Senate panel OKs tax-welfare benefits for newly legal immigrants

The Senate Judiciary Committee voted Monday to allow illegal immigrants who get legal status to begin collecting tax-welfare payments, as the panel spent a fourth day working through amendments to the massive immigration bill and party-line splits began to emerge.

In one major change, the committee voted 17-1 to make a third drunken-driving conviction a deportable offense for the newly legalized immigrants if at least one of those offenses occurs after they are approved for legal status.

But immigrant-rights groups called that a rollback of due-process rights for the immigrants and said a drunken-driving incident shouldn’t cost someone a chance at citizenship.

“We cannot and will not support hard-line proposals that take away discretion and limit an individual’s ability to pursue the pathway to citizenship,” said Paromita Shah, associate director of the National Lawyers Guild’s National Immigration Project.

Overall, the committee continued to maintain the delicate balance struck by the “Gang of Eight” senators who negotiated the 867-page bill: Quick legal status for illegal immigrants, but delaying citizenship rights until after the administration spends more money on border security, puts in place a new electronic verification system to check workers’ status, and enacts an entry-exit system to check visas at airports and seaports.

In previous days’ action, two Republican members of the Gang of Eight — Sens. Lindsey Graham of South Carolina and Jeff Flake of Arizona — joined with Democrats to block a series of GOP amendments to stiffen the bill’s security.

But on Monday, the two Republicans sided with their party colleagues on key questions on giving illegal immigrants public benefits.

The 10 Democrats on the committee still outnumber the newly unified Republicans, but the votes signaled tough fights ahead on the Senate floor.

President Barack Obama will go for immigration reform and gun control this month, the White House tells the left-leaning Huffington Post. Obama’s actions will reportedly be done “quickly.”

“An Obama administration official said the president plans to push for immigration reform this January. The official, who spoke about legislative plans only on condition of anonymity, said that coming standoffs over deficit reduction are unlikely to drain momentum from other priorities. The White House plans to push forward quickly, not just on immigration reform but gun control laws as well,” reports the Huffington Post.

Obama administration failed to deport arrested illegal immigrants who went onto to commit 19 murders and 142 sex crimes

Daily Mail: Illegal immigrants arrested and then released were responsible for 19 murders, three attempted murders and 142 sex crimes during the first three years of President Obama’s administration.

The findings, which were published by the House Judiciary Committee, found that 36,000 illegal immigrants arrested on other charges between 2008 and 2011 failed to be deported by the President and his team.

The study discovered that one in six illegal immigrants is re-arrested on criminal charges within three years of release and House Republicans have condemned what they see as a ‘dangerous and deadly’ immigration policy.

President Obama and his administration were aware of 159,286 immigrants who had committed crimes and been arrested and declined to deport more than 36,000 of them who were here illegally. Although three-quarters of the almost 160,000 people were not eligible for deportation because they were legal, the rest could have been deported.

Those who could have been deported but were instead released back into the community, went onto commit 19 murders, three attempted murders and 142 sex crimes said the House Judiciary Committee which produced the report along with the Congressional Research Service.

‘The Obama administration could have prevented these senseless crimes by enforcing our immigration laws,’ said committee Chairman Lamar Smith. ‘But President Obama continues to further his anti-enforcement agenda while innocent Americans suffer the consequences. ‘His unwillingness to enforce immigration laws puts our communities at risk and costs American lives.’

In addition to the serious violent and sexual crimes committed by the 159,286 immigrants, there were nearly 8,500 drunken-driving offences and 6,000 drug related violations.

The findings were compiled after records were subpoenaed last year after concerns that President Obama’s administration was neglecting its immigration policy, allowing, ‘potentially millions of illegal and criminal immigrants to avoid current immigration law,’ said the Republican led House committee. The Department of Homeland Security could not be reached for any comment on the figures.

The Committee members cited the case of 24-year-old Danilo Morales, who was allegedly killed by 22-year-old Evan Adonis Ortiz and 29-year-old Rene Ubaldo Ramirez. Ramirez is an illegal immigrant who has twice been deported from the USA who was flagged by Secure Communities for a June 2010 vehicle theft and then arrested five months later for attempted grand theft.

Six months after that he was arrested for the murder of Danilo Morales, who was coming to the aid of his 68-year-old grandson, who was being robbed by 27-year-old Edwin Alexander Bonilla and 22-year-old Evan Adonis Ortiz. ‘While this illegal immigrant should have been detained and deported, he was not considered a priority under the Obama administration’s reckless immigration policy and was released onto our streets,’ the committee concluded.

Another case that concerned the committee was that of Carlos Montano, an illegal immigrant who allegedly caused a car crash while driving under the influence that killed a nun, Sister Denise Mosie in August of 2010. Prior to the accident, Montano had been arrested twice before on drunk driving charges but had not been deported.

I feel bad for the families of these victims and crimes.  How infuriating to know that these crimes could have been avoided if the illegals were simply deported.

Obama administration to close nine border patrol stations in four states

ExaminerThe Obama administration is set to close nine Border Patrol stations in four states, Fox News reported Tuesday.  The move has caused alarm from law enforcement officers, members of Congress and Border Patrol agents.

Critics say the closures will hurt efforts to intercept drug and human traffickers in well-traveled corridors north of the border with Mexico.

Six of the stations are in Texas, with one each in Montana, Idaho and California.  The Texas stations are located in Lubbock, Amarillo, Dallas, San Angelo, Abilene and San Antonio.  The other three are in Billings, Idaho Falls and Riverside, California.

While the stations are not close to the border, they still see plenty of action.  According to Fox, the Amarillo station is “right in the middle of the I-40 corridor,” while the Riverside station is outside Los Angeles.

The U.S. Customs and Border Protection Agency says the move is designed to get agents closer to the border where they are needed, but Fox says that “at least one Border Patrol supervisor in Texas” wants local law enforcement officials to make their concerns known.

It could impact us tremendously since we’ve only got two agents up here now for 26 counties,” Potter County Sheriff Brian Thomas said.  The Amarillo station is located in Potter County and Sheriff Thomas says the area is a major “corridor” for illegal immigrants.  “I can’t hold a carload of people out there on I-40 for eight hours while somebody comes from El Paso,” he told Fox News. “I mean, that’s just crazy.”

Fox added:

Border Patrol’s resident agent in charge in Amarillo expressed similar worries, in a recent memo to local law enforcement alerting them to the planned closure. The official, Robert Green, warned that the “entire complement” of two agents would be reassigned from Amarillo to somewhere closer to the border. He said “there is no active plan” right now for Immigration and Customs Enforcement to fill the void on assisting local officials with stops.

Lawmakers, after hearing from local law enforcement authorities, have asked the Agency to reconsider the plan.

Critics also say the move is part of the Obama administration’s soft stand on immigration enforcement.  “It’s part of the systematic dismantling of both border and interior enforcement,” said Bob Dane, communications director with the Federation for American Immigration Reform (FAIR).

Recently, the administration announced that it would stop deporting certain young illegal immigrants, and suspended existing agreements with Arizona over enforcement of federal immigration laws after the Supreme Court upheld a key provision in that state’s new immigration law.

In February, the administration named the first official taxpayer-funded public advocate for illegal immigrants, a position GOP lawmakers called “an official mouthpiece for illegal immigrants being deported.”

“The Department of Homeland Security hasn’t demonstrated that sending additional resources to the border will be a more efficient use of resources than maintaining a presence further north,” said Rep. Randy Neugebauer (R-TX). “I’d like to see numbers that reassure me that this strategy change won’t ultimately result in fewer arrests.”

According to CNN, the closures will save the government $1.3 million a year.

Maybe Skippy plans to use that savings to foot another expensive, tax-payer funded vacation for Moochelle.

Obama makes election-year change in deportation policy

The Obama administration announced Friday it will stop deporting illegal immigrants who come to the country at a young age.

The politically charged decision comes as Obama faces a tough reelection fight against Republican Mitt Romney, with Hispanic voters in swing states seen as a key bloc.

The change in policy could allow as many as 800,000 immigrants who came to the United States illegally not only to remain in the country without fear of being deported, but to work legally, according to a senior administration official speaking to reporters Friday.

Obama is set to make a statement at 1:15 p.m. Homeland Security Secretary Janet Napolitano announced the new policy Friday morning.

“Young people who were brought to the United States through no fault of their own as children, who meet several key criteria, will no longer be removed from the country or entered into removal proceedings,” said Napolitano in a conference call with reporters on Friday morning.

“This grant of deferred action is not immunity, it is not amnesty, it is an exercise of discretion so that these young people are not in the removal system,” she said. “It will help us continue to streamline immigration enforcement, ensure that resources are not spent pursuing the removal of low priority cases involving productive young people.”

The new policy will not grant citizenship to children who came to the United States as illegal immigrants, but will remove the threat of deportation and grant them the right to work in the United States.

According to the Department of Homeland Security, the policy change will apply to those who came to the United States before they were 16 and who are younger than 30 if they have lived here for five years, have no criminal history, graduated from a U.S. high school or served in the military.

A memo from Napolitano ordering the “prosecutorial discretion with respect to individuals who came to the United States as children” argued that those covered by the order “only know this country as home.” It said these people “lacked the intent to violate the law.”

The new policy will apply to individuals who are already in deportation proceedings, the memo said.

The policy change will accomplish portions of the Development, Relief, and Education for Alien Minors (DREAM) Act, legislation that has stalled in Congress amid Republican opposition.

I would ask just exactly where are the congressional republicans, but that would be utterly pointless given that those spineless wonders have been pretty much AWOL for the last eighteen months.

I really do not see that changing – not even for something as assinine as this.

Our country as being transformed into a dictatorship in broad daylight, right in front of God and everybody, and the sheeple do nothing.

And what is even worse, the government body charged with reigning in the power of the executive branch, the United States Congress, has apparently abdicated its oversight responsibilities.

Obama picks immigration reform advocate to lead domestic policy

President Obama has picked a strong advocate of immigration reform to head his Domestic Policy Council.

The White House announced Tuesday that Cecilia Muñoz, a former senior vice president of the National Council of La Raza, would replace Melody Barnes at the top of the council. White House press secretary Jay Carney announced the appointment during his press briefing.

Muñoz is now serving as the White House’s director of intergovernmental affairs and is in charge of outreach to state and local governments.

“The president has asked, she has accepted,” Carney said.

Muñoz is an immigration expert who worked for the National Council of La Raza, the largest Latino civil rights and advocacy organization in the United States, until she joined the administration in 2009. The group works to improve opportunities for Hispanic Americans and advocates legislation that would provide a pathway to citizenship for illegal immigrants.

Obama has frequently been criticized by pro-immigration reform advocates for not pressing harder for changes to the country’s immigration laws. Hispanic groups also have complained that the administration has stepped up deportations of illegal aliens.  

All of this has led to questions about whether Obama will garner strong support from Hispanics in his 2012 reelection bid. It is crucial to Obama’s reelection that he win a large majority of the Hispanic vote, particularly in critical swing states such as Florida, New Mexico and Colorado.

Carney called Muñoz “the best person for the job.”

Last I heard, the Dear Ruler had all but halted deportations of the illegal invaders, so I really do not get what the Hispanic groups have their boxers in a bunch about.

Nothing like a little election year pandering to the illegal aliens who have invaded our country. Of course, many of them will be voting in the upcoming 2012 election, and if recent polling data is to be believed, El Presidente Obama needs all the votes he can get.

ICE launches hotline for busted immigrants

As states across the nation ramp up their efforts to catch illegal immigrants, the Obama administration on Thursday launched a new free hotline for people busted on violations to get help.

The hotline, run by the U.S. Immigration and Customs Enforcement, is available 24/7 for detained individuals to phone if they think they “may be U.S. citizens or victims of a crime.”

The hotline will have translation services available in several different languages. ICE personnel will gather the caller’s information and send it to a field office for immediate action, according to the press release.

The purpose of the hotline and other measures are “to ensure that individuals being held by state or local law enforcement on immigration detainers are properly notified about their potential removal from the country and are made aware of their rights.”

The measures, which also include a new detainer form, have been introduced to ensure that people held on immigration charges are properly notified about their possible removal and understand their rights.

The new practices are “part of a broader effort to improve our immigration enforcement process and prioritize resources to focus on threats to public safety, repeat immigration law violators, recent border entrants, and immigration fugitives while continuing to strengthen oversight of the nation’s immigration detention system and facilitate legal immigration,” ICE wrote in its press release.

ICE is an arm of the Department of Homeland Security.

So if I read this right, the federal government is setting up a ‘free’ hotline we taxpayers will be on the hook for, and use the information to ‘help’ the incarcerated illegal aliens.

The only thing I want these criminals getting help with is finding their way back to Tijuana.

…if they think they “may be U.S. citizens or victims of a crime.”

How would one think they may be a U.S. Citizen? Seems to me they would already know.

As for being a ‘crime victim,’ I will just bet one of the crimes the feds will be interested in is law enforcement personnel actually enforcing our nation’s immigration laws – you know, people like Sheriff Arpaio.

And why is it I think some of the ‘information gathered” from the detainees will somehow find its way to the Dear Ruler’s “Justice” Department, and be used by his No. 1 dog washer, Herr Erich von Holderen, to intimidate and harass law enforcement agencies?

So where is the hotline for us law-abiding American citizen types to report on illegal alien invaders in our communities?

Parts of Alabama immigration law blocked by federal appeals court

From CNN:  A federal appeals court has blocked enforcement of parts of a controversial immigration enforcement law in Alabama.  The injunction issued Friday from the 11th U.S. Circuit Court of Appeals in Atlanta came after the U.S. Justice Department — supported by a coalition of immigrant rights groups — requested the legislation, known as HB 56, be put on hold until the larger constitutional questions can be addressed, a process that could take some months at least.

The 16-page order gives both sides partial victories, allowing some parts of the law to go into effect while others are temporarily blocked.

The Obama administration says the Constitution does not permit states to deter illegal immigration, saying an issue with foreign policy implications is the exclusive mandate of the federal government.

Among the provisions temporarily blocked from being enforced are:

  • One requiring state officials to check the immigration status of students in public schools.
  • One making “willful failure to complete or carry an alien registration card” a misdemeanor for immigrants.

But the state will be allowed to enforce these contested sections:

  • One requiring that police during “lawful” stops or arrests “attempt to determine the immigration status of a person who they suspect is an unauthorized alien of this country.” That provision is similar to other laws aiming to crack down on illegal immigration passed by other state legislatures over the past year.
  • One barring state courts from enforcing contracts involving undocumented immigrants, if the hiring party had a “direct or constructive” knowledge that the person was in the country unlawfully.
  • One making it a felony for illegal immigrants to enter into a “business transaction” in Alabama, including applying for a driver’s license or a business license.

The appeals court also announced it would hear oral arguments on the constitutional questions on an expedited basis, as early as December. The issues in Alabama and in other states with similar crackdown laws may ultimately have to be settled by the U.S. Supreme Court.

Alabama Gov. Robert Bentley, who signed the law in June, has said it would not have been needed “if the federal government would have done its job and enforced the laws dealing with this problem. However, they have failed to do that.”

I believe that the provisions the State of Alabama one are the most important.  Hopefully the state will win all the mandates they request and be able to do what the federal government has not been able to do (or refuses to do).

The Nation’s Cruelest Immigration Law” (editorial, Aug. 29), about a lawsuit by four church leaders against new restrictions by Alabama on undocumented immigrants, says that those who support enforcing immigration laws “have made many in this country forget who and what we are.” Indeed, I think The New York Times seems to have forgotten who and what we are.

The United States was founded on law and justice. The only earthly hope of protecting the equality and dignity of all mankind is with a rule of law that holds both the janitor and the senator completely equal in both benefit and constraint. This was the founders’ dream.     Continue reading

Labor Dept. Confirms: It Will Enforce Federal Wage Laws on Behalf of Illegal Workers

What part of illegal does our government not understand?

CNS News: The U.S. Department of Labor told CNSNews.com in a written statement on Wednesday that it will enforce the federal wage laws on behalf of anyone working in the United States “regardless of their immigration status.” The statement was in response to a written question from CNSNews.com.

The written statement backed up a video statement that Labor Secretary Hilda Solis made to CNSNews.com on Monday in which she indicated that “partnership” agreements she had signed that day with a group of Latin American countries will obligate the U.S. government to protect the working conditions for both “documented and undocumented” migrant laborers here in the United States.

The Labor Department’s determination to make U.S. employers treat illegal aliens taking jobs in the United States as if they were U.S citizens or legal immigrants seems to contradict the Immigration and Nationality Act. That act says “employers may hire only persons who may legally work in the United States (i.e., citizens and nationals of the U.S.) and aliens authorized to work in the U.S.” and that the U.S. government “protects U.S. citizens and aliens authorized to accept employment in the U.S. from discrimination in hiring or discharge on the basis of national origin and citizenship status.”

CNS sent a question that was: “Will the Department of Labor enforce existing law under the Immigration and Nationality Act that says ‘employers may hire only persons who may legally work in the United States (i.e. citizens and nationals of the U.S.) and aliens authorized to work in the U.S.?’”

A Department of Labor official responded: “The WHD [Wage and Hour Division] administers and enforces the law for all workers employed in the United States, regardless of their immigration status.”

During the signing ceremony, Solis said, “No matter how you got here or how long you plan to stay, you have certain rights. You have the right to be safe and in a healthy workplace and the right to a legal wage. We gather here today to strengthen our shared commitment to protect the labor rights of migrant workers in the United States. Unfortunately, due to language barriers and immigration status, migrant workers can be those that are most vulnerably abused.”

Glad to know they are working hard to not enforce our laws.  What a slap in the face to those that did obtain US citizenship the legal way.

Our Founding Fathers are again rolling in their graves.
