Insane: Knowingly exposing others to HIV will no longer be a felony in California

Liberals not only are gravely mentally-ill, their disorder now threatens to endanger others.

Patrick McGreevy reports for the Los Angeles Times that on Friday, Oct. 6, 2017, California Gov. Jerry Brown signed a bill, SB 239, which reduces from a felony to a misdemeanor the crime of knowingly exposing a sexual partner to HIV without disclosing the infection.

The bill also applies to those who give blood without telling the blood bank that they are HIV-positive. (See DCG’s post here.)

HIV has been the only communicable disease for which exposure is a felony under California law.

The authors of the bill, state Sen. Scott Wiener (D-San Francisco) and Assemblyman Todd Gloria (D-San Diego), argue that modern medicine allows those with HIV to live longer lives and nearly eliminates the possibility of transmission, and that the current law may convince people not to be tested for HIV, because without a test they cannot be charged with a felony if they expose a partner to the infection.

Note: Both Scott Wiener and Todd Gloria are openly “gay”.

Wiener said in a statement:

“Today California took a major step toward treating HIV as a public health issue, instead of treating people living with HIV as criminals. HIV should be treated like all other serious infectious diseases, and that’s what SB 239 does.

We are going to end new HIV infections, and we will do so not by threatening people with state prison time, but rather by getting people to test and providing them access to care.”

Supporters of the bill also claim women engaging in prostitution are disproportionately targeted with criminal charges, even in cases where the infection is not transmitted.

Republican lawmakers including Sen. Joel Anderson of Alpine voted against the bill, arguing it puts the public at risk.

Sen. Anderson said during the floor debate:

“I’m of the mind that if you purposefully inflict another with a disease that alters their lifestyle the rest of their life, puts them on a regimen of medications to maintain any kind of normalcy, it should be a felony. It’s absolutely crazy to me that we should go light on this.”

Brown declined to comment on his approval of SB 239.

  1. It should be a capital crime. Like murder. Of course, if that were the case, then abortion would also be a capital crime.
    Kalifornia, the only state with an Official Disease…..
    HIV/AIDs?…. nope. A close second place to:
    Liberal Insanity.
    Perhaps Trump should just carpet bomb a path across Kalifornia, through San Fran Sicko, and bulldoze it into a corridor for overseas ships to load and unload goods. Then the rest of the nation would have access to the Pacific Ocean, even if Kali would secede, as threatened.
    I, for one, am damned sick and tired of hearing about “California, this…..” and “California, that……”
    Back in the days of Frankie & Annette and the Golden Age of Hollywood, it was the place everyone wanted to go visit. Now, who in their right mind would want to go there?

NOT ME…but we are “trapped” here by the underwater housing economy of the last decade of Obama, etc…. And, like everyone else, I am sick and tired of hearing “Kalifornia this, Kalifornia that,” in relation to gun control, ammo control, sancturary cities, illegal immigration, “Dreamers,” free college or health care for all–even illegals…all on the backs of the only 50% of populace that turns in a legal paycheck record to the state and federal government for taxation.

      As far as exposing, knowingly, another to AIDS or other lethal/long term disease being “excused” in California….does this NOT harken back to the days when a person could KILL someone while they were driving drunk….like the 1950’s….and “get off” b/c they were “JUST” drunk and unaware at the time? Are we TRULY ready and willing and able to roll back our evaluation of “responsibility” to that stilted and blind level of social and legal ignorance ONCE AGAIN????????

    to the repeated attempts by female legislators in the USA and the UK to
    legalize pedophilia so the molesters can receive psychiatric treatment.

  4. Well, California is no longer just the state of fruits and nuts, it has gone so far over the edge with their PC that now anyone who needs blood is in danger. I would say that this blood is tested and is discarded if it contains HIV/AIDS, however,knowing the commie nutcase who runs the state, he may make a law against testing as well. So, if you get sick, get the heck out of California

  6. How is this in anyway beneficial to the community? This will only spread the disease further. The fact that you can live longer while taking hiv meds should be irrelevant. The fact that it NEARLY eliminates, rather then eradicate all possibility of spreading infection says it all. They know people can still be infected, yet choose to pass this law anyway. The utter lack of common sense in the legislation in California is becoming dangerous to the people.

    • Marcella . . . another factor t add to the mix is that some of the HIV/AIDS medications have a per month cost exceeding one thousand dollars for just that one medication. As a nation . . . do we really have such an excess of resources that we can afford such expensive medical care for something that is preventable. I sometimes wonder is Governor Brown of Kalifornia has syphilitic brain disease, or just plain dementia. How could a totally well person approve for all of these drastic measures that effect the population negatively?

          I wouldn’t be surprised if they, esp. brown, was involved in a backhand deal with big pharma to intentionally cause people to get HIV and be forever dependent on their pharmaceuticals.

  8. I foresee a huge jump in HIV infection in California, followed by the inevitable huge increase in full-blown AIDS. That is a terrible way to die…why would any sane person ever risk it?

    Back in the 1980s, my husband’s estranged brother had friends who were a gay couple. One of them died soon after being diagnosed with AIDS. The other one did okay for a few years; he was a nice looking man that looked normal and healthy. Within a few short years, that all changed when the AIDS kicked in, and he was completely unrecognizable. He was about 35 and he looked 100. He was dead within months.

    It seems that they desire to infect as many people as possible. This new law and their push to be able to donate blood leads me to that conclusion. Not to mention San Francisco and their public nudity desires. I surely would not want to sit anywhere they have.

    I will always see San Francisco as my honeymoon city, but the liberal lefties and their sexual deviants have destroyed it’s beauty.

  10. it is truly disgusting what these so-called “legislators” are doing to the legal residents and the state as a whole…and are getting away with it.
    so, california is not only a sanctuary state for illegals, but also a sanctuary state for HIV, AIDS, and tainted blood donation.
    what is wrong with these people?…everything.
    california is a prime example of what happens when morally corrupt and evil “lawmakers” get control and use every means necessary to keep control and ruin an entire state and its people.
    if allowed, the PC world will bring you down to the lowest common denominator….especially if you want to live your life as a reflection of the Lord.
    I don’t know how the people of California can excise this cancer out of our state….the entire state needs an overhaul.
    All I can suggest is to please pray to the Lord for the people of California to deliver us from these evils….Amen.

    • Maryaha . . . I agree wholeheartedly with the sentiment that there are indeed good and righteous people living in The State of California that really could benefit from our prayers. Not everyone goes along with all this perverse craziness, nor are all the good people able to flee their state. I am glad you thought of that idea, it really is profound. Thank you.

Whenever there’s a serious accident,someone needs surgery,a transfusion or treatment for a contagious disease,there will be DEMANDS from patients or families of patients to transport the patients to OTHER States’ Hospitals for their care. There will be special daily flights scheduled to transport patients elsewhere. In Ca.,with the exceptions of homosexuals and illegals and their ER needs,California Hospitals will literally be like Morgues. I guess,technically,they WOULD BE Morgues with waiting facilities.)

    • That’s a good point. What happens when a state elects to do things that make it dangerous to the nation, as a whole? If they allow diseased aliens to infect residents that travel to other states, who is accountable?

      If they export products and services that are impacted by their 3rd World hygiene and standards, does the rest of the nation have to accept that? If “managing” their weirdness becomes too costly and expensive, what do we do?

      What if there’s a war and they refuse to participate, or, conversely, they start one? It has been on this path for quite a while now. Having a communist mentality is dangerous. They want everything with no responsibility for it.

      What’s going to happen, as it may already be, is that people will become increasingly indifferent to tragedy. They’ll be afraid to assist in accidents, many against their very nature, and this will bring about a deep hatred, within, for going against their own better nature to help.
      The libs don’t yet realize the consequences they’re unleashing upon themselves.
      Humans are social creatures and to take that away leads to inner frustration, apathy, and potential sociopathy.

      • America needs to go through and revisit the Conservative and Liberal MEANINGS of a lot of the English language. We’d find that THEIR meaning of many words is TOTALLY different than ours. Unfortunately,THEY believe they’re right just as solidly as WE believe WE’RE right. What to do???? There’s not enough rubber rooms to commit them all,nor enough attendants to administer their meds and electro-therapy sessions,and it’s illegal to just declare open season on Liberals….

        • Just bear with me a minute. I know I’ve talked team sports, etc., to death, but I want to explain something. People are conditioned to “pick teams”. When the entire propaganda apparatus is constantly reinforcing the notion that people only have two choices and then defining them, they pick “their” team.

          The truth is that what they define isn’t acceptable. But, once they have “picked their team”, there is no limit to how much disgusting baggage they can attach to it. So inflicting unwanted pregnancies and spreading disease is no longer out of the question if it’s for “your team”. That’s where we are.

          None of this is accidental. It’s all in the script. Of course, some of us are onto this. But, collectively, they’re betting not enough to be a problem.
