Did you know that the city of New York has a Human Rights Law?

It’s called the New York City Human Rights Law (NYCHRL), the enforcement of which is by a bureaucracy called the New York City Commission on Human Rights (henceforth, the Commission).

The purpose of the city’s Human Rights Law is to prohibit discrimination in employment, public accommodations, and housing on the basis of gender. But NYCHRL has a specific, politically-correct definition for gender as one’s “actual or perceived sex and shall also include a person’s gender identity, self-image, appearance, behavior or expression, whether or not that gender identity, self-image, appearance, behavior or expression is different from that traditionally associated with the legal sex assigned to that person at birth.” 

The Commission has an elaborate, detailed legal enforcement guide for the Human Rights Law, which you can read here. The guide includes:

Definitions

1. Cisgender: an adjective denoting or relating to a person whose self-identity conforms with the gender that corresponds to their biological sex, i.e, someone who is not transgender.

2. Gender Identity: one’s internal deeply-held sense of one’s gender which may be the same or different from one’s sex assigned at birth. One’s gender identity may be male, female, neither or both, e.g., non-binary. Everyone has a gender identity. Gender identity is distinct from sexual orientation.

3. Gender Expression: the representation of gender as expressed through, for example, one’s name, choice of pronouns, clothing, haircut, behavior, voice, or body characteristics. Gender expression may not be distinctively male or female and may not conform to traditional gender-based stereotypes assigned to specific gender identities.

4. Gender: an individual’s actual or perceived sex, gender identity, self-image, appearance, behavior, or expression, whether or not that gender identity, self-image, appearance, behavior or expression is different from that traditionally associated with the sex assigned at birth.

5. Gender Non-Conforming: an adjective sometimes used to describe someone whose gender expression differs from traditional gender-based stereotypes. Not all gender non-conforming people are transgender. Conversely, not all transgender people are gender non-conforming.

6. Sex: a combination of bodily characteristics including chromosomes, hormones, internal and external reproductive organs, secondary sex characteristics, and gender identity. Most people are assigned male or female at birth based on the appearance of their external genitalia.

7. Intersex: a term used to refer to a person whose reproductive or sexual anatomy and/or chromosomal pattern does not fit typical definitions of male or female. There are many different medical diagnoses or conditions that an intersex person may have.

8. Transgender: an adjective used to describe someone whose gender identity or expression is not typically associated with the sex assigned at birth. It can be used to describe people with a broad range of identity or expression. Someone who identifies their gender as androgynous, gender queer, non-binary, gender non-conforming, MTF (male to female), or FTM (female to male) may also consider themselves to be transgender.

From the above list of definitions, do you now have a clear idea of what “gender” is, or what “sex” is, or how “gender” is different (or not) from “sex”?

I don’t have a clear idea either.

What I got from the definitions is that a person’s subjective feelings trump all — even over biology. One can be whatever “gender” or “sex” (it turns out the two terms are interchangeable, with both meaning “the person’s subjective identity or perception”) he or she “thinks” or “perceives” himself or herself to be. The trick is that the New York City Human Rights Law demands that everybody else must conform to that person’s subjective “gender identity,” and if you don’t, you’ve committed “gender discrimination” and can be prosecuted.

Gender-based discrimination/harassment

Under NYCHRL, “gender discrimination” is defined as “discrimination . . . based on one’s perceived or actual gender identity, which may or may not conform to one’s sex assigned at birth, or on the ways in which one expresses gender, such as through appearance or communication style.  Gender discrimination is prohibited in employment, housing, public accommodations, discriminatory harassment, and bias-based profiling by police and exists whenever there is disparate treatment of an individual on account of gender.  When an individual is treated ‘less well than others on account of their gender,’ 8 that is gender discrimination under the NYCHRL.”

Note that “less well than others” is not defined.

Furthermore, gender discrimination can be “harassment” that is “motivated by gender,” that is “when the incident or behavior creates an environment or reflects or fosters a culture or atmosphere of sex stereotyping, degradation, humiliation, bias, or objectification” — all loaded terms.

This is where the Commission’s legal guide becomes tyrannical.

As examples of gender-based harassment, the guide includes the following:

  1. Unwanted sexual advances or requests for sexual favors;
  2. Comments, unwanted touching, gestures, jokes, or pictures that target an individual based on gender
  3. Refusal to use a transgender employee’s preferred name, pronoun, or title.

Examples of violating #3 include:

  • Repeatedly calling a transgender woman “him” or “Mr.” after she has made clear which pronouns and title she uses.
  • Calling a transgender woman “Mr.” because her appearance “is aligned with traditional gender-based stereotypes of masculinity.”
  • Refusing to call a transgender woman her preferred name, Jane, because her identification says that her first name is John.
  • Refusing to permit individuals to use single-sex facilities, such as bathrooms or locker rooms, and participate in single-sex programs, consistent with their gender identity (or perception), regardless of their sex assigned at birth, anatomy, medical history, appearance, or the sex indicated on their identification — even if other people, including customers, object to the transgender using the single-sex facility like a bathroom.
  • Requiring a transgender or gender non-conforming individual to provide proof of their gender in order to access the appropriate single-sex program or facility. 
  • Imposing different uniforms or grooming standards based on sex or gender.

Penalties

The Commission can impose civil penalties up to $125,000 for violations, and up to $250,000 for violations that are the result of willful, wanton, or malicious conduct. (Note that neither “willful” nor “wanton” nor “malicious” is defined.)

I expect any day now, we will be required by law to call someone a bunny rabbit or “it” because he “identifies” and “perceives” himself to be a rabbit. After all, if Americans believe in “transgender,” why not “transrace” or “transspecies”?

  3. They could fine me as much as they wanted-they can’t squeeze blood out of a rock….I guess it’s time to drag out the “Questionable Gender” card on the Mayor (or MayNOT) of NYC. My Brother’s ex mentioned seeing “him” on a news clip and noticed a conspicuous “lack of bulge” even a cheap pair of pants couldn’t hide. Needless to say,I was surprised to hear THAT from her. She claims to be a Conservative,while showing all the earmarks of a Liberal. WTF??

      • Folks, I am a pretty intelligent person, and even though a conservative am willing to engage in a very broad spectrum of beliefs, ideas, and challenges for discussion. However, at this point I feel as though we have entered a territory so strange, so foreign, so difficult to understand that there’s little chance for meaningful discussion between equals.

        The basis of any and all meaningful discussion begins with an understanding of the names and terms used by the participants. But it appears to me that my contender uses words and terminology that either has a different meaning for me or I simply cannot understand it as they are intended for me to understand it.

        I have a lot more to write on this, but the difficulty of my using the very small screen on my iPhone makes it impossible for me to write any more, due to my limited vision.

  6. I await the day, when a person with full, anatomically correct, male genitalia is convicted of a crime & then claim they are a female, & demands to be sent to a ,..’woman’s,..’ prison,.or,..for that matter,..when a bio/female convict demands to be incarcerated in a men’s prison,..

    And, I am guessing that this issue will arise when tryouts for the next Olympic Games roll around,as most certainly, there will be some ‘bio/male’s’ wanting to compete on the US women’s Olympic team,..and/or visa versa,..

      • What we’re seeing now is bad stuff,but if we follow the Liberal line of “thought”,how long before we start getting invitations to peoples man/horse or trans-gender/duck weddings? THAT will give me nightmares!

    • If I recall a woman has already married the eiffel tower and another has married the berlin wall, or whats left of it. But the next step is “otherkin” also… these are people who are convinced they are not human in their soul, some of them even think they’re hybrid creatures consisting of fantasy beings… regardless of how incompatible such beings would be… IE “1/3rd angel, 1/3rd demon, 1/3rd vampire” for example. Another popular choice is dragons. You’re probably going to see more mental illnesses or diseases touted as healthy or normal over time. I imagine such vileness as tantra and other things will gain in popularity too, as well as “psychic” (or regular) vampirism and “energy medicine” (which we already see with the crazy channeling of reiki etc.) and all that.

      What to do about it? combat it wherever possible and especially in your own localities, if there are “gender” or non-discrimination & “hate crime” laws and such, one should check and make sure they aren’t “weasel-worded” with nebulous loaded terms like this new york malarkey, and try to get laws or ordinances passed that prevent “activists” from monkeying with those. Naturally legislation won’t stop ’em, but it is an impediment, and impediments help in adding time for preparing proper countermeasures

  10. SOOOOO…this means then that any ‘woman’ or ‘tranny’ can now audition for ANY NEW YORK PROFESSIONAL SPORTS TEAM, right?? If they don’t let you, the NFL, NBA, MLB are then guilty via the state of new yark of being ‘prejudiced’ or whatever they say it is.
    This whole bathroom thing can be solved easily. Just have three bathrooms- one for the “He” one for the “She” and one for the “IT”.
    So much for freedom of choice…so now if we think a ‘guy’ is a ‘woman’, we have to call it a ‘guy’? What if we don’t want to? Oh, that’s right, no choices in Commie land New York.

    Much like police officers nowadays . Nothing but control freaks . If you ask pertinent q’s to them which they don’t have the aptitude to reply to , you get arrested and thrown into the so-called legal system .Which is a big joke .

    Why is it that a lot of the police are ex-vets ? Control , control , control …..That’s what it’s all about . Half of them look like they have been on steroids all their lives …..the other half of the police force look like whimps who couldn’t wipe their own butt . And yet they are able to shoot non-compliant people , and get away with it ( in most cases )……..Because the sheeple have been programmed to never doubt the gov’t enforcers ..

  16. I’ve written abt my situation w/this before here–but it bears repeating b/c it’s getting more scary, even in the last year’s time: I tread eggshells w/this issue as a teacher. Surely, the first to be sued will be a “deep pocket” institution—like a school district (—good luck getting millions out of a poor middle-class conservative…we have enough trouble these days buying a gallon of GAS—so, at the drop of a hat—or a pronoun–these people will go for the “deep pockets” instead).

    I’m not saying school districts will purposely NOT go along with all of this—They WILL….we long ago had these policy lectures here in CA. But, it will be a humble teacher, like me, who mistakenly uses the WRONG pronoun when referring to a little one & that kid will go home & say, “Parent—my teacher called me “she” when I really WANT to be a “he” & everyone else knows it…why doesn’t my teacher?” Then, the lawsuits will begin!

    I have this potential situation going on right NOW in a middle school classroom. I teach a child who is listed as a female on my records, but whom shows up to school representing a male child in dress/friends /actions…& though neither “she” or a parent has informed any of us of a sexual identity preference; all “her” peers THINK “she” is a boy, even after going to school with “her” for a number of years through elementary school before they all arrived at middle. I don’t KNOW what pronoun I’m supposed to use. The first time I used the “her” pronoun for this child, the other kids about had a meltdown—visibly reacting/ responding to me (though the child in question did not).I was SO paranoid after that, so I asked a campus supervisor to secretly follow “her” one day when I released “her” to go to the bathroom, just to see which door “she” chose. I figured if “she” went into the boy’s room, I’d call “her” “he,” & if she chose the girl’s room, then I’d KNOW that “she” knew “she” was a “she” & had not informed school officials or teachers of a preference. She chose the girl’s door. Still…I decided to try to NOT use ANY pronoun with “her.” I use “her” name (which, ironically is an ULTRA- FEMININE first name…which is why I can’t see why peers haven’t figured this out yet).

    I am “asea” lately with this “stuff.” I am not a mind-reader. I attend to nearly 200 seat-times daily, MORE if I carry an extra period (which I do on Mondays and Wednesdays). What I WANT to do is to teach my subject matter(s), delivered in ways appropriate to the age group to whom I am responsible. I am a loving parent, teacher, daughter, friend, wife, neighbor, etc….and I’d never intentionally hurt anyone, let alone one of my students. Yet, the teaching profession has become fraught with mine fields and “no-win” situations increasingly through the years. I find so much of my time these days being eaten up with wrestling technology that doesn’t work OR dealing with salient social issues, such as this…..I USED to teach “bell to bell” in my classroom—-and now, I bet I’m “lucky” to be able to devote 3/4 of that same time—maybe even only HALF, these days, to delivering the required subject matter/standards to my kids.

    Here’s a quote I’ve heard—pretty sure it must have been from a Founding Father or someone of significance to us (I paraphrase—but the meaning is the same): A government that can give you EVERYTHING you demand of it, is powerful enough to also take EVERYTHING away from you.

    We’ve arrived.

Well, the quote up top is certainly justified & correct; the vast majority of our societal ills are legislated, the DEVIL is in the details, and it is often through “elections” that evil ascends. Remember folks the JAFFE MEMO from Planned Parenthood in 1970 showing the intention of promoting homosexuality for the purpose of EUGENICS? Political Correctness, or else. The truth must be criminalized in the name of ANTI-DISCRIMINATION. What a joke

  23. Thank you Dr. Eowyn for this incredible post. I read the definitions within this “law” a few times, and I have no idea what they are talking about, nor is it in any way clear to understand. This undoubtedly is the language of the devil-upside down and completely confusing. It is an attempt to make evil, good, and good, evil. It is full of flaws and inconsistencies. Horrible.
