NY demorats push for social media review as part of firearm background check

From New York City Patch: Two Brooklyn politicians want cops to examine New Yorkers’ online activity to prevent more hate-fueled tragedies like the Pittsburgh synagogue massacre. State Sen. Kevin Parker and Brooklyn Borough President Eric Adams proposed legislation Friday that would incorporate social media accounts into background checks for gun buyers.

They argue doing so would help law enforcement authorities spot dangerous people like Robert Bowers, who reportedly declared his hatred for Jewish people online before allegedly killing 11 people last Saturday.

“You would have thought this person was a model citizen until you examined his social media profile,” said Adams, a Democrat. “And you would have noticed he was not a model citizen, he was a broken citizen that was a time bomb that was waiting to explode.”

The pair of bills would empower the New York State Police and local departments like the NYPD to check three years of Facebook, Twitter, Instagram and Snapchat activity for anyone applying for a gun license in New York, Parker said.

Authorities would flag anything that is an “immediate threat to public safety,” he said. Gun buyers would also have to let police comb through a year’s worth of their search engine histories under the legislation.

The state’s SAFE Act — known as one of the nation’s toughest gun laws — requires instant federal background checks for all gun sales except those between immediate family members. But lawmakers have to do more in the wake of recent hate crimes such as the Pittsburgh shooting, Parker said.

“We certainly want to make sure that we’re adding to the protections that we need to make sure that people that we’re putting handguns and rifles and shotguns in the possession, that they in fact are the people that are using them in the right way,” Parker said.

The syngagogue massacre, in which 11 people died, came just a day after federal authorities arrested Cesar Sayoc, the Florida man accused of mailing bombs to high-profile Democratic figures. Sayoc had searched for his targets’ addresses online, federal prosecutors allege.

Lawmakers are still working out exactly how law-enforcement officials would go about accessing social media profiles that are not publicly viewable, Parker said, though he noted the legislation would require gun buyers to make their profiles available.

“We’re going look at what’s in the universe already and use that as one of the tools to determine the profile of a person who’s attempting to purchase a handgun,” Adams said.

The legislation also would not cover more obscure social media sites such as Gab, on which Bowers reportedly signaled that he was going to carry out violence. But Parker said officials wanted to go after the “low-hanging fruit.”

“How much is it going to cost in human lives if we don’t start checking people’s social media and trying to get a good sense of their understanding?” Parker said.

  1. Any such legislation would be unconstitutional, and, frankly, of little value. Yes, Bowers declared his hatred openly. (And Gab was the first platform to report him to the police and FBI). But Bowers was likely a stooge or patsy of some sort; Profiling would not expose someone who does not overtly state their intentions. Besides, a profile, in and of itself, does not constitute probable cause.
And then come the difficulties in differing political opinions, and who, exactly, is doing the profiling.

Did the NYPD look at my Facebook or Twitter page? If they did, they didn’t find anything. Did they Google my name, or look me up on any other database? Again, they would not have found anything for their aims. (Although I am in their database now, and even if and when I am found not guilty, my information shall remain there.)

The Looney Left has but one aim, and that is to eliminate freedom. Guns and firearms represent freedom. They are nothing but tools, and their moral value is but a reflection of the intent of the user. Can’t get around that. Ditto cars, another thing they want to ban, because Cars are freedom. Ultimately, what the Left really wants is the near-extinction of the human race. That is because they are stupid pawns of the elites. And it is because they are INSANE.

  2. The Democrat Party are no longer just for big government. Now unmasked, they really are for totalitarian government.

  3. New York…. Everyone around Andrew Cuomo is under investigation or has been convicted of felonies… 2 of the 3 that foisted NY-SAFE upon us have been sentenced to Federal Prison but have yet to serve a single day…. Sheldon Silver was sentenced to 7 yrs while Dean Skelos got 4 yrs 3 mos…. However Andrew Cuomo is riding on a white horse through this manure pile without a single turd sticking to him….

    • The Good Lord knows what I think of Andrew Blowmo. I feel your pain as a fellow traveler in the People’s Socialist Republic of New York.

  4. Well, they forced my hand: It’s gotten to the point where I’d only purchase a “black market” firearm and never register it. Ammo, too. Not that I have, of course (I’m a law-abiding citizen, after all). But I WOULD.

    • Right there with you on that when the government tells me I can not protect my family then either I move or do it anyway. God gave me the right to do it and the government don’t have the right to take it away God trumps them.

Still all part of the dis arm the populace so we can control them and for the ones who don’t it will be a fight.

And Doc I tried to subscribe but it will not take my email address for some reason.

    • Recynd77,
You don’t have to go the illegal route of a blackmarket weapon. It is perfectly legal to assemble your own gun at home, using readily available parts, that can be shipped to your home.
The thing that the government makes the manufacturers put a serial number on is the frame of the gun. And you can buy a frame that is only 80% finished, and using the enclosed jig, and often the drills as well, drill and sand it the rest of the way. Then go to one of the several places that sell gun parts, and buy the rest of them and they will ship those parts directly to your home.
That is why there was such an uproar about the 3D printed guns. Because you didn’t have to print the entire gun, but only the frame, and you could then order everything else. But there is absolutely no law against making your own gun in your own home. The only part that would be illegal is if you sell it without a serial number.
The AR 15 is probably the most popular gun that you can buy an 80% lower, but they now have the Glock frame available as well. So you need only buy one of those frames, which the BATFE doesn’t consider to be a gun, since it is not finished anymore than 80%, and it can ship to your house. Finish the frame, order the rest of the parts for the gun, and put it together pretty much like an erector set, from our youth.
And then you have a gun that is completely off the books of any governmental body, and completely legal.
You can build an AR 15 for around 300-350$ doing it this way. Usually, people doing this are trying to control the quality of parts going into their gun, and so will only buy top end parts to finish the gun. And of course, the sky is the limit as far as how much you want to spend.
This doesn’t change the rules regarding a felon in possession of a gun, and of course, states change their laws so often and in some states, in such convoluted ways, that I urge you to do your own due diligence as far as the laws in your state. I am not a lawyer, so please, please, don’t just take my word for this topic. I am pretty sure that I am right, but the difference between right and wrong in thing that can cause the involvement of the BATFE, is a long prison hall away.
And social media being accessed by the government won’t just look at your profile, but depending on the wishes of those in power, they will look at every word you have ever written or picture you have posted.
If the option to be a power grab is on the table, rest assured that the government will eventually grab that power.

  5. I won’t shed a tear for the marshmallow soft useless idiot masses that will eventually elect a socialist moron like Bernie or Cortez.
At least the glorious equality will be achieved as we all stand around beat up 55 gallon drums roasting rat kebabs while wearing sandals made from old tires. Forward!

  6. I wonder what they’ll do for those who don’t partake in social media, like me – unless you count posts (here, or Disqus).
