Why the Electoral College method won’t work to reverse 2012 Election

U.S. presidential elections are not actually determined by the popular vote, but by the Electoral College.

There is a plan on the blogosphere, asking conservative and GOP voters in the “red states” to contact their Electoral College electors to ask that they refrain from casting their ballots next month for America’s president and vice president. The idea is that, according to Article II of the U.S. Constitution, this would mean the presidency vote would then devolve to the U.S. House of Representatives where Republicans have a majority of 241 v. the Democrats’ 193. Presumably, those 241 Republican House members would NOT vote for Obama.

Indeed, Article II does specify that if no person has a majority of votes by the Electoral College, then the House of Representatives would vote for the President:

Art. II: “the person having the greatest number of votes for President, shall be the President, if such number be a majority of the whole number of electors appointed; and if no person have such majority, then from the persons having the highest numbers not exceeding three on the list of those voted for as President, the House of Representatives shall choose immediately, by ballot, the President.

Alas, upon a closer reading of Article II, we must woefully admit that this plan won’t work. Here’s the reason:

If the House of Representatives were to replace the Electoral College in selecting who would be President (and Vice President), Article II specifies in that voting, the House of Representatives would do so as reps of their states, with each state having only one vote:

Art. II: “But in choosing the President, the votes shall be taken by states, the representation from each state having one vote.

Further, Art. II also specifies that a majority of all the states shall be necessary to a choice.”

All of which means that if the House of Representatives were to elect the President, there would be 50 votes (“the representative from each state having one vote”), instead of the present 435 voting members who comprise the House.

Of America’s 50 states, 24 are “red states” which presumably (a big “if”) would not vote for Obama. Assuming that the 26 “blue states” will vote for Obama, that means the House of Rep. votes will at best be 24 v 26.

26 is “a majority” — which means that the plan to convince the Electoral College electors from the red states not to cast their ballots so that the vote will go to the House of Reps, won’t work.

Does that mean we sit on our behinds and do nothing?

Hell No!

We still have the option of writing our state’s attorney general to ask him or her to look into the compelling and ever-mounting evidence that massive vote fraud was committed in the 2012 presidential election. (See “22 signs of Democrat Voter Fraud in 2012 Election“.)

This sounds like a good plan, and one which will provide a credibility to the grievance which would have been lost on the more quixotic approach.
    We are all thankful for your James’ successful outcome through his more personal ordeal, and will continue to be his and your Aarons and Hurs, lifting up you both in prayer as James continues to recover.

    Thanks for all the foot work, it was simple to send our request to the state’s attorney general.
    But I think you didn’t give the correct total of states; Obama said there are 58, not counting Alaska and Hawaii.

  5. Thanks, Dr. Eowyn, for taking the time to verify the best strategy. I noticed WND.com has posted another article about the 1982 RNC Consent Decree, (http://www.wnd.com/2012/11/gop-legally-barred-from-fighting-vote-fraud/)
    but oddly enough, they didn’t talk about FOTM’s suggestion of what could be done: contacting the AGs of these states to investigate reported cases of voter fraud. We’ve reached out to WND about FOTM’s suggestions. Hopefully they’ll create a link to this very informative website! To God be the glory!

I looked over the consent decree from the original 1982 DNC vs. RNC case and I did not see where it blocked the RNC from calling for investigations of voter fraud. http://brennan.3cdn.net/484c0b5d69fb0379c1_kzm6b9f2t.pdf and the whole article, http://www.brennancenter.org/content/resource/dnc_v_rnc_consent_decree/ Have any non RNC lawyers looked at this ruling. I do not believe that the RNC has been truthful with us for a long time and I would not just accept this from them and quit. Also I thank Dr. Eowyn for the efforts and Terry for his but I want to be doing what is attainable and not just being busy to make myself feel like I am doing something. The RNC has been playing us and we must vet everything they say or they will hose us and we will lose our freedom to a bunch of globalist.

    • I recently watched the Video Thrive. It has similar material found on a John Birch video and another Conservative Christian video. This, however, was from a rather Left Leaning group and it shows that much like the Occupy and Tea Party movement have much in common, we have been divided by these globalist elites who threaten our Democratic Republic. If we can only put the animosity and divisive rhetoric aside and realize that we have all been played and will work to actually mount a unified assault on this affront to our electoral process and our Constitutional government.
      I would recommend that you all watch this video and look for the common points that are being stressed by the Left that are also being stressed by the Right and let us stand as Americans of the UNITED STATES.

  9. The only problem with letting the people spin their wheels to no avail is that after doing this a number of times with 0 results, people tend to stop trying. Realizing just how set up these people, whom we are trying to oppose, are should not be a discouragement but rather add a sense of urgency to find things that we can be doing that will have a possibility of success. To just keep people busy is not the way to keep people mobilized. We have been following a Blue Print for electing conservatives that was created by those who seek to keep conservatives out. They are many steps ahead of us because they know what steps we will try to take. It is time to get everyone thinking outside of the box and find the loopholes that they missed from which we can attack with purpose and a chance for victory.

  10. I am not sure the statement above 26 Democrat states and 24 Republican states is correct. I saw elsewhere the number of states with Majority Republican Representatives in Congress is 30, or another place 33. I have not counted myself. But the visual District by District Red v. Blue map sure suggests the Republican states outnumber the Democrat states.

    • Thank you for your comments, James. To my knowledge, the designation of a state as “red” or “blue” is based on how a state had voted in a presidential election, rather than by whether the state’s legislature is predominantly Republican or Democrat. Indeed, my understanding is confirmed by Wikipedia:

      “Red states and blue states refer to those states of the United States whose residents predominantly vote for the Republican Party (red) or Democratic Party (blue) presidential candidates. This terminology came into use in the United States presidential election of 2000 on an episode of the Today show on October 30, 2000 … the terms were coined by [the late] journalist Tim Russert.”

      However, your interpretation of “blue” & “red” states is in the context of the House of Reps (instead of the Electoral College) voting for the President. Since Article II of the US Constitution says in that vote, each state is to have one vote, then it is conceivable that the 50 states might vote in accordance with whether the states’ legislatures are mainly GOP or Dem. Your point is most interesting and casts a welcome ray of hope!

  11. Another aspect of our Constitutional Republic is the Grand Jury, the “Fourth Branch” of government. (Justice Scalia and others so describe it…)

    Contrary to the will of the Tweed appointed prosecutor, the Citizens on a Grand Jury caused the fall of the notorious Tweed Ring in New York.

    A Grand Jury in Minneapolis indicted the Mayor and Police Chief at the turn of the last century, likewise in San Francisco.

    A Grand Jury in Chicago in Operation Greylord during the Reagan era resulted in something like 39 judges being arrested, and most convicted.

    A Grand Jury, NOT a Congressional committee, led to first 7 “Plumbers” being indicted and convicted in the Watergate burglary, and then 7 White House staffers being indicted for Perjury and Obstruction of Justice.

    A Grand Jury can investigate and indict public servants in ANY of the other three branches of government, including Election Board workers.

    Justice Scalia in the United States v. Williams, 504 U.S. 36 (1992) opinion described as the “fourth branch of government”, and quoted Justice O’Connor in the unanimous United States v. R Enterprises, Inc., 498 U. S. 292, 297 (1991):
    “The grand jury’s functional independence from the Judicial Branch is evident both in the scope of its power to investigate criminal wrongdoing and in the manner in which that power is exercised…
    …the grand jury can investigate merely on suspicion that the law is being violated, or even because it wants assurance that it is not.”

    Let US, We the People go to OUR local Grand Jury to have it investigate Fraud by our Public Servants, including in the Election Board and Polling Places.

    The numbers for the Republican Party members look low, I have seen the number to be 243.

    But the point in relation to the above blog post challenging the viability of the “Set Aside the Electoral College” strategy in favor of the “Contingent Voting Procedure” of this Constitution, the One Vote per State in the House of Representatives appears to be a clear win for the GOP ticket.

    • James, I believe that the states and the judicial system (your proposal of Grand Juries to look into vote fraud) are and will be what could save America. Thank God for the Founding Fathers having the wisdom to devise a FEDERATION (instead of a centralized political system like England or Japan, wherein the national govt holds all power), a rule of law (thus, grand juries), as well as the 10th Amendment to the U.S. Constitution!
