Constitutional Crisis: Democrats introduce bill to confiscate firearms in Missouri

Article 1 of the Bill of Rights of Missouri’s State Constitution says:

Section 23. That the right of every citizen to keep and bear arms in defense of his home, person and property, or when lawfully summoned in aid of the civil power, shall not be questioned; but this shall not justify the wearing of concealed weapons.

Today, Feb. 14, 2013, Democrats in the State of Missouri’s House of Representatives introduced a bill, HB 545, which will make it a class C felony to manufacture, import, possess, purchase, sell, or transfer any assault weapon or large capacity magazine.

“Assault weapon” is defined to include semi-automatic rifles, semi-automatic pistols, and semi-automatic shotguns. Exempted from the bill are government officials and employees, and members of the armed forces and law enforcement. If passed, HB 545 will render the State of Missouri into an effective police state.

If approved, HB 545 will become effective on August 28, 2013.

Introduced by Democrat Rep. Rory Ellinger, the bill is co-sponsored by Democrats Jill Schupp, Margo McNeil, and Rochelle Walton Gray.

The bill gives Missouri residents 90 days to turn in their assault weapons and large capacity magazines, or be prosecuted.

Here’s the entirety of proposed House Bill No. 545:

AN ACT

To amend chapter 571, RSMo, by adding thereto one new section relating to the manufacture, import, possession, purchase, sale, or transfer of any assault weapon or large capacity magazine, with a penalty provision.


Be it enacted by the General Assembly of the state of Missouri, as follows:

            Section A. Chapter 571, RSMo, is amended by adding thereto one new section, to be known as section 571.023, to read as follows:

            571.023. 1. As used in this section the following terms shall mean:

            (1) “Assault weapon”, any:

            (a) Semi-automatic rifle that has the capacity to accept a detachable magazine and has one or more of the following:

            a. A pistol grip or thumbhole stock;

            b. Any feature capable of functioning as a protruding grip that can be held by the nontrigger hand;

            c. A folding or telescoping stock; or

            d. A shroud attached to the barrel, or that partially or completely encircles the barrel, allowing the bearer to hold the firearm with the nontrigger hand without being burned, but excluding a slide that encloses the barrel;

            (b) Semi-automatic pistol, or any semi-automatic, centerfire or rimfire rifle with a fixed magazine, that has the capacity to accept more than ten rounds of ammunition;

            (c) Semi-automatic pistol that has the capacity to accept a detachable magazine and has one or more of the following:

            a. Any feature capable of functioning as a protruding grip that can be held by the nontrigger hand;

            b. A folding, telescoping or thumbhole stock;

            c. A shroud attached to the barrel, or that partially or completely encircles the barrel, allowing the bearer to hold the firearm with the nontrigger hand without being burned, but excluding a slide that encloses the barrel; or

            d. The capacity to accept a detachable magazine at any location outside of the pistol grip;

            (d) Semi-automatic shotgun that has one or more of the following:

            a. A pistol grip or thumbhole stock;

            b. Any feature capable of functioning as a protruding grip that can be held by the nontrigger hand;

            c. A folding or telescoping stock;

            d. A fixed magazine capacity in excess of five rounds; or

            e. An ability to accept a detachable magazine;

            (e) Shotgun with a revolving cylinder; or

            (f) Conversion kit, part, or combination of parts, from which an assault weapon can be assembled if those parts are in the possession or under the control of the same person.

Assault weapon does not include any firearm that has been made permanently inoperable;

            (2) “Detachable magazine”, an ammunition feeding device that can be loaded or unloaded while detached from a firearm and readily inserted into a firearm and includes a magazine that can be detached by merely depressing a button on the firearm either with a finger or by use of a tool or bullet;

            (3) “Fixed magazine”, an ammunition feeding device contained in, or permanently attached to, a firearm in such a manner that the device cannot be removed without disassembly of the firearm action;

            (4) “Large capacity magazine“, any ammunition feeding device with the capacity to accept more than ten rounds, but shall not be construed to include any of the following:

            (a) A feeding device that has been permanently altered so that it cannot accommodate more than ten rounds;

            (b) A twenty-two caliber tube ammunition feeding device; or

            (c) A tubular magazine that is contained in a lever-action firearm.

            2. No person, corporation or other entity in the state of Missouri may manufacture, import, possess, purchase, sell, or transfer any assault weapon or large capacity magazine.

            3. This prohibition shall not apply to:

            (1) Any government officer, agent, or employee, member of the armed forces of the United States, or peace officer, to the extent that such person is otherwise authorized to acquire or possess an assault weapon or large capacity magazine, and does so while acting within the scope of his or her duties;

            (2) The manufacture of an assault weapon or large capacity ammunition feeding device by a firearms manufacturer for the purpose of sale to any branch of the armed forces of the United States, or to a law enforcement agency in the state of Missouri for use by that agency or its employees, provided the manufacturer is properly licensed under federal and state laws; or

            (3) The sale or transfer of an assault weapon or large capacity ammunition feeding device by a dealer that is properly licensed under federal, state, and local laws to any branch of the armed forces of the United States, or to a law enforcement agency in the state of Missouri for use by that agency or its employees for law enforcement purposes.

            4. Any person who, prior to the effective date of this law, was legally in possession of an assault weapon or large capacity magazine shall have ninety days from such effective date to do any of the following without being subject to prosecution:

            (1) Remove the assault weapon or large capacity magazine from the state of Missouri;

            (2) Render the assault weapon permanently inoperable; or

            (3) Surrender the assault weapon or large capacity magazine to the appropriate law enforcement agency for destruction, subject to specific agency regulations.

            5. Unlawful manufacture, import, possession, purchase, sale, or transfer of an assault weapon or a large capacity magazine is a class C felony.

Should the insane proposed law be adopted, I’m happy for Missourians that the “bill gives Missouri residents 90 days to turn in their assault weapons and large capacity magazines, or be prosecuted.” That period of time will give traditional and patriotic Missouri Americans opportunity to move out of the state. I hope that these unworthy lawmakers will finally realize what they are doing. Isn’t it ironical how (with such moronic legislation) that they are putting themselves more at risk by attempting to create an illusionary “gun-free” cocoon for themselves and the rest of Missouri citizens?

  10. I live in Missouri and emailed Rory and Jill opposing the bill. I hope everyone who reads this article in Fellowship of the Minds will also email or write the representatives.

  11. Oh, and I did include an alternative solution. First, make government work more efficiently by collecting tax on internet sales, deliveries from internet business; and second, by working with mental health professionals to improve access to counsel and treatments.

    Despite there being 110 million rifles in the U.S., only 323 people were killed by ALL types of rifles in 2011, per FBI figures, not just the deceptively misnamed “assault rifles”, of which there are at least 4.5 million. (1)(18) Compare that to the 450 people who died of falling out of bed; (2) the 496 who were beaten to death with hammers or clubs; the 728 who were beaten to death with fists or feet; (1) the 16,500 who bled to death because they took NSAID painkillers; (3) and the 33,000 + who died in car accidents. (4)

    And according to Natural News, the report “Death by Medicine”, by Drs. Gary Null, Carolyn Dean, Martin Feldman, Debora Rasio and Dorothy Smith, the medical establishment kills hundreds of thousands of people in the United States every year. (5)

    Those deaths include:

    • 106,000 Americans killed from drug side effects
    • 115,000 Americans killed from bedsores
    • 98,000 Americans killed from medical error
    • 88,000 Americans killed from infections
    • 32,000 Americans killed from surgery
    • 37,000 Americans killed from unnecessary procedures

    If there were three or four instances of people ramming a car into a crowd and killing an equal number of people as the shootings, would we ban cars? If the anti-gun zealots were really concerned with public safety, they would go after these much larger problems first, but gun control is not about safety; it is about CONTROL of the people by the elite.

    At least 90% of the school shooters have been on pharmaceutical drugs, especially SSRI anti-depressants, which the makers admit cause suicidal and homicidal behavior. (6)(15) Ban the drugs, not the guns that protect people from harm, and arm teachers and administrators so that they can protect the students.

    In Israel teachers and parents, serving as school aides, are armed at all times on school grounds, with semi-automatic weapons. Since this policy was adopted in the 1970s, attacks by gunmen at schools in Israel have ceased. (21) In Utah, Concealed Carry License holders, including teachers, have been able to carry handguns into schools for twelve years with no mass shootings or accidents. Are our teachers less capable than theirs? Kansas, Oregon, New Hampshire, Texas and Hawaii also allow people to carry concealed handguns in schools. As Walter Mondale observed in 1994, “Gun bans don’t disarm criminals, gun bans attract them.” (14)(19)

    An attack such as Sandy Hook could easily have been done with several revolvers. You can quickly reload a revolver using a speedloader (the world record is 12 shots in 3 seconds), so to think that banning semi-automatic rifles would prevent such crimes is a mistake, and semi-auto rifles are rarely used to kill people anyway, as the FBI statistics prove.(23)

    What the anti-gun forces really want is to take all guns. Clinton’s Attorney General Janet Reno said in 1993 that, “Waiting periods are only a step. Registration is only a step. The prohibition of private firearms is the goal.” (7) Sen. Diane Feinstein said in 1995 that (concerning semi-autos, at a minimum) if she had had the votes, she would have said, “Mr. and Mrs. America, turn them all in.” (8) Washington Post columnist Charles Krauthammer said, “Passing a law like the assault weapons ban is a symbolic — purely symbolic — move in that direction. Its only real justification is not to reduce crime but to desensitize the public to the regulation of weapons in preparation for their ultimate confiscation.” (13)

    Banning semi-automatics is just the first step: the anti-gun radicals want to take them all. In Australia, they took the semi-automatics in 1996; now they are confiscating even bolt-action rifles. Expanding background checks to private sales will just assist them in identifying who has what in the event of an attempted forced confiscation from law-abiding citizens.

    Fifteen national polls, including organizations such as the Los Angeles Times, Gallup and Peter Hart Research Associates imply that there are between 760,000 defensive handgun uses to 3.6 million defensive uses for any type of gun per year, and over 95% of the time, they simply brandish rather than fire the gun to protect themselves. Would those who would take away guns rather have all of those people robbed, beaten, raped or murdered? (“More Guns Less Crime”, p.12, 2010 edition)

    A thirty round magazine sounds large, but in reality it may take many bullets to stop an attacker or attackers. A Tucson SWAT team invaded a marine’s home and shot 70 rounds at close range hitting him only 22 times. (17) Not only can one miss, but even a hit does not necessarily disable an attacker. A Georgia woman hiding in her attic with her two children recently shot an armed intruder five times in the face and neck with a .38 revolver and he was still able to flee. (16) If the most highly-trained cops can only achieve a 30% hit rate while under pressure, and if an attacker can be hit five times in the face and neck and walk away, that clearly demonstrates why average citizens defending themselves against an attack need a large magazine: They need to have enough ammunition loaded and ready to defend themselves against one or more armed attackers. Semi-autos such as the Bushmaster AR-15 are popular among men and women (light weight and low recoil) not only for self-defense, but also as target and hunting rifles as well. (9)

    Martin Luther King owned numerous firearms for self-protection, an aide described his home as “an arsenal”, and applied for a concealed carry permit, but it was denied. The Dalai Lama said, “If someone has a gun and is trying to kill you, it would be reasonable to shoot back with your own gun.” Mahatma Gandi said: “Among the many misdeeds of the British rule in India, history will look upon the act depriving a whole nation of arms, as the blackest.” (10)

    Gandhi also explains that someone who cannot use violence to defend themselves or their family is a helpless coward and a “worm.”

    In his own words from the text Between Cowardice and Violence:
    “He who cannot protect himself or his nearest and dearest or their honor by non-violently facing death may and ought to do so by violently dealing with the oppressor. He who can do neither of the two is a burden. He has no business to be the head of a family. He must either hide himself, or must rest content to live forever in helplessness and be prepared to crawl like a worm at the bidding of a bully …[When violence] is offered in self-defense or for the defense of the defenseless, it is an act of bravery far better than cowardly submission.” (11)

    In addition, the chief author of the Declaration of Independence and president, Thomas Jefferson said, “The strongest reason for the people to retain the right to keep and bear arms is, as a last resort, to protect themselves against tyranny in government.”

    George Orwell , author of “1984” and “Animal Farm”, wrote, “That rifle on the wall of the labourer’s cottage or working class flat is the symbol of democracy. It is our job to see that it stays there.” (24)

    And, finally, Sigmund Freud said, “A fear of weapons is a sign of retarded sexual and emotional maturity.” Let us not allow the emotionally immature among us to endanger the law-abiding vast majority by banning or reducing the effectiveness of these necessary tools for the protection of self and freedom. (22)

    Political idiots can’t pass laws that trump Constitutional Law…end of story.
    It doesn’t how far up the “Idiot Chain” you go. Constitutional Law trumps all.

    To turn in your guns will make you an automatic victim to all those “exemptions” that have guns. Why do Government officials and employees need guns? Why do they need protection, if no one else has guns?
    Allowing them to be armed will enable them to be domestic threats to the Public.

    It’s a mute point. You can’t pass laws that make law-abiding citizens into criminals. That makes the politicians the criminals for trying to do so!

Now it’s up to the Republicans in the state’s House of Rep. to stop this bill from even being considered by the state Senate. Failing that, the citizens of Missouri must rise. And if you/they don’t, then you deserve the government you have.

    Now, as the phrase set off by comas can be removed from the sentence per strict grammar without affecting its meaning, the statement reads:

    (b) Semi-automatic pistol that has the capacity to accept more than ten rounds of ammunition;

    Semi-auto pistol with removable magazine and various objectionable features is covered in part (c), but what kind of pistols that have more than a 10-round capacity generally (not otherwise specified as having a removable magazine or not, literally) are there? Anything with a removable magazine (see, no limit on how many rounds they can hold), especially anything with a standard magazine that hold more than 10 rounds (ooh, bad)!

    A comma fault (perhaps intentionally) in a binary “or” statement… love those gun-grabbin’ left/libtards. (Really, someone probably meant pistol or rifle with a fixed magazine originally, but that first coma– not needed in a series of two and used properly in the series of three that follows– got stuck in there by someone editing who knew better.)

The second amendment: “A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.” The question now is what do YOU believe? Do you believe that you have a right to bear arms, ANY arms, as the second amendment clearly states and that right shall NOT be infringed? or do you believe any one of these co-sponsors, with a bill, can and have the right to take away those rights? If you believe the co-sponsors, by proposing this bill, have the right to take away your right to keep and bear Arms, do you believe they also have the right to take away your right to freedom of speech, what about indefinite detention without a trial, fair or otherwise? Because whatever the outcome is here, it will set the precedent for all of the rest of it.

  33. The Constitution’s Second Admendment states that we have the right to keep and bear arms. Untill that is taken away from us (and there will be a bitter fight to do so), Missour’is HB545 should be rendered useless.

    One thing for sure if this bill passes(and I’m sure it won’t), they will never find my stach of weapons or ammunition. They won’t be moved out of state, but they will be close enough in case I’ll need them.

    There is no way in HELL I will give up my rights. Far too many were taken from us by good ‘ole G.W. like illegal search and seizure and Due Process. I’m damn tired of the Govt. running every aspect of my life. What are they going to do next? Take away our right to have SEX?????

    It’s about time that we start fighting back! Write everyone you know of in Govt. and tell them that you’r not taking this anymore. Something has to stop!
    It’s a God awful shame that our Pres. is using Sandy Hook to further his political agenda. Using the families by inviting them to the State of the Union.
    If thoes people would realize that they are being used like that maybe they all would have stayed home like they should have done instead following our leader like a bunch of lost sheep. The Pres. should hang his head in shame for what he is doing to thoes poor family members who lost their loved ones, but the sad thing is he really just don’t care.

    There are far too many sheep in this country afraid to speak their minds and let their true feelings come out.
    They don’t because they are afraid. Afraid of WHAT???
    I’m 62 and at my age I don’t care what I say or what I do. Piss on them on thinking they are gonna push me around. I’ll stand up and fight anyone anywhere. I just don’t care.

    Let me let you in on a little on a little secret. The United Nations are the ones that are pushing for us to abolish the Second Admemdment, confiscate and melt OUR guns. They have done this in other countries like Spain and England just to name a couple.

    If you go to the website IANSA.com, start reading, soak up all the information you can and then you will see who’s behind this all.
    Another thing I want you to do is to join the National Rifel Assoc. The more people they have, the stronger their voice will be heard in D.C.
    Believe me, they are not a radical group of country bumpkins, rather they are well educated men who will fight for our freedoms

    Wlii you stand up like a man, or will you follow like a sheep?

This is wrong, by definition an assault weapon is one that fires at a rate of automatic fire with the use of a selector switch Not Semi auto because it looks like one don’t make it one when you take all guns from law abiding citizens then only outlaws will have them. Thus giving them as you would have it sitting duck victims Please think about this an armed citizen deters an outlaw because they don’t know if your armed or nor take that away and crime will increase ask the English, and the Australians. This is not the answer

  35. the citizens of this country create our government that is supposed to do our bidding, we did not give them the power to enact their own laws. they are supposed to represent the wishes of those who put them into office. unfortunately, they are not doing that. they are traitors to themselves and to the american people . We know who and where in Washington from which this has. all developed. when are the people of our country going to wake up?
