California’s ammo background checks off to a rocky start

From AP: California’s new ammunition background check law began Monday not with a bang but with a whimper from dealers who reported delays and glitches with the state’s online system.

But they said few customers were affected because most had stockpiled bullets or shotgun shells in the weeks before the new law took effect.

Voters in 2016 approved requiring criminal background checks for every ammunition purchase. But the state’s latest attempt to deter gun violence only took effect Monday.

Vendors the length of California were frustrated by online snags including their inability to readily log in to the new system that is supposed to let them background-check customers with the state, though some put it down to a predicable learning curve.

Chuck Michel, an attorney for the National Rifle Association and the affiliated California Rifle & Pistol Association, said he will soon cite the glitches in seeking an injunction to block the law. The California affiliate sued last year, maintaining that the new law violates the Second Amendment right to bear arms, impedes interstate commerce and is pre-empted by federal law.

“I’ve had one customer, and I had to turn them away because I couldn’t get into the system,” Don Reed, owner of DGS Ammo & Airguns in Sacramento, said at midmorning. “He seemed a little bit perturbed. … There’s a lot of people feel like they’re being held hostage suddenly — punishing the people who’ve been doing it the right way.”

He was reading through dozens of pages online as he tried to log in, but he groused that “it would take a Philadelphia lawyer to figure it out.”

Officials with the state Department of Justice, which administers the program, did not respond to repeated telephone and email requests for comment. The department said in a news release that it had sent vendors regulations and instructions on how to comply.

“The eligibility checks ensure purchasers are not prohibited from owning or possessing ammunition due to a felony and/or violent misdemeanor conviction or warrant, domestic violence restraining order, or mental health issue,” the department said.

The state system is supposed to crosscheck one database of people who already cleared background checks when they bought guns in California with a second database of those who bought guns legally but are no longer allowed to own them. The process should take about two minutes, the department said Monday.

Customers pay $1 for the check. Those who pass get their ammo after clerks record the brand, type and amount of ammunition. “So far it doesn’t work at all. My system doesn’t let me access it,” said Steve Converse, a longtime clerk at Ade’s Gun Shop in Orange, 30 miles southeast of Los Angeles.

Scott Emmett, the manager of the Ammo Bros store in San Diego, said the system was down for the first 45 minutes. “I sat on the phone for about 40 minutes and no one answered” at the Department of Justice, he said after hanging up in frustration.

Emmett had a single customer by midmorning whose transaction took about 10 minutes instead of the couple minutes it would previously have taken to run a credit card. “I can’t believe the amount of paper it wastes,” he said. “This one transaction for two types of ammo was almost eight pages long.”

Andrew Hackett, manager of Nice Shot, an indoor shooting range in Redding, 160 miles north of Sacramento, said he would have to turn away customers because he’d had no guidance on how to log into the state system. Customers are allowed to buy ammunition to shoot at his range — they just can’t take any home without a background check.

One of the clerks at OC Guns in Lake Forest, 45 miles southeast of Los Angeles, bought a box of ammunition just to see if it could be done. “Confusing,” said store owner Scott Bodkin. “Just a learning curve. We’ll get through it.”

Scott Dipman, vice president at Coyote Point Armory in Burlingame, 16 miles south of San Francisco, was frustrated with the online ammunition reporting forms. “I have thousands of items that I’m going to have to manually type into the system,” he said. “There’s a learning curve for us to figure out what that the new procedure is, and unfortunately the state didn’t give us any peek into what was going on.”

You got it! “Illegal alien.”

From AP: Lawsuits allege a Dallas man already charged in the deaths of 12 elderly women also killed six other elderly people, which would bring the victim total to 18.

The six lawsuits filed Tuesday in Dallas County accuse The Tradition-Prestonwood, an independent living facility in Dallas, of failing to keep residents safe and hiding suspicious circumstances surrounding deaths. The lawsuits filed on behalf of family members and advocates of the alleged additional victims say plaintiffs anticipate 46-year-old Billy Chemirmir will soon be indicted in the deaths of the five women and one man.

A Dallas County district attorney’s office spokeswoman did not immediately respond to a request for comment Wednesday. Dallas police had no comment Wednesday. An attorney for Chemirmir did not immediately return a call for comment.

Chemirmir, a Kenyan citizen who was living in the U.S. illegally, has been in custody since March 2018 , when he was arrested in the death of 81-year-old Lu Thi Harris in Dallas. Last month he was charged in the deaths of 11 more elderly women. Authorities have said Chemirmir posed as a maintenance worker or health care provider, and that he stole jewelry and other valuables from his victims.

Two of the people Chemirmir is already charged with killing also lived at The Tradition. The lawsuits say the deaths of those two people and the six alleged additional victims were unexpected, and in most cases valuables were missing from their apartments. The lawsuits say those eight deaths at the independent living facility occurred in a four-month span in 2016.

The lawsuits say one of the alleged additional victims, an 87-year-old woman, told her daughter several times in the weeks before her death that she was uneasy because a lot of otherwise healthy people had unexpectedly died at the facility. The woman, who had gone dancing the night before her death, even mentioned that she should maybe move during a conversation with a friend.

The lawsuits say the woman and her family “did not know everything The Tradition knew, and so she stayed— at the ultimate cost.”

“Unimaginably, at no point in time during the string of murders and robberies does The Tradition share plainly relevant information with the families of the victims, the residents who are still in danger, or the police who were viewing each death through a skewed, incomplete lens due to The Tradition’s failure to disclose,” the lawsuits say.

The Tradition in a statement called the deaths “a true tragedy,” and added that it had relied on the investigations of police and other officials. The facility said “any death” was investigated by police and the Dallas County medical examiner’s office and had been attributed to natural causes. In two cases, it said, autopsies confirmed the people died of natural causes.

The facility said “those rulings stood for more than 27 months.”

The Tradition added that it cooperated with authorities and that its CEO did not withhold information.

The lawsuits also note that at one point before Chemirmir’s arrest on murder charges, he was “merely” escorted off the premises at The Tradition and asked not to come back.

Dave Wishnew, one of the attorneys representing the plaintiffs, said the families want accountability.
“If you are going to promise to provide exceptional, state-of-the-art safety and security to the most vulnerable people in our community — the elderly — then you have to fulfill those promises,” Wishnew said.

This is Chiraq: 45 shot – 4 fatally – during weekend violence

Given the level of violence this city has seen since Mayor Lori Lightfoot assumed office (see here, here and here), Monday’s “Accountability Meeting” should be a blast.

From MyFoxChicago: Citywide gun violence since 5 p.m. Friday left at least four people dead and 41 others hurt.

The weekend’s latest fatal shooting happened Saturday in West Lawn. A witness reported that an 18-year-old man was arguing with a male in an alley about 11:13 p.m. in the 6000 block of South Komensky Avenue, Chicago police said. The male pulled out a gun and fired several rounds before running off. The man was struck multiple times, and taken to Christ Medical Center in Oak Lawn where he later died, police said.

A few hours earlier, a man was shot to death in Gresham on the South Side. Andre Lyons, 32, was on a street about 2:05 p.m. in the 7600 block of South Aberdeen Street when an unknown person unleashed gunfire, police and the Cook County medical examiner’s office said. He was struck in the head and once in the back. He was taken to Christ Medical Center where he died, authorities said. He lived in the same block where he was shot.

Near dawn, a man was found shot to death in East Garfield Park. About 5:33 a.m., residents in the 3200 block of West Huron Street heard gunfire and then found Tavaris Trimble, 26, unresponsive in a gangway, authorities said. The man had three gunshot wounds and officers recovered a weapon near the body, authorities said. He was pronounced dead on the scene.

On Friday, another man was killed in the same neighborhood. Henry Daniels, 52, was shot multiple times in the abdomen, leg and back and was taken to Norwegian American Hospital, where he died, police and the medical examiner’s office said.

The shooting happened about 7:20 p.m. in the 3200 block of West Walnut Street, authorities said.
Area North detectives are conducting a homicide investigation.

In non-fatal gun violence, five people were wounded Saturday on the Near West Side. The group was on the street about 2:32 a.m. in the 2400 block of West Jackson Boulevard when someone unleashed gunfire, police said. They all took themselves to area hospitals.

A 22-year-old woman went to the University of Illinois Medical Center with a gunshot wound to her leg, police said. Her condition was stabilized.

Four others went to Stroger Hospital, police said. Two 28-year-old men shot in the leg and back and a 54-year-old man hit in the back had their conditions stabilized. A 49-year-old woman who was shot in the chin is in serious condition.

Neither witnesses nor victims saw who did the shooting or know where the rounds came from, police said. Area North detectives are investigating.

A bullet struck the side of an apartment building on the street, but the man who was sleeping in one of units said he didn’t hear any gunfire. “I was woken up by the police lights,” Giovanni said. He only gave his first name for fear of getting recognized by the large group of people he said gather on the corner nearly every weekend.

At least 36 others were hurt in gun violence incidents over the weekend.

Unreal: New Jersey ISIS recruiter gets just 48 months behind bars

You want to know how old the judge in this case is? He was appointed by Lyndon B. Johnson. Yes, Lyndon B. Johnson. The good judge is 97 years old.

From NY Post: A Brooklyn federal judge Wednesday sentenced an admitted ISIS recruiter and failed government cooperator to only 48 months behind bars — despite prosecutors’ requests that the New Jersey woman serve 30 to 50 years for her crimes.

The lenient sentence from Judge Jack Weinstein means Sinmya Amera Ceasar, who’s already served 29 months, will walk free in just over a year and a half following her guilty pleas to charges of providing material support to ISIS and obstruction of justice.

“I was used by people when I was confused,” Ceasar told the court ahead of sentencing. “I wasn’t drawn into it by violence.”

“I’m not blaming others, I’m blaming myself,” she said.

The “wounded animal” aka terrorist supporter

Prosecutors Josh Hafetz and Ian Richardson spent the past three days arguing that Ceasar, who called herself “Umm Nutella,” was still a danger to society after she flouted a 2016 cooperation agreement with the feds and kept talking to fellow jihadists online.

Yet Weinstein disagreed. “It’s apparent that this young woman is in need of serious educational, medical, and economic support,” the judge said in explaining the low sentence. “This sentence will also save her as a human being.”

“She’s like a wounded animal,” defense attorney Deirdre von Dornum said of her client, who was repeatedly sexually abused as a child. “Her life has been ruined, but there’s hope for her.”

Shovel ready: Demorat Illinois governor signs massive tax/infrastructure bill

“He is a private business owner based in Chicago and a managing partner and co-founder of the Pritzker Group and a member of the Pritzker family who own the Hyatt hotel chain; he has an estimated personal net worth of $3.2 billion.

Pritzker was the Democratic nominee for governor of Illinois in the 2018 gubernatorial election. He defeated Republican incumbent Bruce Rauner in the general election on November 6, 2018. As governor, he holds more private wealth than any other governor in U.S. history and is the second-wealthiest U.S. politician to have ever held office, after Michael Bloomberg.

From MyFoxChicago: Illinois Democratic Gov. J.B. Pritzker on Friday signed into law a plan that will pour $45 billion into state construction projects to build and upgrade roads, bridges, parks and schools – and will require drivers, smokers and gamblers to pick up the tab.

Pritzker called it the “most comprehensive reconstruction effort” in the state’s history.

“Together we passed the largest, most robust capital plan in this state’s history,” said Pritzker, whose office says the plan will create 540,000 jobs. “We’re investing $45 billion over 6 years to fix what’s broken and repair what’s needed.”

Illinois’ first statewide capital plan in 10 years will include spending on everything from an expansion of high-speed broadband internet to sewage system development. The bulk of the money – $33.2 billion – will be spent on transportation projects. An additional $4.3 billion will be spent on state facilities, $3.5 billion on education projects and $1.2 billion on environmental projects.

To pay for it all, the Democratic-controlled Legislature approved the expansion of gambling around the state, including new casinos in Chicago, Rockford, Danville, Williamson County and a yet-to-be-decided site in a Cook County suburb south of Chicago. Supporters say the state’s share of gambling revenue will be $2 billion in one-time licensing fees and an additional $400 million a year when all the casinos are up and running.

“We’re responsibly expanding gaming at the request of cities that want to make sure that they have the resources to pay for police and firefighter pensions, and to fund vital services,” Pritzker said.

Lawmakers also have signed off on doubling the state’s gasoline tax from 19 cents a gallon to 38 cents a gallon, as well as bumping the price of cigarettes by $1 a pack, and adding a 15% tax on e-cigarettes.

The cost to register electric vehicles will climb by $250; the cost to register all other vehicles will be increased by $50. The plan also calls for an increase on the real estate transfer on commercial properties and the removal of a sales tax exemption on property valued at more than $10,000.

ICE releases list of illegal aliens accused of rape and murder who were released by sanctuary city policies

Demorats working hard to protect illegal alien criminals and endangering law-abiding citizens.

From Daily Mail: U.S. Immigration and Customs Enforcement has released a list of criminal illegal aliens who were released into communities by sanctuary city policies, as federal officials try to convince cities and states to assist immigration enforcement.

The list released last week highlights cases in Oregon, which has the oldest sanctuary state law in the country, and Washington state, which passed an expanded sanctuary state policy last month.

Washington’s new sanctuary law is among the strongest in the nation, barring local police from assisting federal immigration enforcement officers in any way.

In signing the law, Democratic Governor Jay Inslee said, ‘We will not be complicit in the Trump administration’s depraved efforts to break up hard-working immigrant and refugee families.’

ICE argues that sanctuary policies, which bar local officials from notifying federal officials before they release illegal aliens from detention, allow dangerous criminals back into communities, and force ICE agents to conduct arrests at homes and workplaces rather than the controlled environment of a jail.

Oregon jail releases Mexican man who raped dog

In February, Fidel Lopez, 52, pleaded guilty to raping his fiancee’s Lhasa Apso mix in Portland, Oregon.

While he was being held in the Multnomah County Jail, ICE officials interviewed him and determined that he was an illegally present Mexican citizen. The same day, ICE lodged an immigration detainer on Lopez for violating immigration laws.

In April 2019, Lopez was sentenced to 60 days in jail, the maximum allowed under state law for animal sexual abuse, and released on time served.

ICE says that the county jail did not honor the immigration detainer and released him without notice to immigration officials.

After his release, ICE apprehended Lopez at his residence and served him a notice to appear. He is currently being held at ICE’s Northwest Detention Center in Tacoma pending immigration proceedings.

‘There is an inherent increase in risk to personnel and bystanders when ICE officers and agents must go out into the community to proactively locate these previously detained criminal aliens,’ ICE said in a statement.

Honduran man ‘kills and dismembers his cousin’ after Washington cops released him without notifying ICE

In October 2017, Rosalio Ramos-Ramos was arrested in Kent, Washington on suspicion of methamphetamine possession after calling 911 and making bizarre confessions to involvement in a supposed sexual assault.

While being booked into King County Jail, Ramos-Ramos made statements that he wanted to die and began fighting with corrections officers, injuring five of them, and was hospitalized for a head injury he himself sustained while officers subdued him.

After seeing his named on the local booking log, ICE identified Ramos-Ramos as an illegally present Honduran citizen with prior felony convictions and four prior removals from the U.S.

ICE told the local police department that policy barred them from arresting people at a hospital, and issued a detainer asking the local cops to hand him over for deportation.

However, Kent police were not on hand when Ramos-Ramos regained consciousness after a medically induced coma and walked free from the hospital.

In January 2018, Ramos-Ramos was arrested again in Seattle on suspicion of killing his cousin, dismembering the body, and stuffing the parts in a suitcase. He was charged with murder and is being held in the King County Jail on a $2 million bond. ICE has lodged another detainer with local jail officials.

Illegal alien Martin Gallo-Gallardo

In March 2018, Martin Gallo-Gallardo was arrested in Portland, Oregon and charged with domestic violence. While he was detained at the Multnomah County Jail, ICE identified him as a citizen of Mexico who was unlawfully present in the U.S. and lodged an immigration detainer.

ICE says that jail officials did not honor the immigration detainer and released the convicted criminal two days later, without notifying ICE. Following his release, ICE made multiple, unsuccessful attempts to locate and arrest the Gallo-Gallardo.

In October 2018, Gallo-Gallardo was arrested again, this time on felony murder charges for allegedly killing his wife. An autopsy found the wife died from blunt-force head trauma and multiple stab wounds.

Following the murder, the Multnomah County Sheriff’s Office blamed ICE and said federal agents should have tracked down and arrested Gallo-Gallardo after he was released. Gallo-Gallardo is being held in the Clackamas County Jail without bond on the murder charge. ICE has lodged another detainer with local officials.

Convicted rapist ‘returns to victimize same wheelchair-bound woman’ after Seattle officials release him in defiance of ICE detainer

Mexican national Francisco Carranza-Ramirez, 35, is currently on the run from cops in Seattle after police said that he returned and raped the same wheelchair-bound victim he was previously convicted of sexually assaulting.

Police say that the initial rape occurred in September 2018 when Carranza-Ramirez saw the woman and followed her into her apartment building, attacking her in front of her two-year-old son. The woman managed to surreptitiously dial 911 and left the line open during the attack, and Carranza-Ramirez was caught in the act when police responded.

Carranza-Ramirez entered an Alford plea to the rape charge in February, admitting a jury would likely find him guilty. He is a Mexican national present in the country illegally.

He was released from jail last Thursday, on a judge’s admonishment to return to Mexico of his of own volition. Instead, police say that he returned to the 32-year-old woman’s home and proceeded to strangle, beat and rape her in front of her toddler son.

Carranza-Ramirez is currently being sought, and officials in Seattle now believe he may have returned to Mexico. US Marshals are helping sheriff’s detectives and working with Mexican authorities to track down and arrest Carranza-Ramirez.

Financier George Soros and heiress Abigail Disney are among the 19 billionaires who published an open letter Monday to Republican and Democratic hopefuls saying that they “support a moderate wealth tax on the fortunes of the richest 1/10 of the richest 1% of Americans — on us.”

”The next dollar of new tax revenue should come from the most financially fortunate, not from middle-income and lower-income Americans,” they wrote.

Along with Soros and Disney, other signers include Facebook co-founder Chris Hughes, Molly Munger, daughter of Berkshire Hathaway vice chairman Charlie Munger, and members of the Pritzker family – along with one anonymous.

”America has a moral, ethical and economic responsibility to tax our wealth more,” they write in the letter.

A wealth tax could raise funds to address the climate change crisis, bolster health care measures, curb income inequality and provide relief for those with student loans.

”The concept of a wealth tax isn’t new: Millions of middle-income Americans already pay a wealth tax each year in the form of property taxes on their primary form of wealth — their home,” the letter says. “The kind of moderate tax on the richest 1/10 of 1% that we support just asks us to pay a small wealth tax on the primary source of our wealth as well.”

The letter noted that a number of Democratic candidates – Sen. Elizabeth Warren, Mayor Pete Buttigieg, former Rep. Beto O’Rourke and Rep. Tim Ryan – support the idea.

How’s that gun control working in Washington state after stricter laws implemented?

At the end of May this year I did a blog post entitled, “How’s that gun control working in Washington State since new laws were passed?”

I outlined how presidential candidate demorat Gov. Jay Inslee signed a bunch of new gun control laws on May 7 claiming that they would “improve gun safety overall.”

The new laws included:

Statutory law prohibits firearms to persons under 21 years of age.

Police may temporarily seize guns from people a judge deems a threat to themselves or others.

In November 2018, voters approved I-1639 that includes increased background checks, firearm safety training, waiting periods before semiautomatic assault rifles may be purchased or delivered, and require certain secured firearm storage or trigger-locks, and criminalize certain firearm storage if it results in unauthorized use.

Of course these laws did NOTHING to stop criminals. As I noted in my post, “Seattle had more than one reported shooting a day somewhere in the city during the month of May; two of those incidents resulted in death.”

From MyFoxChicago: Shootings across Chicago’s city limits since Friday evening left four people dead and at least 16 more wounded in the first official weekend of the summer.

On Sunday, a 28-year-old man was killed in Englewood. The man was found about 3:54 a.m. in the 7300 block of South Oakley Avenue by officers responding to a ShotSpotter alert, Chicago police said. He was taken to Christ Medical Center in Oak Lawn with a gunshot wound to his neck and was later pronounced dead.

In Saturday’s only fatal shooting, a 49-year-old woman was found with a gunshot wound to the head blocks away from Chicago State University. Officers found Gloria Hentz about 1:59 a.m. outside a home in the 9700 block of South Dobson Avenue, police and the Cook County medical examiner’s office said. She was taken to the University of Chicago Medical Center where she was later pronounced dead, authorities said. There aren’t any witnesses to the shooting.

Two people died Friday in separate shootings. In the later incident, a 29-year-old man was killed in West Garfield Park.

Several males approached him about 10:11 p.m. as he was walking in the first block of North Kilbourn Avenue, police said. They fired shots and struck him in the back and upper body. The man died at Mount Sinai Hospital. Police said no witnesses have come forward, and the circumstances of the shooting are unknown.

Less than an hour earlier, a 27-year-old man was killed in Lawndale on the West Side. Marvin Bennett was standing on a sidewalk about 9:20 p.m. in the 1500 block of South Christiana Avenue when someone unleashed gunfire, striking him in the head, police said. Bennett was pronounced dead at Mount Sinai Hospital.

Nonfatal shootings left three people wounded Sunday, including a 20-year-old man who was shot while driving in Garfield Park.

The man was eastbound about 8:54 p.m. in the 3900 block of West Jackson Boulevard when he heard shots and felt pain, police said. He kept driving a few blocks before calling police. He suffered a gunshot wound to the back and had his condition stabilized at Stroger Hospital.

A 19-year-old hurt in Lawndale was among Saturday’s six people injured by gunfire. About 6 p.m., he and a 56-year-old man were in the 3900 block of West Lexington Street when someone fired shots at them, police said.

The 19-year-old was struck in the head and was taken to Stroger Hospital in critical condition, police said. The 56-year-old was hit in the right buttocks and taken to Mount Sinai Hospital in good condition.
The weekend’s earliest shooting wounded a 23-year-old man in a South Loop alley.

He was behind a residential building about 5:35 p.m. in the 1600 block of South Michigan Avenue when a gunman approached him and fired shots, Chicago police said. The man was shot in the knee and hand, and his condition was stabilized at Northwestern Memorial Hospital.

Last weekend, 28 people were shot, 6 fatally, in gun violence across Chicago.
