Spero has presided as trial judge in criminal and civil cases in a variety of subject areas, including patent, employment, civil rights, commercial contract, trademark, and federal misdemeanor cases. He has also served as a settlement judge in over 1500 cases.”

From Daily Mail: The family of a woman allegedly killed by an illegal immigrant who was deported five times cannot sue the city of San Francisco, a judge ruled.

Kate Steinle, 32, was reportedly shot dead by Juan Francisco Lopez-Sanchez, 45, a Mexican national with a long criminal record who was allowed to remain in the country due to the city’s controversial sanctuary policies.

The Steinle family argued in a wrongful death suit that the city and former sheriff should be held responsible for her murder.  

Lawyers argued that if city officials had notified Immigration and Customs Enforcement when they released 7-time felon Lopez-Sanchez from prison in April of 2015, Kate’s death could have been avoided. 

‘Kate’s death was both foreseeable and preventable had the law enforcement agencies, officials and/or officers involved simply followed the laws, regulations and/or procedures which they swore to uphold,’ the lawsuit said.

However, Judge Joseph C. Spero dismissed their claims on Friday, according to KTLA.

He wrote: ‘No law required the Sheriff’s Department to share Lopez-Sanchez’s release date with ICE, nor did any law forbid Mirkarimi establishing a policy against such cooperation’.

Kate’s death caused an uproar when it occurred last year and became a rallying cry for Donald Trump’s immigration policies while on the campaign trail.

Sanctuary cities have no clear definition or geographic limit. They are scattered throughout the country and generally limit the ability of government workers to assist the federal government with immigration matters.

In San Francisco, the City and County of Refuge ordinance, passed in 1989, ‘prohibits city employees from helping federal immigration enforcement efforts unless compelled by court order or state law’, according to CNN.

The Steinle family may still have an opportunity to seek justice, as the judge allowed their case against the Bureau of Land Management (BLM) to continue. Lopez-Sanchez reportedly stole the gun he used to kill Kate from a BLM unattended vehicle.

  3. It is notoriously difficult for Americans to sue the government. The Steinle family probably will find more success with a civil suit against SF mayor & sheriff.

    • It is notoriously difficult to sue the Federal Govt, but not so difficult to sue local and state govts, especially police or prisons, in Federal Courts. Libs and criminals do it all the time.
      What is different in this case is that the city and their police willfully, knowingly, amd intentionally broke Federal laws to release a known dangerous criminal that was unlawfully in this country. They did this out of Liberal arrogance and disrespect for actual Law, passed by Congress, mandated by the Constitution, and signed into law by previous Presidents. They may think they were covered by the current administrations refusal to enforce the law, but a Lib/Prod “nod & wink” is further conspiracy to ignore and break Federal Law.
      We have a huge opportunity here to support and strengthen the Constitution and enforce Constitutional responsibility on BOTH Parties, as well as Stale and local govts. It is a rare opportunity indeed! We need to do what we can to expose this flagrant and intentional willful violation of CONSTITUTIONAL LAW intended to protect our Citizens, Economy, and National Security, by arrogant Liberal Socialists adhering to a foreign Globalist Agenda. A gross violation of all their “Oaths of Office”.
      Please, Dr. Eowyn, “take up your shield” and try to get this to the attention of anyone that has the ear of the Trump organization.
      Furthering this lawsuit could end all of the “Sanctuary” nonsense for Criminal Invaders, quickly and easily.
      This is a rare opportunity to be a real American hero. To make a real difference in restoring Constitutional Govt.


    • Dr Eowyn . . . I agree, they should move forward in suing the mayor and sheriff of San Francisco. Let’s put the blame where it belongs. Suing the BLM for a stolen gun (even thought that was extremely careless of the owner) removes the blame from where it really belongs. . . the chief officers of the city and police dept at the time of this occurrence.

  4. San Francisco was in clear violation of Federal Law by not handing a known Illegal Alien over to ICE. This malfeasance is increased dramatically if the police knew he was a 7 times convicted, violent Felon that had been deported 5 times before. This was a known dangerous criminal they released on innocent American victims. Victims intentionally disarmed by Lib/Prog Pols!
    This is Gross Culpable Negligence, Malfeasance, and Misprision (Covering up) of Felony by the Police in clear violation of Existing Federal Law. Granted, the Obamunist controlled ICE may have released him, but then it would have been their fault. It is time to put a stop to Liberal Idiots flagrantly and openly ignoring and violating necessary Federal Law that is in place to protect American Citizens from violent Criminal Invaders! This Dirt-bag could just as easily been a Jihadist that intended to blow up a bus load of San Fran hippies and faggots, imagine what the Media reaction would have been then!

  5. I only now read this horrible atrocity. It’s impossible for me to comprehend how anyone would want to injure this beautiful young woman just coming into the fullness of her life…. Why would anyone ever act against her in any way?

    This savage deserves the death penalty, but it’s probably better to put him on a remote island as was done to Napoleon, but w/o provisions beyond a few tools to use to provide for himself, as he’s such an antisoocial creep.

    • Joseph . . . I could not agree with you more. If you just look at the pictures (side by side) of the woman who was killed, and the murderer . . . you cannot help but come to some mental conclusion of which of these individuals had the promise of being a better addition to our society!

      This is a great reason to CUT ALL FEDERAL FUNDING to sanctuary cities . . . I may not be impartial, but since Portland, Oregon has just come out as a “sanctuary city” according to our new major–Ted Wheeler . . . let’s just start by cutting funds to Portland. That works just fine for me.

    • Anarchy is the only socially responsible solution. NEVER confuse anarchy w/ nihilism, which is what you’ve been misled to believe is true. Anarchy wants the MINIMUM governance by formal bodies ruling from the top down, and instead seeks the MAXIMUM participation from the bottom [our communities up], instead.

      The best example of traditional anarchy in action is when rural communities form volunteer fire departments. see how simple it is? Ditto for paramedics and ambulances. Schooling should be voluntary only.


      • Anarchy, i.e., self-rule or “true” communism, is a pipe dream. It is simply not feasible for large living units, especially urban cities. Anarchy as practiced by communes has largely been a record of failure.

        • Anarchy demands taking responsibility for one’s life & the consequences of free will choices, so yes, you are correct, it isn’t likely to be commonly found. However, Jeshua was about us living as distantly from political governance as possible, lest it corrupt our beliefs and right relationships, which made Christianity a stumbling block for weaker souls. He never said it was going to be easy, but who among us would want other than what He has given us?

          Anarchy rooted in Christian beliefs worked well for the Doukhobors in BC, amongst whom I lived for 17 years as I wanted my children to live in that atmosphere of spiritual peace and understandings. Again, you’re correct in that it works best for smaller groups of people.           • Anarchy, i.e., genuine self-government or “true” communism, doesn’t work because that ideology believes — and requires, for it to work — that human nature is fundamentally good & selfless. But human nature and we are not, as Genesis makes clear — The Fall and the resultant Original Sin, by which we are all born with concupiscence, being tinder for sin (fomes peccati), inclined toward evil. Anyone who thinks human beings are basically good is naive, and are doomed to a life of repeated rude awakenings when people, again and again, turn out not to be angels.

            Not to be rude, but that last sentence describes your life experiences, which you had related to us in your tales of woe.

      • The simple current usage of “Anarchy”, is a Lib/Prog “excuse” to refuse to obey any law they dislike or don’t find convenient. “Anarchists” in the past not only refused to obey laws, but would kill anyone that represented the laws or obeying them. Most of the “Anarchists” were really Marxists of some sort, but the Progressives didn’t want to get a negative connotation to “Marxism”, so they called them “Anarchists”. The same pretty much holds true today.
        Nihilisn – 1. a negative doctrine, the total rejection of religion and morality.
        Is not completely accurate. Many of these people make a religion out of their perversions and their politics. They reject OUR morality, but insist everyone else accept THEIRS. They are actually Marxists, Totalitarians & Revolutionaries, plus assorted Whack-doodles, forcibly rejecting all laws, morality, and religion of the Dominant Society, but demanding everyone obey theirs, … whatever, …wishes? Man-Caused Global Warming, Universal Brotherhood, Borderless Nations, Guaranteed Income, Free Unicorns and My Little Ponies for everyone?
        Nihilism is more a “state of mind”, Anarchy is more of a “recognized political philosophy” by current usage. At least it looks that way to me. Just trying to use the words that others seem to understand.
