Beinvenidos a California: Lawmakers agree to health benefits for illegal aliens

From SF Gate: California will become the first state to pay for some adults living in the country illegally to have full health benefits as the solidly liberal bastion continues to resist the policies of Republican President Donald Trump’s administration.

Democrats in the state Legislature reached an agreement Sunday afternoon as part of a broader plan to spend $213 billion of state and federal tax money over the next year. The legislature is expected to approve the deal this week. The agreement means low-income adults between the ages of 19 and 25 living in California illegally would be eligible for California’s Medicaid program, the joint state and federal health insurance program for the poor and disabled.

Only those in that age group whose incomes are low enough to qualify for the program would get the health benefits. State officials estimate that group will be about 90,000 people at a cost of $98 million per year. The state Senate had wanted to expand the proposal to include adults 65 and older, but the Newsom administration argued it would cost too much.

“California believes that health is a fundamental right,” said state Sen. Holly Mitchell, a Los Angeles Democrat who led the budget negotiations.

The move is part of a larger effort to make sure everyone in California has health insurance. The proposal also makes California the first state in the country to help middle-income families pay their monthly health insurance premiums. It means a family of four earning as much as six times the federal poverty level — or more than $150,000 a year — would be eligible to get about $100 a month from the government to help pay their monthly health insurance premiums.

But to pay for part of it, the state will begin taxing people who don’t have health insurance. It’s a revival of the individual mandate penalty that had been law nationwide under former President Barack Obama’s health care law until Republicans in Congress eliminated it as part of the 2017 overhaul to the tax code.

Republicans on the legislative committee negotiating the budget voted against the proposal, arguing it was not fair to give health benefits to people who are in the country illegally while taxing people who are here legally for not purchasing health insurance.

The budget agreement still must be approved by the full state Legislature. State law requires lawmakers to enact a budget by midnight on June 15. If they don’t, lawmakers would lose their pay.

The health care proposals are a win for first-term Democratic Gov. Gavin Newsom, who proposed both of them. Several lawmakers in the Democratic-dominated state legislature wanted to go further by offering health coverage to all adults living in California illegally. But Newsom opposed that, noting it would cost $3.4 billion.

Questions asked about triple-amputee veteran Brian Kolfage’s GoFundMe border-wall donations

Brian Kolfage is a triple-amputee Iraq War veteran and Purple Heart recipient who created a GoFundMe last December 16, asking for donations toward construction of a US-Mexico border wall that has stymied President Trump because of Congress’ refusal to fund the wall.

Kolfage promised that “100% of your donations will go to the Trump Wall” and that “If we don’t reach our goal or come significantly close we will refund every single penny.”

Kolfage’s goal is $1 billion. As of this morning, $22,229,287 have been donated by 261,937 people, which comes to an average of $84.87 per donor. If the most recent 10 donations are an indication, most donations are small, made by ordinary Americans, not the super-wealthy:

All of which makes it even more imperative that Kolfage’s GoFundMe drive is a creditable undertaking.

Clash Daily is an authentic conservative website founded by Doug Giles, who is a conservative Christian patriot.

Given the conservative credentials of Clash Daily, we should take note that it is raising questions about Kolfage’s donation drive.

Wes Walker reports for Clash Daily, May 14, 2019, that Brian Kolfage is “now being accused of being a scam artist, using donations meant for his multi-million-dollar Build The Wall project to fund a jet-set lifestyle” and a $600K boat that Kolfage maintains was purchased prior to the GoFundMe campaign and paid for “by other means”.

Walker quotes a May 13, 2019 Daily Mail article:

But the Florida resident [Kolfage] is now facing repeated questions about the progress of the wall and attention has also turned to a $600,000 boat he says he bought a year before he began the GoFundMe appeal.

A source told The Stern Facts that Kolfage is now living a high-flying lifestyle, saying: ‘Whether he ordered it last year with the year before is irrelevant it’s still nearly a million dollar boat. Those new toys are very expensive as is flying private.’

He has previously posted image of his travels on private jets and with pricey cars. In February he posed, along with his wife, in front of a plane saying ‘it looks like our first piece of land for @webuildthewall is a go!’ The couple are understood to have flown with the Veterans Airlift Command.

But after a seemingly lack of progress and a reported 300,000 individual donations one supporter asked: ‘I am very disappointed in you Brian Kolfage, where are the progress photographs?’

Another added: ‘Quit talking about it and do it.’ On Twitter another asked: ‘Why no updates on the status of the wall? I have a feeling this is a scam.’

In an apparent attempt to alleviate donor’s concerns the We Build The Wall Inc posted a video to Facebook on Monday appearing to show steel bollards being cut in the factory.

They wrote: ‘Just when we thought that the fake news media couldn’t get more ridiculously desperate, they’re now proving how low they’ll go by claiming that ‘We Build The Wall’ founder, Brian Kolfage, bought a yacht with the GoFundMe money.

‘It takes simple skills to see that the boat he bought and posted photos on Instagram was purchased a YEAR before he began the GoFundMe.’

It’s not clear how this private effort would interact with any federal plans sought by Trump to build a wall with government funds in many of the same areas, or with local building regulations.

On his personal Facebook page Brian, who has been accused of misusing funds he raised in the past, said: ‘There’s no update because we are remaining silent for a very good reason.

‘You all will have the best present very soon. Remember powerful people want to stop our progress, so to not tip anyone off we are radio silent! The ACLU would file a lawsuit to impede our wall success if they knew where and when.

‘But when I guaranteed we’d build the wall I meant it, and we are working with many congressmen and senators to help us mitigate these issues from the left wing attack groups! We are in the homestretch and it’s on a need to know basis.’

Walker points out that the private jet and $600K boat are not the only “red flags”, and that “several Right-of-Center news providers have complained about his ‘news’ site being guilty of straight-up copy-and-past plagiarism, passing off unattributed columns written by other people as though they were his own…. Not exactly the sort of behavior one would call worthy of someone wearing the badge of ‘hero’.”

However, the one example named by Walker is John Prager who, according to tucson.com, has written about Kolfage on the blog Americans Against the Tea Party (AATTP), accusing Kolfage of plagiarizing news stories and posting them on his own websites without attribution. But Americans Against the Tea Party, as its name says, can hardly be considered “Right-of-Center”. Efforts to access the website http://aattp.org/ bring you to a blank page with this cryptic message:

For his part, as reported by tucson.com, Brian Kolfage, in June 2014, filed a defamation lawsuit in Arizona’s Maricopa County Superior Court against “seven defendants in various states who he claims libeled him in Facebook postings accusing him of plagiarism and claiming he’s racist, homophobic and a drug abuser.” John Prager is one of the defendants named in the lawsuit.

According to Daily Mail, another red flag is a claim by Buzzfeed News, which itself is a dubious news site, that the three military hospitals with which Kolfage said his program had worked — Walter Reed, Brooke Army Medical Center, and Landstuhl Regional Medical Center in Germany — told Buzzfeed they have no record of Kolfage working with them.

For his part, Kolfage says that BuzzFeed “100 percent lied”.

The May 13, 2019 Daily Mail article says Kolfage “lives with his family in the resort community of Sandestin, in Florida’s Panhandle”. Sandestin is a golf and beach resort in Miramar Beach, FL.

In December 2018 when I first wrote about Brian Kolfage, I had noted that his GoFundMe page identified him as being in Miramar, FL, but the address to send check donations is a UPS store in a strip mall in Castle Rock, CO.

But according to Spokeo, there is no Brian Kolfage in all of U.S.A.; and according to TruthFinder, there is no Brian Kolfage in Miramar, Florida, or anywhere in Florida, nor is there a Brian Kolfage in Castle Rock, CO, or anywhere in Colorado. TruthFinder, however, does have two Brian Kolfages:

  1. Brian Gregory Kolfage, 65, born in 1953; lives in and owns a modest home in Dearborn Heights, Michigan; has a small business in Dearborn Heights called Professional Home Care — a medical apparatus and supplies business, with an annual revenue of $1,343,193 and a staff of approximately 10. (Manta)
  2. Brian G. Kolfage, 37, born in 1981; lives in Farmington Hills, Michigan, and has lived in Dearborn Heights, MI (in 2000); Miramar Beach, FL; Mulberry, FL; San Angelo, TX; Tucson, AZ; and Honolulu, HI. His business and employment history are listed as the same as 65-year-old Brian Gregory Kolfage (his father?) — Professional Home Care in Dearborn Heights.

This 37-year-old Brian G. Kolfage is likely the GoFundMe Brian Kolfage. Why he gives two addresses on GoFundMe (Miramar, FL and Castle Rock, CO), neither of which is his actual residence in Dearborn Heights, MI, is a mystery.

Walker concludes:

It shouldn’t be all that hard to someone in authority to sort out fact from fiction.

After all, how hard should it be for him [Kolfage] to present some receipts, and demonstrate conversation between himself or his designate and the related suppliers or foremen for a project of this scale?

If everything checks out and his project is going forward with the money accounted for? Great.

But if they discover that the patriotism and fear of good people have been leveraged for personal gain, his military service offers him no shield against becoming crooked when he rejoins civilian life.

In that case, Purple Heart or no, throw the book at him.

Congressman Clay Higgins confronts bishop on Catholic Church’s hypocrisy on border wall

The dictionary defines “hypocrisy” as “a situation in which someone pretends to believe something . . . that is the opposite of what they do”.

On April 27, 2019, we are told that Pope Francis donated half a million dollars from the Peter’s Pence fund, the source of which are donations by lay Catholics, to assist migrant invaders determined to enter the United States but find themselves “stranded” in Mexico because “the US border remains closed to them.”

Although the Vatican itself is protected by 40 ft. tall walls, Pope Francis tells the U.S. we must take in “migrants”. He even went so far as to say the wellbeing of migrants and refugees supercedes a country’s national security.

Anna Giaritelli reports for the Washington Examiner that yesterday, April 30, 2019, during a House subcommittee hearing, Rep. Clay Higgins (R-La) deftly exposed the Pope’s and the Catholic Church’s hypocrisy on unbridled immigration and border wall.

Higgins is a ranking member of the House Homeland Security Subcommittee on Border Security, Facilitation, and Operations.

Rep. Higgins asked Bishop Mark Seitz, the U.S. Conference of Catholic Bishops representative for the Catholic Diocese in El Paso, Texas, about the Roman Catholic Church’s wall around its Vatican headquarters in light of Pope Francis’ recently voiced opposition to additional physical barriers on the United States’ southern border:

“Regarding the sovereignty of the church and as it relates and compares with the sovereignty of our nation, the church has been a light for the world for 2,000 years — a place of refuge, a place where a child of God could seek spiritual prosperity. But the sovereignty of the church has been protected by the security of the church. One of the most famous walls in history is the wall around the Vatican. I would ask you, bishop, in the area that your serve, do your churches lock their doors after hours?

Bishop Seitz replied: “Many of them. I would point out that that wall you refer to at the Vatican also has arms embracing and opening to the world, if you’ve been to the … ”

Higgins interjected: “As we do. We have 328 ports of entry — legal entry — into the United States of America.”

Seitz appeared before the committee to share how local nongovernmental organizations were handling the release of as many as hundreds of migrants in southern border cities daily. Catholic charitable groups have been at the forefront of outside groups trying to help house those people and care for them in the hours and days after being released from federal custody.

Higgins asked what the Catholic Church was doing in the Central American countries, where nearly 70% of people identify as Catholic and the Church has an influential position because of that.

Seitz said his counterparts in Central America are “working very hard to dissuade people from leaving their homes.” Higgins pushed for details on how.

Seitz said: “There is an active engagement, but the problem is the governments are so weak and so corrupt that there is no authority on the governmental level that people can go to. The Church is about the only one.”

Illegal alien charged with rape and murder was deported twice before: ICE

How many more women have to die at the hands of illegal alien scum before the left gets its act together and supports enforcing our immigration laws? The latest victim was Carolina Cano, 45, of Jersey City, NJ, whose body was found in a public park lake near a New Jersey casino. The murder suspect is a 33 year old man who worked at a company that cleaned commercial property. According to ICE officials, the suspect had been deported twice prior to his arrest. ICE officials said he was in this country illegally. From The Jersey Journal, April 5:

The man charged with raping and strangling a jogger in Jersey City’s Lincoln Park had already been deported twice, Immigration and Customs Enforcement officials said.

Jorge Rios, who was identified by ICE officials as Jorge Alberto Rios-Doblado, is from Honduras and “has been removed from the country on two prior occasions, in 2003 and 2004,” according to ICE’s Enforcement and Removal Operation (ICE-ERO) in Newark. ICE officials also said Rios initially entered the country illegally.

ICE-ERO said that it has placed a detainer on Rios following his arrest on Sunday on charges the 33-year-old kidnapped, raped and murdered Carolina Cano, 45, of Gautier Avenue in Jersey City, on March 24. The nanny’s body was found in the lake near the Casino in the Park building that day.

The ICE-ERO spokesman said “ICE maintains that cooperation by local law enforcement is an indispensable component of promoting public safety. ICE will seek taking custody of Rios at the conclusion of his criminal proceedings, despite limited cooperation in the state.”

If Rios is convicted of the charges against him, he will have to serve his prison term first before a possible third deportation. The charge of murder carries a possible sentence of 30 years to life in prison upon conviction.

Rios, formerly of Belmont Avenue in Jersey City, was arrested in a Jersey City restaurant on Sunday and is being housed at the Hudson County jail in Kearny. The state has filed a motion to detain him through the course of his prosecution.

Following Cano’s death, Jersey City Police Department Emergency Services Unit divers have returned to the lake at least twice to scour it for further evidence. Divers were most recently in the water on Monday.

Rios was spotted on surveillance video in the area the woman’s body was found around the time police believe she was murdered, a law enforcement source said.

Cano is from Peru and worked as a nanny. A resident of the building where she lived off West Side Avenue said she had been in the United States for about two years. Jersey City Mayor Steve Fulop has said that it appears Cano and Rios were strangers.

Rios was at the Belmont Avenue building to visit residents of his former first floor apartment on the weekend Cano was raped and killed, one resident of the building said. Little is known about Rios, who authorities said Wednesday works at Jersey City company that cleans stores.

A spokesman for ICE-ERO would say only that Rios was previously removed from the United States due to immigration violations. At a meeting with residents Tuesday night, Hudson County Prosecutor Esther Suarez said Rios has no previous criminal record.

Another American permanently separated from her family by illegal alien in car crash

From WKRGThe Mobile County District Attorney’s office says an illegal immigrant who is (was) days away from his 17th birthday is responsible for a crash that killed a woman on US 98 Monday.

Prosecutors say Domingo Francisco Marcos hit Sonya Jones head-on, killing her then tried to run off. He was injured too badly to run and collapsed. He was then taken to USA Women’s and Children’s Hospital for surgery.

Marcos was released in 2017 when he claimed asylum. That was in Arizona where officials were trying to deport him back to Guatemala. He never showed up in court on the asylum claim so it was denied. But, he disappeared and was never deported.

He’s charged with homicide by vehicle and leaving the scene of an accident with injuries.

Prosecutors plan on asking the judge not to grant him bond.

Lower Alabama Congressman and Senate candidate Bradley Byrne issued the following statement in response to the arrest:

“Yet again we have someone who is in our country illegally taking the life of an American citizen. How many more Americans have to die before we take action to crack down on illegal immigration, secure the border, and keep the American people safe? Enough is enough!”

Kittitas deputy killed by illegal alien in sanctuary Washington state

The deputy is permanently separated from his wife, three children and family and friends.

Washington state governor Jay Inslee made Washington state a sanctuary haven for illegal aliens in 2017.

As reported by MyNorthwest.com: A deputy with the Kittitas County Sheriff’s Office was killed in the line of duty Tuesday evening in the City of Kittitas. Immigration and Customs Enforcement confirmed Thursday that the suspect — Juan Manual Flores Del Toro — was in the U.S. illegally, and had entered the country through a port of entry in Laredo, Texas.

Deputies were called to a report of a road rage incident in the Badger Pocket area of Kittitas County. Deputies tried to stop the vehicle involved at about 7:45 p.m., but the driver failed to stop. Deputies chased the suspect into the City of Kittitas.

Investigators said when the vehicle stopped, the suspect got out and exchanged gunfire with a Kittitas County sheriff’s deputy and a Kittitas police officer.

The deputy was shot and died from injuries at Kittitas Valley Hospital. Deputy Ryan Thompson was 42. Thompson was born and raised in Walla Walla and was a reserve deputy who worked in corrections and with the sheriff’s office close to 15 years.

The Kittitas officer was also shot and was airlifted to Harborview Medical Center, where he was in satisfactory condition as of Wednesday morning. Officer Benito Chavez, 22, was sworn into office in July. He is married and his wife is expecting their first child. The police force in the small town consists of three officers.

Chavez was undergoing surgery for a shattered femur Wednesday, authorities said at a Wednesday morning news conference.

The suspect was also shot and was taken to Kittitas Valley Hospital. Ellensburg police told KIRO 7 the suspect later died.

Animals: MS-13 members stab 16-year-old 100 times for wanting out

Supposedly calling people “animals” is not a good thing. In this case, “animals” is too kind of a word.

From NY Post: Five MS-13 members stabbed a 16-year-old fellow gangbanger 100 times because he wanted out of his crew — and then drove his corpse to Virginia, where they torched it, the victim’s mother said.

Maryland cops identified the victim, Jacson Pineda-Chicas, after releasing a photo of a tattoo on his left arm, Fox News reported.

The teen’s mom told NBC4 in Washington that she and her son fled El Salvador after he was strong-armed to join MS-13 there.

When her son’s sadistic gang pals accused him of talking to cops, and threatened to kill his family, he offered himself up, the mom told the outlet.

“He had to take knives to defend himself, and screwdrivers,” she told the station. “He had razors and he told me, ‘Mom, I’m going to defend myself with them, but it’s not going to be enough.”

Police in Prince George’s County said Pineda-Chicas was killed in a home 60 miles away in Landover Hills, Md., that belonged to Jose Ordonez-Zometa, 29, the head of a Virginia branch of the MS-13, Fox News reported.

The teen’s body was dumped on the side of the road in Stafford, Va., March 9, cops said.

Ordonez-Zometa is also charged with participating in the vicious slaying. Police said the other suspects were Jonathan Castillo-Rivera, 20; Kevin Rodriguez-Flores, 18; Christian Martinez-Ramirez, 16, and Jose Hernandez-Garcia, 25, the report said.

“To hear somebody was stabbed 100 times … pretty much speaks for itself how violent the attack would have been,” Maj. Brian Reilly said at a Friday news conference.

12 Republican senators voted against Trump’s national emergency to build border wall

Bridget Bowman reports for Roll Call that yesterday, 12 Republican senators joined every Demonrat senator in voting for a resolution to block President Trump invoking a national emergency at the southern border so as to build the wall with defense funds. Trump had declared a national emergency last month after the Democrat-dominant House refused to appropriate his requested $5+ billion funds for a border wall.

The resolution passed the Senate, 59-41, after passing the House late last month.

The Gang of 12 Republicans includes so-called “moderate” senators — one of whom is up for re-election in 2020 — and so-called “conservatives”. 6 of the 12 serve on the Senate Appropriations Committee.

Here are the 12 Republican senators who voted to thwart President Trump’s national emergency declaration:

(1) Sen. Lamar Alexander of Tennessee: A 3-term senator and member of the Appropriations Committee said in a statement yesterday ahead of the vote that although he supports the president on border security, the emergency declaration sets a dangerous precedent: “His declaration to take an additional $3.6 billion that Congress has appropriated for military hospitals, barracks and schools is inconsistent with the U.S. Constitution that I swore an oath to support and defend.” Alexander announced last December that he would not run for re-election in 2020.

(2) Sen. Roy Blunt of Missouri: A senior member of the Appropriations Committee, Blunt is concerned about the precedent Trump’s declaration of emergency would set. Blunt was re-elected to a second Senate term in 2016. (He served several terms in the House before running for Senate in 2010.)

(3) Sen. Susan Collins of Maine: Not only is this POS pro-late term abortions, Collins actually co-sponsored the resolution ostensiblyout of concern for the precedent an emergency declaration would set for the powers of the executive branch. The four-term senator is likely to face her toughest re-election next year, with Democrats raising millions of dollars for a yet-to-be-determined challenger after she voted for Supreme Court Justice Brett M. Kavanaugh.

(4) Sen. Mike Lee of Utah: First elected in 2010, Lee announced his support for the resolution Wednesday after Trump rejected Lee’s offer of a compromise to curtail future national emergency declarations through an amendment of the National Emergencies Act to include the automatic termination of future emergencies after 30 days unless Congress authorizes the emergency to continue. Lee said in a statement announcing his decision that “For decades, Congress has been giving far too much legislative power to the executive branch.”  One of the most conservative senators, Lee is up for re-election in 2022.

(5) Sen. Jerry Moran of Kansas: A member of the Senate Appropriations Committee, Moran tweeted that “I share President Trump’s goal of securing our borders, but expanding the powers of the presidency beyond its constitutional limits is something I cannot support.” Moran is up for a third term in 2022.

(6) Sen. Lisa Murkowski of Alaska: Another pro-abort POS, Murkowski said in a floor speech earlier this month: “Congress is a co-equal branch of government and as such Congress should stand up for itself.” She is not up for re-election until 2022.

(7) Sen. Rand Paul of Kentucky: Earlier this month, Paul announced at a GOP Lincoln Day dinner that he would support the resolution because Congress did not appropriate the funds Trump was looking to use for the border wall, and “If we take away those checks and balances, it’s a dangerous thing.” A self-described libertarian, Paul was re-elected to the Senate in 2016 after a failed White House bid, and he will not face voters again until 2022.

(8) Sen. Rob Portman of Ohio: Portman had worked with Mike Lee on the compromise resolution. The two-term senator said that while he supported Trump’s request for border wall funding, an emergency declaration is not necessary to secure those funds, and that the declaration would set a “dangerous precedent” by opening “the door for future presidents to implement just about any policy they want.” Portman won re-election by more than 20 points in 2016 and won’t face voters again until 2022.

(9) Sen. Mitt Romney of Utah: Although Romney is a freshman senator, he entered the Senate with a high profile as his party’s 2012 presidential nominee and the former governor of Massachusetts. Critical of Trump in the past, even before Trump officially declared a national emergency, Romney said he “would also expect the president stay within statutory and constitutional limits.” Romney won the open Utah Senate race in 2018 by 32 points, and he is not up for re-election again until 2024.

(10) Sen. Marco Rubio of Florida: Like the others, Rubio too warned of the precedent set by Trump’s national emergency. A member of Senate Appropriations, he said in February that while he agrees there is a crisis at the southern border, “a future president may use this exact same tactic to impose the Green New Deal.” Rubio won re-election by 8 points in 2016 after an unsuccessful run for the GOP nomination for president. Trump carried Florida by just 1 point in 2016.

(11) Sen. Patrick J. Toomey of Pennsylvania: A “conservative” Republican, Toomey had occasionally broken with President Trump in the past, particularly on Trump’s use of tariffs. Toomey told the Philadelphia Inquirer that he supports Trump’s effort to build a border wall, but the declaration of a national emergency was “a very important separation of powers issue.” Toomey narrowly won re-election in 2016 when Trump won Pennsylvania by less than a point.

(12) Sen. Roger Wicker of Mississippi: The two-term senator, who’s the chairman of the Commerce Committee and the second-highest-ranked Republican on the Armed Services Committee, also had “serious reservations” about what an emergency declaration would do to the separation of powers. Wicker said in a statement earlier this week: “The precedent we set this year might empower a future liberal President to declare emergencies to enact gun control or to address ‘climate emergencies,’ or even to tear down the wall we are building today.” Wicker, an Air Force veteran, won re-election comfortably last fall in a state Trump carried by nearly 20 points in 2016.

Today, President Trump used his veto powers for the first time to overturn the Congressional resolution, calling it “reckless”. He said: “Today I am vetoing this resolution. Congress has the freedom to pass this resolution and I have the duty to veto it.” To override his veto would require two-thirds of the vote in both the House and the Senate, and the Senate doesn’t have the 67 votes needed for an override. For all the Gang of 12’s concerns about the separation of powers and Trump setting a “dangerous precedent” by declaring a state of national emergency, one would think such declarations are rarely invoked.

Not so.

The fact of the matter is there have been 58 national emergencies declared by presidents since 1979 under the National Emergencies Act of 1975, 31 of which are still active national emergencies. Below are the number of national emergencies declared by President Carter and after:

  • Jimmy Carter: 2 — one of which is still active.
  • Ronald Reagan: 6 — none of which is active.
  • George H.W. Bush: 5 — none of which is active.
  • Bill Clinton: 17 — 6 of which are still in effect.
  • Barack Obama: 13 — 11 of which are still active.

Illegal Alien Charged with Murder Had Been Arrested and Released Nine Times

Here is  yet another reason to build the wall, close our southern border, and strictly enforce existing immigration law.

A homeless man arrested on Monday, March 11, for stabbing a San Jose woman to death last month was an illegal alien who had been ordered detained by federal authorities nine times, officials said Tuesday. But the man, who had multiple convictions for misdemeanor and felony offenses, was released from the Santa Clara County California jail twice in the months before the killing.

On Tuesday, San Jose Mayor Sam Liccardo issued a sharply-worded criticism of the county’s policy of not honoring federal immigration detention orders at the jail. Liccardo said the policy “undermines public safety, and violates common sense.”

San Jose Police Chief Eddie Garcia joined with Liccardo and Santa Clara County Sheriff Laurie Smith in criticizing the policy Tuesday. At a press conference, Garcia said he was well aware of the ways in which the case probably would be politicized amid a heated national debate over immigration and local “sanctuary” policies meant to protect undocumented residents from federal authorities.

But, Garcia said, there was a distinction between protecting and embracing “otherwise law-abiding undocumented residents” and policies that he said “shield admitted gangsters or violent criminals.”

“When we have violent or serious offenders that are preying on our community, we must have the ability to protect our residents,” Garcia said.

Police arrested 24-year-old Carlos Eduardo Arevalo-Carranza on Monday in the death of 59-year-old Bambi Larson, who was found dead in her home on Knollfield Way on the afternoon of Feb. 28.

Arevalo-Carranza, a native of El Salvador, had been living in the country illegally, and was the subject of at least nine “detainers” from U.S. Immigrations and Customs Enforcement since 2016, according to Erik Bonnar, the agency’s acting field director the agency’s San Francisco field office.

Under those detainers, local law enforcement agencies hold immigrants for up to two days until ICE agents can take custody of them. Santa Clara County has not honored them since 2011.

Garcia said Arevalo-Carranza had been arrested several times in Santa Clara County in recent years for a string of charges, most recently when he was arrested in January on charges of possession of methamphetamine and paraphernalia. He had also been arrested in October. But Garcia said Arevalo-Carranza was never turned over to ICE because of the county’s policy of ignoring federal detention orders.

Bonnar leaped to criticize the county in a statement Tuesday, writing that it “allowed Arevalo-Carranza back on the streets to reoffend.”

“These sanctuary policies have unintended, but very real, and often tragic consequences to public safety,” Bonnar said.

Liccardo said he would like the county to honor ICE detention orders for “prior first-degree home burglaries and other ‘strike’ offenses.” Garcia did not describe specific changes he would like to see to the policies, but said he believes local law enforcement should be involved in the conversations.

Smith, who as sheriff runs the Santa Clara County Jail, said Arevalo-Carranza should have been held for federal officials.

“It has been my long-standing position that all undocumented immigrants who are a serious or violent felon, should be held for ICE evaluations,” Smith said.

Authorities have not been able to determine any connection between Arevalo-Carranza and Larson, Garcia said, though they believe he “stalked” the quiet South San Jose neighborhood where the crime occurred.

Larson’s son had gone to check on his mother on the afternoon of Feb. 28 after he said coworkers told him she had not shown up to work that day. He found her covered in blood in her apartment.
