Fox News: One of two men charged in connection with last month’s home invasion, rape and fatal bludgeoning of a 64-year-old California woman was in the U.S. illegally and on probation, the News-Press has learned.

Victor Aureliano Martinez Ramirez, 29, who is charged along with Jose Fernando Villagomez, 20, in the July 24 attack in Santa Maria, Calif., was on probation for committing battery against an unidentified woman on May 22, 2014, while in possession of methamphetamine. He was charged twice this year for violating probation, once for possessing a concealed knife and the other for drugs, but a Santa Barbara judge allowed him to enter a substance abuse center in Santa Maria in lieu of jail. According to County Jail officials, U.S. Immigration and Customs Enforcement declined to issue an immigration detainer that would have required local authorities to hold him for deportation.

Police say Marilyn Pharis was beaten with a hammer and sexually assaulted in the morning attack, and died later at a local hospital. An autopsy was set for Thursday.  Ramirez fled, but was tracked from the scene by a police dog to a nearby home, according to authorities.

Ramirez pleaded not guilty to attempted murder, first-degree burglary, and assault with intent to commit rape. Those charges could be upgraded to murder following Pharis’ death. He was being held on $1 million bail.

Villagomez was booked Tuesday into Santa Barbara County Jail on suspicion of sexual assault and attempted murder. He was already behind bars after a July 28 arrest over a probation violation.

In May, Villagomez allegedly committed battery against Miguel Angel Romero and was found in possession of methamphetamine. He was sentenced to three years of supervised probation June 17 and was also allowed to enter a drug treatment center in Santa Maria.

Both men will next appear in court on Aug. 13. The autopsy findings could result in murder charges against both.

  3. Do I understand this correctly–the taxpayers were sending the one illegal to a drug rehab center, rather than jail? Why are we in the business of providing medical (psychological or physical in nature) to people who have no legal claim on the riches of this nation. I would say the judge in this case needs to be voted out of office ASAP! Sorry to those who are fainthearted but in instances like this the death penalty should come into play. Why punish the American taxpayer with supporting murderers for the rest of their pitiful lives? I say NO! It also galls me that no other Republican has stood up like Trump to cry outrage over the flood of illegal criminals who have been murdering, torturing, raping, stealing from, etc the American people. Why is that??? They need to be kicked to the curb also!

      The Latino vote. Reportedly, Trump has a 75% disapproval rating among Latinos.

      It’s a vicious circle: the more illegals we let in, the more Latino votes (illegals vote! What a country!), the more politicians don’t do anything about the invasion, the more illegals we let in, etc. etc.

  6. I have an idea,..How about, that , whenever anyone who is out of prison on parole commits a crime,..then,. every member of the parole board, who voted to turn them loose would be charged with whatever crime the paroled person may commit while on parole,.?.

My introduction to California 30 years ago was…in our RURAL area, near the coastal Ortega Mt Range…..abt 8 mi North of the first Border Patrol check point (70 mi N of the Mexican border—in fact…..where OBAMA planned to flood our rural area with those thousands of illegals by the busload last year—) was the abduction and rape of a 5-year old girl….OUT OF HER HOME—HER BEDROOM AT NIGHT by an illegal. He didn’t KILL her…but tied her up like a cocoon and strapped her to a tree. She STILL could have died in the vastness of the adjacent State forest lands, if she’d not been found and freed. Being born/raised in the East, I could NOT UNDERSTAND the UNDERWHELMING repsonse by the people in the area….which amounted to NO response. Business “as usual.” AS the (THEN) mother of children about that age….I lived in fear everyday when I sent my kids off to walk to school or when we set our heads down each night on our pillows. To this day, to my knowledge, NOTHING was ever done, no justice was ever pursued on this case. It was an “accepted PRICE” of doing business here in Southern Califnornia. I am still stunned after all these years. I am still grieving for this child and family and there is NO END IN SIGHT according to our National mores/values on this subject/problem. It is “acceptable” and that little girl and that family paid the price that funded the Obama Administration. Countless others continue paying today, 30 years later.
