were unsuccessful.
In August, Johnson, who initially said someone who lived with her took the gun but later admitted she bought it for Wheeler, pleaded guilty to providing false information to a federally licensed firearms dealer when she purchased the gun. In addition to a year of probation, U.S. District Judge Eleanor L. Ross ordered Johnson to 40 hours of community service and 180 days of house arrest.
However, the Omaha police union is unhappy with Johnson’s sentence and referred to the day in court as the “day the federal justice system failed.”
“The members of the OPOA cannot begin to express the amount of anger, frustration, and sadness this news brings to us,” the union said, adding that Johnson could have been given a $250,000 fine and up to 10 years in prison.
“How does this make you feel knowing the court system that is supposed to help protect you from violent felons and those who aid them just let her walk free?” the union queried. “What kind of message does this send to offenders in the future that will purchase guns for violent felons that are prohibited from possessing firearms?”

How a firearm is obtained is irrelevant, just as who possesses it is irrelevant. That is exactly what is meant by “The Right To Keep And Bear Arms Shall Not Be Infringed”. What is relevant is what that firearm is used for.
Making the source or purchaser of the weapon liable for its illegal use is only part of the strategy of gun control and has nothing to do with the intent of the criminal mind. It only fosters fear and mistrust of all citizens and furthers their cause.

What, therefore, is their reaction when cop-thugs shoot, with intent to kill, innocent unarmed people?

    • Why would any Cop shoot an “innocent, unarmed person”? That gains the Cop absolutely NOTHING good. If you look closer, beyond the Media’s headlines, you’ll see that the ONLY time this happens is in the form of an accident,a mistake. It’s the MEDIA that wants to “make” it a premeditated, intentional killing, through their means of reporting via stating speculation as fact. These INNOCENT people you mention, the ones who really ARE innocent, do what the Cop says to do,they don’t talk back, make hand gestures and point toy guns acting like they’re shooting. THAT behavior isn’t innocent,it’s STUPID,and THOSE are your innocent unarmed people. They get what they earn for looking tough for their homies.

  3. Don’t call cops thugs, rather call violent felons and their lying slut girlfriends thugs.
She ought to be locked up, she’s an accessory to that crime.and broke lots of laws before the shooting even occurred.

    • Cops are hired thugs. The gov is the biggest form of organized crime. Cops weather they believe so or not are hired thugs to do the suit and tie wearing capos in DC dirty work. Enforcing laws they don’t abide by.. If Obama declared martial law whos going to be on the front line taking folks guns away. That’s rt the gustapo (police officers).

I am sure it was the understanding, and the intent of the founding fathers, that any one committing a crime harsh enough to be deprived of their civil rights ( of which the second amendment is included) would not spend another day enjoying his membership in a free society any how.
That is why they saw fit to include the “Bill Of Attainder” clause within our ruling document. Only life in prison or the hangman’s noose was to separate one from his civil rights.
I believe the blame for these kind of instances should more properly be blamed on the leniency of courts allowing the truly violent and murderous back out on our streets, and the government depriving free citizens of their right to be armed at any time and place for the protection of themselves and society in general.

  4. Really?

  5. In this instance, since the woman lied about who the gun was being purchased for, I would judge her to be accessory to the murder of this police officer. As a deterrent to other people who may wish to purchase arms for felons–she should have been slapped with the $250,000 fine and 10 years in jail. The judge in this case is an idiot–and should be removed from his/her position. If this particular offense only garners such a light sentence–it sends no message to the community. It also sends the message to our police officers’ that their lives mean very little in the grand scheme of things. What happens when we no longer have individuals willing to step up to fill the positions of “law officers.” I daresay it will be every dog for himself!
DCG, you have brought a very important post to our attention–thank you, excellent job!

    • Thanks! And I concur with you. This woman should be in jail.

requiring to submit to an inquisition before exercising ones right is a violation of our Constitution. If one has ever been convicted of a crime harsh enough to be denied his/her civil rights, it should be harsh enough for life in prison or the death penalty.
Where a gun comes from is not a crime (unless it is stolen property). It is only ones actions with a firearm that can be criminal. Our government has never had the authority to make the simple acquisition or possession of a firearm a crime.

  6. All forms filled out in order to buy a firearm are filled out under ,..’Penalty of Perjury’,. which means that any false statement amounts to the crime of PERJURY,..& perjury is punishable by 7 years in prison.
So by that fact alone this chick should be looking at 7 years in the slammer, even (IF) the gun had not been used in a crime,
And she should be charged as an accomplice ,BEFORE the FACT to the murder of a police officer, So, properly, she should never see the light of day again,…
